The Revdex.com forwarded your concern regarding postdated checks and theassociated NSF fees which have been charged to your account.
I understand the frustration of writing a check for a date in the future and it getting depositedprior to the date written. The...

creditor negotiates the check at their financial institution and thechecks are cleared via an automated system. A check is a negotiable instrument. The payee, theperson to whom the check is written, may negotiate it through the banking system at any time.Once you sign a check, it can legally be cashed, regardless of the date you wrote on it, by thepayee. It is not within our control to see each check until after it has been negotiated.
There are some protections to help when postdating checks to creditors outlined within UCC 4-40 l .C and carried through on State of W A, RCW 62A.4-401. The passage is included below:
(c) A bank may charge against the account of a customer a check that is otherwise properlypayable from the account, even though payment was made before the date of the check, unlessthe customer has given notice to the bank of the postdating describing the check with reasonablecertainty. The notice is effective for the period stated in RCW 62A.4-403(b) for stop-paymentorders, and must be received at such time and in such manner as to afford the bank a reasonableopportunity to act on it before the bank takes any action with respect to the check described inRCW 62A.4-303.
If we are notified in advance that a check is postdated and we are given sufficient informationabout the check (check number, payee, and amount), we can reject the check for you. We wouldneed to have reasonable notice (notified two days prior of the mailing of your check). We willnot hold the check for you, we will only reject it.
On August 22nd you reached out to our contact center about this issue. During the call therepresentative you spoke with reviewed your account and noticed it appears the majority ofchecks postdated and submitted early are written to [redacted] and [redacted] Therepresentative explained our Bill Payer option may be a viable solution to ensure checks are notreceived prior to when you want a creditor to cash them. If you need assistance in getting thisoption set up, Miae M[redacted] Branch Manager at your local Lakewood branch can be reachedby phone at (360) 486-3782 or by email at [redacted]@twinstarcu.com.
Also during this call, two overdraft fees were reversed as a courtesy. This is the extent of thefees we will be reversing on your account due to postdated items.
Overall, the practice of writing postdated checks is not a suggested practice due to the risksinvolved. Here is a link that may be helpful explaining why people should be careful writingpostdated checks.

complaint on May l, 2017.Upon reviewing your complaint, we understand you were a
victim of a counterfeit check scam. While we make every effort to...

detect and
stop counterfeit items, you are in the best position to avoid this type of
fraud because you have directly interfaced with the fraudster and are more apt
to determine whether the transaction is legitimate and the instrument is
genuine based on your personal interactions and judgement. Currently, your
account is negative as a result of depositing this counterfeit check, receiving
the funds from us, and then distributing those funds to the perpetrator(s) of
this scam.Our deposit agreement states, in accordance with UCC 4-214,
you agree you are fully responsible for all items negotiated by or on behalf,
including, but not limited to items presented for cash or deposit at the credit
union or a foreign financial institution, regardless of whether or not the item
is personally endorsed.In order to bring your account current, our Fraud Department
will be contacting you to provide you with loan options which will afford you
opportunity to make payments over time, rather than a lump sum amount to bring
your account current. The interest charged on these work out loans is
significantly less than a standard signature loan that may have been presented
to you previously.We hope this will alleviate some of the financial burden this

The Revdex.com has recently forwarded your complaint to TwinStar Credit Union.
You contacted us on June 13th and reported we had wrongly charged your account two overdraft fees. We have reviewed your account and found there was not an error by TwinStar...

Credit Union. The following explains the transactions that occurred which resulted in the overdraft charges.
The available balance on the end of business day June 10th was $49.95. This was due to an approved pending debit card transaction that day in the amount of $249.00.
 
On June 11th  an ATM withdrawal of $40.00 reduced the available balance in the checking account to $9.95. 
 
Following the ATM withdrawal, a debit card purchase for $10.60 overdrew the account and a corresponding $30.00 overdraft fee was assessed. A [redacted] charge was next to post for $1.63. This further overdrew the account and was assessed the corresponding overdraft fee.  Please be advised a charge does not have to clear for more than $5.00 to be assessed an overdraft fee at TwinStar Credit Union.
 
The credit union provided one courtesy fee reversal as an exception on 6/13/16; your account had already been granted the maximum amount of courtesy reversals from prior overdraft charges that were refunded.
 
The Manager also offered to remove overdraft protection to prevent your card from approving a transaction if the funds were not available. At the time offered, you elected to decline.

This letter is written in response to the Revdex.com complaint submitted on January 25, 2016 by [redacted].  The...

complaint alleges that TwinStar demanded payments from the member outside of the contract terms, and the credit union denied the member access to statements explaining the discrepancy.  I would like to address each of the concerns.
Ms. [redacted]’s auto loan contract is the source for all terms of the loan.  Included in the agreement is a requirement that auto insurance is maintained throughout the life of the loan.  Unfortunately, this portion of the contract was not upheld by the member.  Therefore, Collateral Protection Insurance premiums were added to the balance of the loan; these additions totaled $871.  The variance described by the member approximately matches this amount.
It is the credit union’s responsibility to provide detail regarding all transactions and account balances to the membership.  This information is available via periodic statements, on-line banking, and on-demand requests.  While I cannot speak to the specific challenges Ms. [redacted] experienced in obtaining this information, I understand that she was able to acquire the requested information at our Lakewood branch on January 26, 2016 and chose to pay the remaining loan balance in full at that time.  Additionally, I will mail copies of the account history to the member today to ensure receipt. 
I hope this information helps provide clarity to any outstanding concerns.  Please let me know if additional detail is needed.

I am rejecting this response because: this continues to be a regular occurrence. I would like to see a detailed report of the payments made against my Chevy Suburban loan that includes what payments were made and when but also which months the payments were applied to, as that information is not available online.

Thank you for sharing your recent interaction regarding your accounts with TwinStar Credit Union.  We appreciate the opportunity to review situations such as these to ensure our members are receiving the high levels of service they should expect.
In reviewing your letter that...

was submitted to the Revdex.com on December 22nd of 2015, I have been able to determine that your account was overdrawn on December 20th of 2015 and you did incur overdraft charges in the sum of $120.00.
TwinStar Credit Union has not changed our practices in how we process debits from our member’s accounts.  When an account is taken negative, all additional debits will incur an overdraft fee.  This overdraft program is provided to our members as a courtesy to ensure their payments are processed; which requires the credit union to fund those purchases until the account can be properly reconciled.
After researching your account, TwinStar Credit Union provided courtesy fee reversals on the following dates:
7/13/15                                    �... 4 Fee Reversals                                   �... $120.00
8/6/15                                     ... 2 Fee Reversals                                   �... $60.00
12/4/15                                    �... 1 Fee Reversals                                   �... $30.00
We typically provide our members two fee reversals a year for non-credit union related errors, which you have exceeded.
I have instructed an employee of our member services team to reimburse the fees incurred on your account in the total of $120.00.  This will exempt you from receiving fee reversals for non-credit union related errors throughout the calendar year ahead.
If having access to our overdraft protection is not a good financial solution for you, it can be cancelled anytime by contacting us at 1.800.258.3115, or visiting your local TwinStar Credit Union branch.
