I am rejecting this response because:the car operated fine until strut failed car immediately started to make hissing noise after the strut failed and the right-hand side of the car dtopped to inches it never did that prior to its failure I do not understand how the inspector could say that that’s the way the car was running what it obviously couldn’t even be driven after that pointThe right front fender was hitting the front wheel taking chips out of the tire because it was Clearly rubbing the tire The malfunction light came on on the dashboard showing that the leveling system was not operating at that time as wellYou could clearly hear hissing which is the air escaping the self leveling system coming from that right productYou never heard that sound before the failure If the strut was working properly which is a significant part of the hydraulic system to keep the car level this would not of happenedIt didn’t happen until the system broke Do they honestly expect me to believe that Mercedes Benz sold me a car that was not drivable and I drove it for over two months and miles in that condition just waiting to file a claim

We do not contract with the sellers that the customer is referencing. Rather, the call center/seller contracts with us to administer the service contracts they sell. The customer is inaccurate that we can be held liable for their calls, a recent court case that was won at the appellate level (one step below the US Supreme Court)The final opinion can be found at http://cdn.ca9.uscourts.gov/datastore/opinions/2017/08/09/15-17328.pdf. We are hereby requesting that the Revdex.com remove this complaint from CarGuard's profile, as not only did we not place the calls, but legally we cannot be held liable for them

This claim was filed on 2/27/An inspector was sent on 3/1/The inspector determined that the cause of failure pre-dated the sale of the contract, and the contract was denied under the "Exclusions" section of the contractAn inspection report was generated and is on file. To Whom It May Concern (Revdex.com):CarGuard Administration, INC is an administrator of Vehicle Service Contracts. This means that a direct marketing seller or a dealership pays CarGuard a fee to administer claims on their behalf and be the party that is obligated to pay claims on the Service Contract...

Form. CarGuard does not engage in marketing of any kind directly to consumers. CarGuard currently has over 40 entities, both dealerships and direct to consumer sellers, who sell service contracts. We have no way to know, based on the limited information provided, who actually initiated the call, however it was not CarGuard.We have sent out a mass e-mail to all of our sellers telling them to add the number and name on this complaint to their internal DNC Lists, however, CarGuard does not make the calls, is not liable for the calls, and therefore this complaint is not against CarGuard. To address eh allegation that the customer wasn't provided the seller's information, it is a violation of our CarGuard seller agreement for a seller to not disclose their identity and properly explain this relationship. We are hereby requesting this complaint be closed out as "Information Only" because the entity in question that this complaint is about is not CarGuard Administration. Signed, Elijah N[redacted]CEO

To Whom It May Concern:This customer purchased their contract from JR Auto Protect on December 22nd, 2017. The customer went online and found JR Auto Protect and then purchased the contract. There was a 30 day/1000 mile waiting period on the contract that the customer had to wait before any...

claims could be filed. Only 19 days after the waiting period expired, the customer filed a claim for over $5,000. It was an engine claim and an inspector was sent. An inspector found that the failure occurred prior to the contract being sold, so the claim was denied due to a pre-existing condition. It is a common occurrence for people to purchase service contracts when there is already an issue with the vehicle. The purpose of the service contract is to fix issues that happen after the date the contract is sold, not before. It is for this reason that the claim was denied. Signed,CarGuard Administration, INC

To Whom It May Concern:While CarGuard may be responsible for paying claims after 30 days, they are only claims whereby the failure occurred after the first 30 days. The inspector determined when the inspector was sent out that the condition pre-dated the sale of the service contract, and thus the claim is denied under the terms and conditions of the contract as a "pre-existing" condition. We would be happy to provide the customer a copy of the inspection report if the customer wishes. Signed,CarGuard Administration, INC

I am rejecting this response because: The Original response to the claim from the company "This customer took the car prior to us being able to pay for the repair." -- Correct the repair shop released the vehicle in the anticipation of the payment. What are your expectations? I should have left my vehicle at the shop for nearly 3 month, since you never sent the check to the repair shop"Upon investigation, as a customer service courtesy, we are reimbursing this customer. A check will be disbursed tomorrow and mailed to his address." -- What "courtesy". The reimbursement of the approved claim is an obligation not a  courtesy. You have failed to timely send a check directly to the shop.  Here some email correspondence:Me to Company: 01/11/18    Could you please send the payment to the shop asap?  Company to me: 01/11/18 The claim is with Accounting.......Do you have your vehicle? Or are you still waiting to pick it up? I checked with accounting and it is in line to be processed.Me to company:02/13/18We are yet to receive the payment. I was assured the check was mailed out last week. Could you please follow up on the payment. I believe the processing time is way overdue. Company to me:02/14/18:i will check on this today.  and so on..... up until today no check "We hope this resolves this customer's complaints. " - The complaint will be resolved once the approved claim is going to be paid. So far no payments

I am rejecting this response because: I did not google or solicit car guard they called me repeatedly attempting to sell me an extended warranty contract. The part that failed worked perfectly until the date of the failure it was well after the contract was entered into all the pre-conditions were met. They insured the car after  30 days and or 1000 miles. The failed part a hydraulic strut would make the car undrivable during that period How could I Possibly drive 1700 miles without a hydraulic system where the car was 4 to 6 inches lower on the right-hand side than the left and making it impossible to drive and make turns without the wheels rubbing on the vehicles body The car was inspected prior to its sell by Mercedes Benz and there were absolutely no defective parts

To Whom It May Concern:Mr. [redacted] purchased a Vehicle Service Contract from one of our sellers, [redacted] in Stuart FL on September 9th, 2016. On November 15th, 2016, Mr. [redacted] took his vehicle into Webb Hyundai reporting engine issues. After sending an inspector out to the...

repair facility, it was determined that the engine oil was 2 quarts low due to a lack of maintenance. Per the terms and conditions of the service contract, the claim was denied. After receiving this complaint, we reached out to the seller, [redacted] and they agreed to issue the customer a full refund for all of the money they paid into the policy, which totaled $300.18. The customer stated they were satisfied with this resolution. A copy of the cancelled check from [redacted] to the customer is attached to this response.  Signed,[redacted]Chief Executive OfficerCarGuard Administration, INC
