Thank you for reaching out today and callingI am including a copy of the original letter that was sent certified mail, but never delivered, for your reviewI would like you to see that the moment we knew there was a problem, we sought to remedy it We are also in receipt of the letter and invoice you provided to [redacted] ** As I mentioned to you on the phone, we could have solved this problem in less than minutes with some muriatic acid, if we had had permission to work on your property The bill that was presented for payment, the $400, is excessive and we are seeking a compromise on itEven if we had done a full remove and replace, it would be half thatThe bill is for $What if we had been presented with a bill for $900? Or $1,600? Would we simply have to pay it? It hardly seems fair Please read the first letter and see that we tried contacting you to no availI know you stated that the crew must not know what they are doing, but as I mentioned before, you would be hard-pressed to find a better crew in the regionWe have somewhere around forty houses in you development alone that would tell you we are both competent and professional Let me know what you think please

The best way to address this complaint is sentence by sentenceIt is true we did the backyard project next door to the person writing the complaintIt is also true that in the process of installing an exposed aggregate
finish that the wash went onto the lower property of the person writing this complaintIt is not true that it was so thick it couldn't be removed--it could have easily been removed with a muriatic acid wash in ten minutesWe were not aware of the problem until we were notified by our client on a Sunday, at which time I called the affected homeownerIt is not true that I yelled at herIt is true that I raised voice and asked if she was a racist, based on the disparaging remarks she made about the Mexicans working for me that couldn't even speak Englist is true that I sent a registered letter the next day on Monday because I wanted her to see the timeline of our response, which included me at her property on Monday morning to meet her and resolve the issue--she never accepted the letter from the post man, nor bothered to retrieve it from the post officeIt is true she had the concrete removed and replaced and sent the bill to my clientIt is true that I sent an additional letter to her, with a copy of the first letterIt is not true that I did not offer compensation, as I offered a compromise, seeing we could have done the work at half the cost at worst, and a tenth of the cost if she had allowed us access to her property when we were first made aware of the problemHer opinion of the quality of work is irrelevant as she did not hire usThe opinion, however, of the other FIFTY homeowners in the Elk Grove Del Webb development that we have worked for does matterAnd with them, our reputation is flawlessIt is not true that the crew was unsupervisedThe crew actually had two foreman on it, one with over twenty years of experience and one with sixteenIt is true that we are responsibleMy complaint at this point is the cost of the claim, seeing it is more than double what is reasonableHypothetically, she could have presented me a bill for $or $and then what? I would just have to pay because she said so? This is the first time in over 2,jobs I have ever had to deal with the Revdex.com or a formal complaint from a customerI have never been sued and never been to courtMy reputation is stellarAt this point it would have been easier, and cheaper frankly, to have just cut her a check to make her go awayBut I am in the position I am in because I am standing on the truthThe sequence of events and the words exchanged cannot be alteredGetting to the truth is sometimes hard, especially when dealing with someone who seems to remember selectively and conveniently

Okay, this is going nowhere Her check is in the mail along with a third letter Revdex.com is copied in to all correspondence There's a reason that Revdex.com has never heard of me, and that's because we never have complaints This isn't even my customer If this were a court of law where a lie detector test could be administered, then I might feel like I have a chance Right now, it's a person on a rant and disassociated from the truth Essentially, it's a legalized form of extortion Do what I say you have to do, or I will blast you online and in the community Take the opportunity to talk to your neighbors They will tell you what good work we do, and show you some of the best yards in the whole development Let's hope you can take your check and just go away now, quietly

I am rejecting this response because: The business damaged my property, and offered a bandaid solution, which was not acceptable to me. The sidewalk was undamaged, and only eight months old, when they purposely damaged it. I say purposely, because with all the experience which the business owner claims that his crew possesses, they knew or should have known that they were damaging my property, and did absolutely nothing to mitigate those damages. When I was contacted by the business owner, his response to me was to begin by telling me how knowledgeable and experienced his crew is, and what a great job they always do. He has done this again in his response to my complaint. I am frankly not interested in hearing how great they are, because my experience has shown this to be untrue. It is possible that he could have made the repair to my satisfaction is he had ever acknowledged that his crew had made a mistake and that the mistake needed to be corrected. Instead, he trivialized the damage, called me a racist when I questioned the ability of non-English speakers to properly communicate, and didn't even offer to meet with me to discuss options for mitigating the damage. The letter he claims to have sent me was never received by me, so its contents are not relevant to this discussion. He had my telephone number, my email address, and the address where I live. He should have made a concerted attempt to contact me, yet he failed to do so. I had a landscaper scheduled just subsequent to this incident, and had that landscaper repair the damage at a cost he quoted to me. I did not hear from the business owner again until some weeks subsequent to this time, and that was after I got his name and contacted him. He has sent me a letter in which he offers no payment for the damage my property has suffered at the hands of his experienced crew who he claims have years of combined experience. I find his assertions about the quality of his work and that he has never received any complaints to be laughable. If he were acting in a professional manner, his first response when he contacted me would have been to offer an apology and to offer to come out to the site and review with me the damages. I have yet to receive any apology. I had to go forward with repairs because he was unwilling to act in a professional manner. The landscaper I had hired was very reasonable in the bid to put in my yard. I have no reason to believe that the quote he made to replace the concrete was inflated. If the business owner in this case actually costed out how much it would cost to demo the affected sections of sidewalk and repour the concrete, including the time and labor of the person or persons to do the work, he would (if he were honest) have to admit that the quoted price to repair the damage was within estimates for this area. Whether he thinks that I should be satisfied with his scraping off a brand-new sidewalk or etching it with muriatic acid (which he did not suggest when I first talked to him), then he should reconsider. Not everyone is willing to have an unsatisfactory remedy foisted off on them just because it is cheaper or easier for a contractor than to supervise his crew and actually check on a job when it is completed

Thank you for taking the time and effort to file a formal complaint against me with the Revdex.com. You should congratulate yourself for being the first to do so in any capacity in over 2,000 customer, both for my own company and the companies I have represented over the years.

It is clear from your recollection and sequence of events that this written argument is going nowhere, and consuming more time than I care to allot for it. You and the truth are not in the same room.

From a conscience standpoint, I will be able to stand before God and know that what I have written, said, and recounted both to you and to the Revdex.com is true. When you stand, and you will, you should hope that you have come to terms with you own recollection.

Enclosed are two checks. One check is for $200 and another is for $200. Our worst case scenario to replace your concrete would have cost us $200. Your contractor took advantage of the situation by billing that at $400, and your reply to me at the time was a very cavalier, "oh well, that's life." You can cash the one and be fair, or cash them both. It's your choice.

I will send a copy of this to the Revdex.com in response to your complaint. Frankly, I don't have the time or the energy for a prolonged conflict or argument with a vitriolic person, one bent on tearing down something that someone else has built and is building. I'd be willing to make a bet, if I were a betting man, that this is not your first brush up with someone, that it's not your first complaint to the Revdex.com, and that it's in fact a pattern of yours that has played out over the years if not decades.

At this point I consider the matter closed.

Thank you for reaching out today and calling. I am including a copy of the original letter that was sent certified mail, but never delivered, for your review. I would like you to see that the moment we knew there was a problem, we sought to remedy it.

We are also in receipt of the letter and invoice you provided to [redacted].

As I mentioned to you on the phone, we could have solved this problem in less than 30 minutes with some muriatic acid, if we had had permission to work on your property.

The bill that was presented for payment, the $400, is excessive and we are seeking a compromise on it. Even if we had done a full remove and replace, it would be half that. The bill is for $400. What if we had been presented with a bill for $900? Or $1,600? Would we simply have to pay it? It hardly seems fair.

Please read the first letter and see that we tried contacting you to no avail. I know you stated that the crew must not know what they are doing, but as I mentioned before, you would be hard-pressed to find a better crew in the region. We have somewhere around forty houses in you development alone that would tell you we are both competent and professional.

Let me know what you think please.

Review: TSD Construction was hired by my next-door neighbor ([redacted]) to landscape her back yard. In pouring concrete, they allowed concrete wash to flow onto my sidewalk and coagulate around my garbage cans. This accretion was thick enough that it could not be easily removed. The construction crew made no effort to see the damage that they caused, or to contact me so that I could remedy the situation when it occurred. I did not notice the damage until five days later, when the concrete of course was hardened. When I contacted the homeowner, she contacted [redacted], owner of TSD Construction. His response was to phone me and start yelling at me and calling me a racist, at which point the conversation was no longer relevant to the issue. I had the concrete repaired by removing it to restore it to its original condition, and presented the homeowner with a bill for $400. [redacted] has sent me a letter in which he refuses to pay any part of the bill, because it is "excessive."I did not ever hire this contractor, was not impressed at all with the quality of the work performed by his unsupervised workers, and was not willing to have them return to further damage my property. Both he and the homeowner who hired him are responsible for this situation, and because he is licensed and bonded, he should pay for the damage which his crew caused.Desired Settlement: Contractor [redacted] to pay $400 to repair the damage his crew did to my sidewalk.

Okay, this is going nowhere. Her check is in the mail along with a third letter. Revdex.com is copied in to all correspondence. There's a reason that Revdex.com has never heard of me, and that's because we never have complaints. This isn't even my customer. If this were a court of law where a lie detector test could be administered, then I might feel like I have a chance. Right now, it's a person on a rant and disassociated from the truth. Essentially, it's a legalized form of extortion. Do what I say you have to do, or I will blast you online and in the community. Take the opportunity to talk to your neighbors. They will tell you what good work we do, and show you some of the best yards in the whole development. Let's hope you can take your check and just go away now, quietly.
