Mrs [redacted] ,In attempt to assure consistency and accuracy in this matter, this response and our initial response was based on email correspondence with you, electronic document ledger and referencing Texas Association of Realtors promulgated agreementIts unfortunate that you see this as M&S failing to further assist you in your relocation, but nothing could be further from the truthAs you can see in our documentation and yours that M&S on multiple occasions offered to find another property that might better fit your needs and even was able to extend the July deadline to August M&S is hired to manage a property to deliver the maximum value which includes but not limited to tenant retentionMrs [redacted] , please keep in mind that the owners of these properties have certain financial obligations to creditors and insurance policies that under certain circumstances may require them to have a long term agreement as opposed to a month to month with their tenantsAny notices that have been provided to you during your tenancy have been in compliance with Texas Fair Housing Act and and our TAR agreementFor your review we have attached the email correspondence, delivery of notices ledger and your lease agreementMrs [redacted] please feel free to contact me directly if you have any further questions or concerns

I am rejecting this response because:
I disagree with the response from the company for the following reasons:
Unfair Practices--:I received a renewal lease which stated if not renewed "it is expected that you go month to month at an increase rate of $ I paid the proposed rate with I intentions of continuing with a month to monthPoor Customer Service--: Responses to email & voice message from M&S Asset were return via phone expressing intentions of staying on the property until the end of Summer Last date of contact July 15, whereby by it was accepted move out date "End Of September." I was ask to submitting a letter with expected date of moving; however on July received a voice message stating I must move out at the end of AugustI return a call to verify and was told I only have until the end of AugustIntimidated and Coerced to sign sign a mos lease or be terminated-- after being on a month to month contract since for yearsRetaliation for not agreeing to utilizing M&S Asset Home Buying incentive program which entailed utilizing the companies realtors to broker the purchase of my new homeSoon after my decline to M&S Asset Home Buying incentive I receive a notice for a new lease or be terminated after the month of JulyUnscrupulous business tactics to force a month contract, our a month to month only to deny the option.

07/30/2015Dear Mrs***,I am sorry to hear that this transaction has been misunderstoodWe have had a good working relationship and would like to continue on the same noteIn attempts to clarify we have drawn up a timeline in hopes to clarify any misunderstandingMay 7 -We emailed the
tenant that we had received a verbal notice of their move out intentions-With no response from tenant an extension for months was delivered to tenant on May 2015-June 3-Still no response from tenant in reference to extending their lease or vacating the property.- At this time we were authorized to provide an option to either extend the lease for months or allow the tenant to go month to month for a period not to exceed months which ever was to the tenants convenience at the time. -A second opportunity for a lease extension was offered through July (complying with paragraph 4(A)(1) & (b)(2) on the Texas Promulgated Residential Lease Agreement, see attached). June -Tenant responds stating that they have no intentions to move(see attached email) June 2015-At which point we reactivated the month lease extension for tenant to sign(see attached time stamped documentation)June 2015-Tenant notifies us that she might be relocating, at which time we were authorized to offer a short term lease through March which would also decrease her monthly rent rate(see attached email)- No response from tenantJuly -Since there was no response we provided a day notice (As per paragraph 4(A)(1) & (b)(2) on the Texas Promulgated Residential Lease) that would require property to be vacated no later than August (See attached time dated documentation)-Continued no response from tenaduplicated this notice as friendly reminder July and mailed it certified(see attached time dated documentation)July 24-Tenant responds to request a September move outUnfortunately because of the time frame we were only authorized to extend the already executed August move out to August July 2015-Tenant responds confirming an August move out.We confirmed with the tenant and provided further documentation for move out processWe at M&S take great pride in the the rapport that we build with our tenants during and after our working transactionsWe hope this clarifies the matter and invite any open dialogueSincerely,*** ***Director of Asset Management

May 7 -We emailed the tenant that we had received a verbal notice of their  move out intentions-With no response from tenant an extension for 12 months was delivered to tenant on May 12 2015-June 3-Still no response from tenant in reference to extending their lease or vacating the property.- At this time we were authorized to provide an option to either extend the lease for 12 months or allow the tenant to go month to month for a period not to exceed  2 months which ever was to the tenants convenience at the time. -A second opportunity for a lease extension was offered through July 31 2015 (complying with paragraph 4(A)(1) & 4 (b)(2) on the Texas Promulgated Residential Lease Agreement, see attached). June 4 2015 -Tenant responds stating that they have no intentions to move(see attached email) June 5 2015-At which point we reactivated the 12 month lease extension for tenant to sign(see attached time stamped documentation)June 16 2015-Tenant notifies us that she might be relocating, at which time we were authorized to offer a short term lease through March 2016 which would also decrease her monthly rent rate. (see attached email)- No response from tenantJuly 6 -Since there was no response we provided a 30 day notice (As per paragraph 4(A)(1) & 4 (b)(2) on the Texas Promulgated Residential Lease) that would require property to be vacated no later than August 7 2015 (See attached time dated documentation)-Continued no response from tenant-We duplicated this notice as friendly reminder July 17 and mailed it certified. (see attached time dated documentation)July 24-Tenant responds to request a September 30 2015 move out. Unfortunately because of the time frame we were only authorized to extend the already executed August 7 2015 move out to August 31 2015. July 29 2015-Tenant responds confirming an August 31  2015 move out.We confirmed with the tenant and provided further documentation for move out process. We at M&S take great pride in the the rapport that we build with our tenants during and after our working transactions. We hope this clarifies the matter and invite any open dialogue.
