Broadway, Suite 2060 St. Louis, MO 63102Attention:  Dispute Resolution Department Fax: (314) 645-2666                                                                                                    RE:  [redacted]ID: [redacted] Dear Ladies and Gentlemen,  We are in receipt of the complaint from [redacted] dated May 2, 2018.  In response to the consumer complaint that you received from [redacted] regarding our business practices, you will find our response and supporting documents regarding the water leak in the apartment. This week, we have discovered that water intrusion occurred in two different locations in the apartment. One leak was corrected and the other is active, but pending scheduled repairs. To show the history of the work orders called in for this apartment, we have included the Service Requests and a summary below.  Request Summary: A request relating to a water spot was reported on August 28, 2017.  The above apartment was inspected for a leak.  An active leak was not evident in the second floor apartment.  The water spot was treated and painted the same day it was reported.  A second request relating to a water spot was reported on November 28, 2017. The above apartment was inspected for a leak.  An active leak was not evident in the second floor apartment.  The toilet was checked over and the tub was caulked the same day that the leak was reported. A request relating to a water leak was reported on November 30, 2018.  The toilet was checked and a wax ring and supply line were replaced the same day the leak was reported.  On December 5, 2017, a request relating to a water leak was submitted. An active leak was not evident in the second floor apartment.  The tub, shower walls and toilet were caulked the same day the service request was reported. On January 22, 2018, a ceiling leak/water stain was reported. Maintenance recaulked and ordered/installed shower guards for the tub in the apartment above the subject apartment on the same day the leak was reported. On February 6, 2018, a ceiling leak/water stain was reported. Maintenance ran water the entire week and did not find any leaks.  A cover was installed over the hole in the ceiling.  Once the repairs were made to the toilet with the wax ring, the leak stopped for some time. The apartment above Mr. [redacted] became vacant.  Maintenance replaced the tub stems, plumbing and caulked the upstairs unit prior to the new resident moving in. Once the new resident moved in and would shower or bathe, the apartment below (Mr. [redacted]’ unit) started leaking again. Since Maintenance could not find an active leak in the second floor apartment, a Licensed Plumber was called out to assess the problem.  The plumber had some scheduling issues that were out of our control, so we had to reschedule for the plumber to come out on May 2, 2018. The plumber came out and could not find a leak coming from any specific area.  He then poured water on the floor of the second floor unit, and water came from this area into the unit below (Mr. [redacted]’ unit).   On May 2, 2018, I personally went over to the apartment to look at the area where the water was leaking from the ceiling.  At the time of the inspection, I did not see mold or a leak in progress in Mr. [redacted]’s apartment; however, I did see evidence of water intrusion. I explained to Mr. [redacted] that we would need to figure out the source of the leak to resolve the issue.  The next day, I inspected the apartment again and the ceiling was still not leaking.  The unit above was inspected.  The floor appeared to be wet, but no active leak was detected in the second floor apartment. We have isolated the leak to a flooring issue that is aggravated when the resident in the unit above Mr. [redacted]’ unit uses the shower or tub.   Because the repairs needed in the unit could be extensive and may pose to be a threat to the residents while the unit is occupied, we offered for Mr. [redacted] to transfer to another apartment or to be released from his lease agreement.  Mr.  [redacted] says he wants to continue to stay in the apartment while we make the necessary repairs.
