Although we are always upset when something happens to upset a resident we also try and get both sides of a storyMs*** did call the police on February 18, to report a break in by a resident of #*** and subsequently contacted the onsite manager to make a complaintAt that time she stated
to the manager That her [Pod & Beats (headphones) were stolen, however the only items stated in the police report was a cup with $and a new pack of cigarettesThe manager stated to her that we would start our own inquiry as it would take several days for us to obtain a copy of the reportThe manager then proceeded to contact the residents of Unit ***The resident has stated to us that he cannot recall anything happening as he had been partying all night and had an alcohol fugue.Our investigation along with the police report have produced the following facts to us:No other person according to the police report witnessed this break inAs she is located on the 2" floor an intruder could not have gone through a window without a ladder and no ladder was foundThere is no physical evidence of a break in, i.eno broken locks or damaged doors therefore we are not sure how an intruder got inMs*** approached the alleged intruder on the afternoon of and assaulted him drawing blood complaining about her iPod & BeatsThis was witnessed by several residentsThe resident did not retaliate and retreated into his apartmentMs*** stated to the police that she only knew him as being a resident and the son of one of her mother's friends, however on her Facebook page she stated she met him through a friend and that he had been to her house I time beforeAlthough the police have interviewed the alleged intruder there have been no arrests made at this time.Ms*** may have indeed experienced an intruder however I don't believe all the facts have come to lightWe are in no way trying to justify anyone being in a unit unlawfully however I cannot imagine trying to hold onto an intruder while called the police if I was indeed fearful of the individual (she stated in the police report that she attempted to hold onto him while calling the police)In addition I don't believe Ms*** would have approached someone she was fearful of and assaulted them over stolen items.Our only conclusion at this time is that this incidence was an excuse to break her leaseMs***, like any other resident, is required to abide by the terms of the lease which required a day written notice to vacateUnless further facts are discovered to the contrary she is liable for the rent for March through April 7th and the re-letting fee for moving out early

We stand by our original response due to the police report and witness statements.  We will revisit if further evidence or proof is provided.  The method of entry is important in this case as the complex cannot be held responsible if the resident was careless or had a bad lack of judgment.  Ms. [redacted] was known to have socialized with this individual at least on 1 occasion and by her actions on the police report did not seem concerned with her well being either during the "alleged" burglary or later in the day when she approached the suspect of which we have eye witnesses which does not include the manager. In addition Ms. [redacted] left her unit very dirty and with at least 2 holes in the walls.  At this time we remain neutral and following not only policy & procedure but fair housing laws as it has not been determined if there was a burglary.  Until a determination can be made our original assessment stands.

I will not accept this offer due to the fact [redacted] has no proof about the supposedly confrontation. Regardless of how the intruder entered he still broke an entry. It does not matter how he got in. Its the simple fact that he broke into my apt and my peace at my mind is not at ease. My lawyer Mr.[redacted] will be contacting Royal Palm. This situation is not right at all. and I will be taking further action to this. I will not pay to leave a place where I was not planning on leaving. The only reason why I broke it was because of the fact they broke into my apt. I didn't give a 45 day notice, because like I mentioned I was not planning on leaving the apartments. Unexpected things happen just like the situation that occurred with me. I will not be paying it, there is no reason why I should when this happened and its a month that my lease is up. I will also be Taking further action on Ms.[redacted] for falsely accusing me of harassing the resident.(which that has nothing to do with you guys) but She should not be making assumptions based of the residents family. To be clear they did arrest him and he is out on bond until we go to court. Thank you for your time. They will be hearing from my lawyer.
