We understand you are dissatisfied with our response and state that the amount owed is $ 65.00. We received your rebuttal filed with the RevDex.com on March 26,
2018.
 
To summarize, you have
rejected Golden 1’s original response, as you state a representative advised the
existing Annual Percentage Rate would remain in effect for life. You are asking
for the reinstatement of the [redacted] credit card with a permanent APR of 10
percent.
 
The Credit Union reserves the
right to change the rate on your credit card as outlined in our credit card
agreement. There are specific requirements for making these changes such as
notifying you 45 days in advance and protecting your existing balance at the
current rate for the life of the balance. The new rate would affect any purchases made
after the effective date, if you choose to keep your card. In your case, it
will be April 21, 2018.
 
We no longer offer a product
with a fixed or non-variable rate and therefore are unable to meet your
request.

I am writing in response to the compliant that you filed
with the Revdex.com...

(Revdex.com) on March 16, 2016. 
I wanted to let you know that at Golden 1 we do our best
to protect our members from fraudulent activities.  Our staff cannot know when a check that
appears to be legitimate will be returned. 
It is usually the circumstances around the checks being provided to our
members that would indicate if they are potentially fraudulent.  We have to count on our members to question
these circumstances.
There are many scams that prey on individuals, such as
yourself, and we will do what we can to assist you through the process but we
are not able to credit you money for a fraudulent check.  We do want to provide you the following
suggestions and information to help you going forward.    
Suggested steps to take if you have been scammed:
Contact your local police department to file a reportFile a report with the Internet Crime Complaint Center at [redacted]File a complaint with the Federal Trade Commission at [redacted]..

We are in
receipt of your rebuttal to our response issued through the RevDex.com on June 21, 2017. To summarize, you believe the response provided by the
Credit Union contained incorrect information and ask that proof is provided for
the inquiries on your credit report. 
 
We have reviewed
your call with a Member Solutions representative on May 31, 2017. During your
call, an application was obtained for a Personal and Vehicle loan.  The employee obtained your permission to
access your credit report before beginning the applications.  You discussed a Personal loan in the amount of
$4,000 with a repayment term of 48 months. 
When entering the application, the employee made an error and entered the
amount of $48.00, instead of $4,000.00. We confirmed the application for the vehicle
loan was entered shortly after for the amount of $5,057.55. 
 
On June
1, 2017, Valley Hi Kia submitted two vehicle loan applications to Golden 1
through the Credit Union Direct Lending (CUDL) program. Both applications
containing your personal information, were submitted for the purchase of a 2013
Honda Odyssey. Our records indicate the loan amount on the applications were , $19,204
and $11, 527.  The original credit report
obtained through Experian on May 31, 2017 was used to process the applications.
 
We have
confirmed only 1 credit report was obtained and used for our decisions on all
four aforementioned requests to extend credit. 
Based on our decisions, separate Adverse Action notices were mailed to
you, which contain detailed information of each loan, as well as the reason for
denial. 
 
We have re-confirmed
that our one inquiry complied with the permissible purpose provisions of the
Fair Credit Reporting Act. Thank you for bringing your concerns to our
attention.

On Thursday, May 25, 2017, you had a
conversation with [redacted], manager of Item Processing. You acknowledged your
responsibility to pay back the funds erroneously deposited to your account and subsequently
withdrawn by you. During the call, a
request was made to arrange a payment plan.

left a message.  For further assistance

It was there policy to offer a life time rate of 10% on the [redacted] Card as long as I was a member....they have all the information on this and should be able supply you with it..if not I will take it to my lawyer

We received your
complaint from the Revdex.com on February 5, 2018.
 
In summary, you...

believe
Golden 1 Credit Union failed to recognize a counterfeit check deposited into
your account via mobile deposit. As a result, funds were made available to you.
You then sent money to a third party via [redacted] for $1,850 (the same amount as
the deposited check). Prior to sending the money via [redacted], you recognized that
the check was possibly the result of a scam, but you maintain that when
verbally threatened by the subject who provided you with the counterfeit check,
you sent the money back to him using [redacted]. You then filed a claim with Golden
1, advising Golden 1 that the transaction was not authorized. You assert the
Golden 1 mobile application did not function properly, as the funds should not
have been made available to you, considering the check was ultimately deemed counterfeit.
You would like Golden 1 to reimburse you $1,850 for the [redacted] transaction.
 
Golden 1 Credit Union
has concluded the appropriate action was taken when your claim for the [redacted]
transaction was denied. In this circumstance, you deposited a check into your
account from an unknown person for $1,850 that was later returned as
counterfeit. As a member, you are responsible for the items you deposit into
your account. As part of that process, Golden 1 makes funds available to you
because you have represented the item you have deposited into your account as authentic
and will be honored by the financial institution that it is drawn from.
 
Had you advised us of
the possibility that the check was counterfeit, at the time you first suspected
such, and prior to you sending money back to the fraudster, we could have
assisted you so that you would not have suffered a financial loss. The check
would have naturally returned as counterfeit and not cleared the account.
Filing a claim for the [redacted] transaction was not an appropriate recourse for
you as the transfer was initiated by you. Only after the transaction was
completed did you advise Golden 1 that you might have been the victim of a
scam.
