I am rejecting this response because:
I made a contract with Twin City Fence (***) to place a chain linked fence around my back yard property and to also place a plastic white gate on the side in question and a white fence partition on the opposite side.1st mtg; When we first met with *** we discussed types, etc. in addition, I told *** I did not know for sure what my property lines were. In front of another person *** stated that was not a problem he would take care of that. Since a *** was the "Fence guy"We took him at his word, understanding he must have ways to get property lines easily.2nd mtg.; *** returned, I signed the contract and gave *** half. Later, After we had the problem, *** pointed out that according to the contract he places the fence where the property owner says to. I did not read the full contract, BUT, *** never did ask us where to place the fence at anytime during the process.Once the fence was installed, a few days later our neighbor caught me outside. She let me know the white gate was about one foot encroachment onto her property in the front yard and the back yard, my new fence was not including approximately feet, making it look like this was her yard.3rd mtg.; After calling *** with this information, he was obviously upset. He came by to look at the area. I showed *** a subdivision map our neighbor gave us to show him. He said you can't trust those maps. I then showed *** another piece the neighbor showed me, a survey peg IThe back of the yard. *** again acted as though he was not impressed and/or wasn't sure that peg could be trusted. I asked a *** where he got the information for my property lines. *** said on the side NOT IN QUESTION he used the (x) in the street. As we were walking around, showed me the (x) He then stated he could not even find an (x) on the side in question.After a lot of discussion, it was clear *** guessed as to where to place the fence. *** never asked me to gather any additional information for the property lines nor anyone else. After much discussion about placing the white gate on my neighbors yard and obviously not including my entire yard within the fence, *** agreed to move the fence at his expense. He requested that we ask the neighbor if the white gate could stay where it was as pulling the white plastic gate would be much more expensive than just moving the chain link fence over. The neighbor agreed. We were going to leave about a foot of property on her side in the back, giving her the large tree that sits directly in the middle of the property line.*** hired "*** ***"To mark the grounds for any important lines buried along my correct property line. There are several lines marked. By walking with ***, leaving two feet around each new hole dug, I believe there is a way to move this fence to the area it should have been placed in the first place.As I walked these lines with *** and I was pointing to the areas where I believed holes could be dug. *** became more agitated concerned we were trying to make him look like the bad guy. *** also stated "they" (*** ***) send young boys out here to paint those lines, I can't always trust where they put the lines. I told *** That was/is not our intent at all. We just want our property within our fenceWe have been told if someone else maintains your property, they can make claim of that property.*** told me I could have someone else dig the holes and he would move the fence. I asked if he would pay for that expense. He said no way, I've already paid to dig the holes. I reminded *** that I also have paid to have those holes dug, but he dug them in the wrong place. *** then said "why don't you have "that boy" dig the holes?" (The boy he is referring to is my year old grandson)*** kept saying he could not move the fence. If he would cut some of those lines he would be fined $150,and go to prison. I told *** that I certainly did not want that. I suggested *** have *** *** come out with him to the property and possibly help him locate the holes needed to move the fence. I was told *** *** has GPS, computer systems, etc., in order to locate the exact location of the lineI also suggested the holes may have to be dug more delicately and maybe not using the pole digger when lines are close.*** said he can't do it. He said not every yard can have a fence.I told him if I had known that, I would have been more creative and would not have had the fence installed.*** said he could pull it out.I told *** if the fence cannot include my property, I would prefer he pull it out and he could give me my money back in full. *** says he can't do that.At the end of this meeting, *** left, yelling, and said he wasn't doing it.*** GUESSED as to where my property line was located. He did not ask me for any additional information about the property lines. He did not get a survey or ask me to get a survey. The contract may say Twin City Fence obtains property lines from the property owner, BUT, *** also broke the contract by stating he would take care of getting this information and NEVER asking me to find the property lines before installation.1. I would be very happy with *** if he would work closer with *** *** and place the fence on my property line in the area we discussed.2. If *** cannot do this, I would prefer he pull the entire fence, repair my yard, filling in the holes, etc., and return all of my money in full

The Customer is responsible for the property linesThis is clearly stated in the contract that she signed. What was stated is irrelevant as to what was signed. I am still willing to move the fence as long as she signs the waiver to accept full responsibility if any utility lines or fiber optics cables are cut. I cannot move this fence without taking the chance of losing my business by digging the holes. The wire for the fence needs to be in a straight line. I placed the fence in the only place where it could be installed properly. I will not be refunding any money

This is clearly stated in the contract that she signed.  What was stated is irrelevant as to what was signed.  I am still willing to move the fence as long as she signs the waiver to accept full responsibility if any utility lines or fiber optics cables are cut.  I cannot move this fence without taking the chance of losing my business by digging the holes.  The wire for the fence needs to be in a straight line.  I placed the fence in the only place where it could be installed properly.  I will not be refunding any money.
