TT Marketing, LLC Reviews (1)

Ms. [redacted] willingly went into a 12- month advertising agreement with us to do Facebook advertising. In regards to her cancellation, there were multiple lines of communication via email, phone, etc. prior to sending the customer to collections.  It is stated very clearly and in multiple...

locations in our contract, the payment obligations in regards to early termination.
Excerpts from contract:
Payment terms:  CLIENT will be required to pay $700/month to TT Marketing via ACH pay (preferred), or recurring credit card. Additionally, client agrees to pay Facebook directly for paid advertisements.
By signing this agreement, CLIENT authorizes TT Marketing to charge Credit Card or Checking Account provided on a monthly basis, until termination of agreement. The full contract price of $7000 is divided up in the agreed contract length and must be paid in full in the event of early cancellation.
1.1   Termination.  This agreement is a legal contract binding T & T Marketing and CLIENT to the contract length stated in 6.1, and corresponding fees written in section D for the length of the contract.  After initial term, CLIENT may terminate services by giving a 30-day written notice.  (30 days before recurring billing date) If client wishes to terminate services before the contract date, client is responsible for the full contract fees for the length of initial contract as the first half of contract is heavily weighted and fees are spread out equally into the first payments. Under no circumstance will a refund be issued for services already performed.
When we first received notice of cancellation, this was my emailed response back:

Good Morning [redacted],
It's been brought to my attention that you have expressed a desire to end your agreement with TT Marketing. Shelby has let me know that you won't agree to meet in person to go over this, so I wanted to send over the a copy of your agreement so you were aware of your obligations.
Please see the attached contract which states that your contract is not eligible for cancellation until 3/24/2017.  Termination verbiage is stated in section B, D, and 6.1, 6.2.
She responded saying we posted porn so wanted to 'mutually terminate'. No porn was ever posted on her page. She owns a motocross store, and a photo of a bike was posted and in very small lettering in the background was simply the name of a porn site,'Brazzers' as they were a sponsor of this event. The post was removed at the customer's request. She also made invalid claims that we had wrong hours, etc. Ms. [redacted] simply wanted out of an agreement and was making things up which were not true in order to get out of the agreement.
This was sent in response:

Shelby looked into all details with regards to your concerns and has documented the information that you were concerned about. This was to be presented in person and discussed; however, you refused.
This is the first time anyone at TT has heard about concerns regarding your days or hours; however I have double checked and cross referenced and they do reflect what you have on Google and what you shared with us in the beginning of our agreement. I know our team has reached out to you multiple times since we began working on the page without any response.
We pride ourselves on top performing work and would like to be informed immediately if there had been a problem and we would be more than willing to correct any errors and increase our knowledge, or to offer a financial break. Article C on the agreement explains due diligence on behalf of the client with regards to communication.
If you still wish to terminate early, the remaining contract price is $3,229.02 which would pay out the remainder of the contract.
I never received a response.
We sent 2 subsequent requests for payment with warning of us taking action and sending to collections. We received no response.  When we had not heard anything back by the end of December, we had no choice but to send the client to collections.
We are a service provider, and do not have any initial onboarding or setup fee which is why our payment terms are set up the way they are. The work we do is heavily weighted into the first half of a contract, so in order to keep costs relatively low we spread out the contract price over a period of months for the client. The contract she signed had a full contract price of $7000 over the course of 12 months. She stopped payments after only paying $3770.98 of this contract to which she is legally bound, which is why we were forced to send her to collections.
Best Regards,
Sarah
