We called the member on 1-6-15 and left her a voice message until we heard back from her on 1-15-15. We made a 3 way call to the legal department to review all recorded calls and notes on this case to make sure we did everything we could to help and encourage this driver to...

do everything she can to protect her CDL.  Since our legal department records all calls, we were able to review the calls made by the member, legal department and the attorney’s office.  We even talked with the legal department representative who previously contacted the member about this case and reviewed the recorded notes of calls made to remind the member to turn in a copy of her driving record.  Records show the Case was opened on 10-20-14.  Our legal dept. rep. gave the instructions to the member and asked the driver to send the necessary documents needed to have an attorney represent her. On 10-24-14, she faxed a Power Of Attorney.  On 11-3-14, she called in to follow up and was notified that an MVR was needed to get this case dismissed.  On 11-7-14, the legal department received her ticket & statement of fact by mail.  On 11-17-14, the attorney who was assigned to the case informed the legal department and the member that she may have to be present in court to get a dismissal.  So it was understood that the member would not be able to make an appearance, so the attorney would try to take care of it without her appearance.  The attorney also informed our legal department that an MVR was needed ….other attemptswere made by the legal department leaving detailed messages on the member’s voicemail on the 17, 18, 19, and 24th. The legal department also tried on 11-19-15, and on Nov 21st the member was told that theyneeded a copy of the MVR.On 12-1-14, the attorney notified the legal department and the member that he must withdraw from the case and that an FTA date would be set for the 5th of Dec. if she don’t take care of it.  The member wasinformed that no MVR was received and that she herself or another attorney will need to appear.  On 12-30-14, she called in, after not returning calls prior, to report the FTA to our legal department.  The legal department offered her a free consultation with another attorney at a 25% discount rate off the attorney’s hourly rate to help her with the FTA and do damage control.  It is always better to have a lawyer help take care of the FTA to prevent further problems with the CDL in the future then to just pay it.  She was informed about the 25% case option but declined the offer and said she would call back and never did. So in a nutshell, The (MVR) was needed by the attorney for a successful case.  The member did inform us that she did make an attempt to fax the MVR to the lawyer’s office.  But did not make contact with us, thelawyer’s office or the legal department to confirm the fax was received at that time.  Unfortunately, the member assumed that a confirmation of a successful transmission on her end was enough to confirm that the fax was received by the attorney’s office.  So the copy of the MVR was never received.  Unfortunately the attorney had to withdraw from the case and an FTA was issued.It is always our sincere intention to do everything we can to help our members from the challenges of keeping their membership dues current, turning in the required documents needed to win cases (within the timelines given) as well as protect them from the burdens of losing cases that lead to convictions on their driving record.  I only wished that this driver would have successfully reached out to us directly at that time.Sometimes, as her agents with over 10 years of experience, we can help with measures that can help eliminate guess work and risk.  Our legal department did allow the member to bring the membership duescurrent and waived the handling fee needed to open up a covered case. This driver has used our legal service successfully in the past and has won cases with us before without having to make an appearance in court. Unfortunately, this time the attorney notified our legal department and the member that he is withdrawing from the case as the member had not complied with turning in the requested document needed to represent the member successfully.  She now knows the difference an MVRcan make in a case.  We explained that we can’t do much if she doesn’t comply with what is asked for and takes the extra step to make sure we have received the required paperwork on time as well as returning phone calls to ensure a successful case.  We like to win cases as much as our drivers do.  We wouldn't be in business, for as long and successfully as we have been, if we didn't do what we say we are going to do.We understand drivers work long hours and know it can get difficult to stay on top of these things while driving over the road.  That is why we have a legal department that is open 24/7, and as her agents, we don’t mind our drivers calling us to help out.  We apologized to the driver and explained to her how she can use us better to prevent miscommunications in the future and let her know we are just a phone call away to help her confirm that faxes and any required documents are received on time instead of assuming or just relying on a successful transmission.We offered the member a free consultation with a lawyer to see what can be done to clear the paid ticket and prevent future problems with the CDL.  But the member chose not to at this time.  We did give the member instructions on how to cancel the membership and how to request a refund of $48.85.  The driver told us she will call us back and let us know what her decision is at a later time.  We did receive the formalcancellation request on 1-21-15 and have forward it to the cancellation department for the driver.  Meanwhile, we did deactivate the ongoing payment method so that her card cannot be charged again, unless she calls us back to reactivate it.
