Tunis Excavation

On March 16, 2017, my husband and I hired Frank T to use his loader to dig us out of the snow we received a few days earlier due to the large snowfall (we received about 2 1/2 to 3 ft of snow. Frank Tunis provided the service and was paid $350 for snow removal/plowing of our long driveway and private road. My husband noticed that day that Mr. Tunis damaged some of our wooden (Cedar) split rail decorative fence that we have on our property. As the snow melted the damage became more evident. We have one line post and 4 rails damaged. I contacted Mr. Tunis and he said that he didn't hit the fence it was from pushing the snow. He came up to look at it. At that time he said to see if we could get the same fence (we need cedar , split rail that matches the standing post- it should also be noted that the fence that was damaged is near to our well so we do not want to put pressure treated fence into the ground if we can help it) I didn't hear anything for a few weeks but my husband and were calling around to fence suppliers, lumber yards and anywhere else we could think of to get replacement fence. The place we had purchased it was out of business. I did find a place in OH and got them to forward me an estimate. the price for the fence and shipping is about $460.00. I called Mr Tunis again and he stated he had turned it into his insurance company. Shortly thereafter we received a call form Liberty Mutual on or around May 2, 2017. We provide them with additional pictures. Since then I have called LM 4 times to ask what the status is for the claim and they are not returning my calls. I called Mr Tunis on 5/29/17 and he told me to call them or his agent again. I told him that since he was the insured he would have to call. He told me to calm down and it was just "Old, rotten fence " and hung up on me. At this point I have no idea if he is going to fix my fence and since he hung up on me it doesn't appear that he is interested in doing so.
