Dear Sirs Regarding the complaint from Mr*** dated 4/18/18: Mr*** purchased a home to be built by Twilight Homes on 11/17/At that time Mr*** had a home to sell before he could qualify for a mortgage for the new home and because of that he was
written on a Contingency AddendumAs per our Contingency Addendum, all funds are refundable should the purchaser choose to cancel the agreement should his present home not sellHowever, should the purchaser choose to move forward with the construction of his home, he would need to Release the ContingencyOnce the Contingency is released Twilight Homes started the process of building his homeOnce the process commenced, his construction deposit of $1,was no longer refundable as it states in the agreement (see Attached). Chronology of our interaction with Mr***: 11/17/Purchase agreement signed and construction deposit given. 11/17/Contingency Addendum signed and approved by Twilight Homes 12/12/Mr*** received a Mortgage Approval letter stating he was approved with selling his present home 1/25/18 Mr*** signed the Release of contingency clause on the Contingency Addendum authorizing us to move forward with the construction of his home. 2/5/18 Twilight Homes ordered plans, permits and scheduled with the design center for Mr***3/19/18 We received notice that Mr*** didn't wish to proceed In Summary had Mr*** not released his contingency his $1,construction deposit would have been refundableHowever, the point that a contingency is released is the point that we start to incur costs on the buyers behalf and therefore the buyers funds become non-refundableAll of these points are made and agreed to in our purchase agreement. Though we won't return his earnest money we will credit it to him if he chooses to purchase a home from us within the next two years.
