Symbol;">· I am a Broker, not a Dealer or Owner of the boat the Fitzhenry’s purchased I was hired by the Owners simply to sell their boat My Company does not have warranty on boats we represent · My Clients sign a Brokerage Agreement; line is ‘Good Faith Agreement’ for the Seller/Owner to either disclose issues or confirm there are none known Based upon the opinion of a Certified MerCruiser Mechanic, a flawless Sea Trial, the Buyers personal inspection and some heavy usage without issue since they took delivery, certainly there were none at time of purchase · Holly, her husband ***, Mother and Father (an experienced boater) all came up this past winter to inspect the boat and decided to make an offer to purchase Under the conditions of the offer were a couple contingencies as part of their due diligence A Mechanical Inspection where the Fitzhenry’s hired a Certified MerCruiser (engine brand) Mechanic and a Sea Trial (test drive) · The Fitzhenry’s purchased the boat on March 23th and took ownership · As a protection mechanism for the Fitzhenry’s, my company holds a pre-determined amount of the purchase price in escrow (in this instance $3,500) which the Sellers receive once contingencies are met and delivery is taken If issues are found during Mechanical Inspection or something not working properly during the Sea Trail, that money is used to either pay for or re-negotiate the purchase terms; it is not a warranty as implied by [redacted] · The Mechanical Inspection was performed on both the engine and the drive (the part which is now not working properly) The Certified MeCruiser Mechanics diagnosis was that everything was working as it should · The Sea Trial took place on May 1st The boat performed flawlessly and both Holly and her Father were very impressed by the ride and specifically by how smooth the engine ran The sellers were paid the balance from escrow; the Fitzhenry’s took the boat to Chicago and the deal was officially completed · As with all Brokerage boats there is no warranty They are sold ‘as-is’ as shown on the Invoice Warranties may be purchased from 3rd party companies if a buyer chooses This boat is years old and the factory warranty expired years ago · The boat was in 100% sound working order the day it was delivered on May 1st and the Fitzhenry’s were 100% satisfied · The boat continued to run well and provide over hours of run time without any issues (keep in mind this boat only had total running hours over all years) They have nearly doubled the engine hours since purchasing the boat without problems · Now, months after purchasing the boat and over months of heavy usage, they are having a mechanical issue Unfortunately, boat repairs are common and it is an expensive hobby · Also noteworthy, this is the very first boat the Fitzhenry’s have owned Neither Holly or [redacted] have experience running, maintaining or have any formal training on navigation There is no way of knowing how the boat was treated since they took possession I am very empathetic to the financial stress they are experiencing; however, it is not my responsibility to pay for the long-term expenses associated with their used boat purchase Nor should the unfortunate repair issue effect my good name Prior to receiving this letter, I offered help by referring a mechanic who could fix the drive for roughly ½ the cost she is being quoted in Chicago Holly said she trusted her local guy and was willing to pay twice the cost Somehow she feels mislead I could bombard you with dozens of emails and countless hours of phone conversations and texts exhibiting my helpfulness and sharing of expertise It’s disheartening because I work very hard to ensure a positive experience for my ClientsHope this is helpfulBest personal regards, [redacted]

There was no information given which was ‘false or misleading’.  Damages were never ‘covered up’; [redacted], her parents and the mechanic all noticed the damaged prop set prior to making the purchase.  They discussed repairing the prop after the purchase since [redacted]’s mother had a source in their area but decided not to do so.  Since the boat was working fine for several months, it is entirely possible internal lower unit damage occurred from vibration running with off-balance props for over 50 running hours instead of spending the money to have props repaired as recommended. The factory warranty expired 6 years ago and it was extremely clear there was no warranty on this used boat purchase.  [redacted] bought a fine working boat in used condition, hired a third party to mechanically inspect, water tested and then enjoyed the boat for several months operating over 50 running hours without problems.  Furthermore, it is never a Broker’s responsibility to pay for maintenance after a purchase; and certainly not a ½ year after.  This claim has no merit and is completely unreasonable.  People should not be allowed to publically defame and damage an organization in forums such as the Revdex.com.  My company had a flawless and exemplary reputation.

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  I reviewed the comments from [redacted] and unfortunately he is missing the point that information was not disclosed prior to the purchase and it should have been.  By not being open about the true condition of the boat he mislead the buyer.  If he was unaware of the issues with prop and hull then the seller was not honest with him and thus they share responsibility in this [redacted]er.  I would also appreciate it if he not bring anyone other than myself into this.  Furthermore, he knows nothing about our financial hardship so he shouldn't speak to it.  In his words he sells much bigger boats and this transaction was merely a favor.  Also, regarding the sea trial we were on it for merely minutes in water we were unfamiliar, we never got to test the boat for a fair amount of time, and in the moment it seemed acceptable based on what we were told by [redacted].  We definitely had a false sense of security.  Heavy use is also very subjective.  We use the boat but in the short time we have owned it have taken much better care of it and it was less than 50 hours at the time of the first incident so that was also not accurate.  We are still seeking compensation upwards of $7,000 bc had we known the amount of damage the boat had we would not have purchased or at very minimum we would have requested the seller pay for a second opinion when evaluating the drive and lower unit that incurred incremental damage due to the previous owners negligence.  Furthermore, we were also told the sea pump should have been replaced twice if not three times by the marine mechanic during the time the owner had this vessel.  Once again this is not consistent with what we were told by the broker which was that the boat was up to date and serviced appropriately.  Very misleading yet again and not true.On a final note after feeling very wrongly treated we do not feel confident that the person [redacted] suggested would have done the repairs appropriately.  We want everything done right w warranty and he could not offer that.  Also, the drive is well over 6 hours for us and [redacted] did not offer to pay for our inconveniences which include gas, time of work, food, time away from our slip, etc.  Once again that may be in his best interest but it only truly helps himself.  He has the opportunity to make this better and own up to these issues.  We would be more than happy to share anything positive he decides to do to help make this situation right. Regards,[redacted]

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.First, we were aware the props were nicked bc that was visible; however, we were under the impression that they had NEVER been replaced bc when we asked how the boat was cared for from a maintenance perspective we were told the seller was meticulous.  Why didn't he disclose this information?  Had they been honest and said they had been refurbished several times we would have not purchased the vessel clear and simple.  The marine mechanic that did the repairs had articulated that the damage to the lower unit was caused by the previous owner bumping into things and repairing the props but not the other parts that were being damaged.  Not by myself.  Also, the broker never addressed why the sea pump was never changed or replaced?  Which once again if it was serviced yearly and taken such good care of as were lead to believe this would have been addressed and not been an issue for us  according to the marine mechanic. Second, the mechanic that looked at the boat prior to our purchase was not our mechanic as he sates, it was someone he knew.  In hindsight that was not a good idea, and we will not make that mistake again but once again we were lead to believe that the boat was in great condition as we looked at it.Third, he misstated the 50 hours that is not accurate.  That number is inflated from when the first issues began plain and simple.  We bought a boat so we could use it and unfortunately we never expected that we would be sold a lemon.  So it makes sense that we booked vacations and tried to use the boat but every trip we took we experienced another issue and more financial distress. We believe the broker should take responsibility for their part in this ordeal.  The water "test" if you call it that lasted a mere 15 minutes and it was very hard to tell the true working condition of the vessel due to the lack of time and the environment we were in.  Unfamiliar waters, cold temperatures, without our mechanic, etc. We are overall very disappointed with the customer service that was provided and the way the situation was handled that's why we do not accept this.  No buyer should be placed in this situation physically or mentally and definitely not as they are going through their first pregnancy.  The refund we are seeking would help rectify the situation we were placed in bc we were not presented all the information to make an informed decision.  As I have stated before once the compensation is provided we would be happy to write comments that would be consistent with how we were/are treated.  Our intent is to look out for others so they aren't taken advantage of and to make this situation better.  Regards,[redacted]
