In response to the consumer's complaint, our company is providing further clarification.
Initially, this consumer contacted the company with a claim that no one came to plow his driveway on the first major snow fallOur team explained to him that plow service had been performedHe still didn't believe that service was providedThis first snow fall was heavy accumulation and more snow had fallen since the first plowOur team sent him photo documentation of plow serviceThe service date was December , at 7:07pmWhen he did receive the photos, he went on to apologize stating that the photos speak for themselves.
He went on to call within the same hour window stating that it was still snowing and inquired as to when the plow truck would be back for another roundIt was explained to him that service would come back for a second round within that same hour window; however, an exact time of service could not be guaranteedWe also explained to him that weather conditions cause major traffic backups on roadwaysHe was assured that he was on the schedule for a second plow for the continued snow and that plow would be performed before the hour time frame from his first service.
He continued to repeatedly contact the company within that same hour time frame and he stated that he was dissatisfied and wanted to cancel servicesWith it still within the hour time frame of the very first snow event -- and the consumer requesting a refund so quicklyour team honored the request to cancel serviceService was terminated immediately upon the consumer's request.
The consumer himself asked to be billed for the single plow service and be refunded the balanceHis request has been honoredEven after cancellation, the consumer continued to contact the company berating them for no one coming to plowThe company reminded the consumer that services had been terminated upon his request.
Finally, the consumer never return mailed a signed contract/agreement form to the company for snow plow services even though an agreement former was provided to himHe simply signed the estimate form and returned that with paymentWe billed for work performed (one plow service at per push rate) and we refunded the balanceOur company sees this as a fair resolution to the consumer's complaint but to close this out, we will refund the $balance, thanks!

Hi, in regards to this complaint, we have plowed more then once and will provide dates and times of snow removal to consumer via emailWe never received a email, calls or text, not sure if they are texting or calling the wrong number but we haven't received any communication from a text call or
email prior to this complaintA refund will be issued within days from today's date, thank you

Twin Prak has not sent us a refund for services not rendered for landscaping. Request made since June. Several requests have been made. Promised to send within 15 to 30 days. That was Augusy 15th.

Hi, we have contacted the customer and worked out a payment arrangement.

We paid for services with a contract on June 14, 2018 for Twin Peak Landscaping to provide mulch and labor to apply the product in the amont of $242.00. We received an email on August 20, 2018 indicating that they could not keep enough people employed to perform the work as contracted, and will provide a refund for the services not performed. It is now September 13, 2018 and after numerous emails to Twin Peaks Landscaping without answers and telephone calls to the company without being answered by anything other than their answering service, we still do not have our money as stated in their email. They also stopped mowing our lawn on a weekly basis without notice, and we have had to hire a new contractor to prefrom the work that Twin Peaks Landscaping had contracted with us to perform through the lawn growing season in 2018. We did not pay for the last lawn cutting of $30 (July 15, 2018) so we will accept a payment of $212.00 as our refund. All payments we made as contracted and none were late. We do not understand why they can not call and talk to us and tell us when our money will be sent or delivered. We are contacting the Revdex.com prior to contacting our lawyer if it needs to go that far. However, we believe that we should be refunded in full since we needed to pay other organizations to cut our lawn after this company did not perform the work as contracted and the lawn went over 3 weeks without being cut!

I have reviewed the response made by the business in reference to complaint ID XXXX, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Twin Peak Landscaping placed a check for what was owed to us in our mailbox on 10/27/2018. There was a Western Union check in there for $212, which is $30 less than the contracted amount since they had also did one mowing of the lawn in August that I did not pay for since they were not returning my funds or performing the work as contracted from June 2018. You can close complaint 18-077035 based on the payment. However, I also filed the complaint with The Ohio Attorney Generals Office per your suggestion and they also told me to file a complaint with the local police department. It was the day after I filed the police report at the Lake County Sherriff's Office with XXXXX that I received the funds. It's a shame that I had to get more people involved when all they needed to do was to inform me that they were having some financial difficulties and that a payment would come my way by a certain date. I do understand when things don't go as planned, but after they broke off all communication after they said that they would proceed to give us a refund. I had no recourse but to involve more agencies. Now that they have paid me, I have received numerous emails (4) asking when I would complete the reports to The Ohio Attorney General and the Lake County Sheriff Office to help clear their name. It did not seem like they were afraid when I reported them to the Revdex.com, but their attention did get stronger after informing the local police department. I am a handicapped retired individual and feel that I was taken advantage of in the "refund" process. The company made many promises that they did not keep over the three months I used their services. Including the fact that I needed to sign the various contracts for the services being rendered and that I was never given a copy of the contract when they were promised to be mailed more than once. The current company that I have for maintaining my property also had contracts for me to sign but they gave me a copy of the contract signed by them as well at the same time I signed the contract.
