operate a motorcycle course that is a licensing program We work in conjunction with the New York State Department of Motor VehiclesSince the course we provide results in our students obtaining their motorcycle licenses if they successfully complete it we are under very strict regulations set by DMV one of the many regulations is that students much attend the “entire” class and not miss any class time. When a student registers for a class via our website, such as *** did they are informed that if they are late they will not be allowed entry into the class and they will forfeit the entire registration feeEach student has to click I agree before they can continue with the registration process *** was no different she agreed to the termsOn the day before the class (September ***) I personally spoke to *** as I did the rest of the class via a telephone call explaining where they should report on the first day and emphasizing the fact that she must be on time *** said she understoodOn September *** after not showing for a class in the morning our teacher called *** and she said she had overslept and would be there in minutes this was already passed or scheduled start time of a.mActing in good faith the teacher told *** she would give her until 8:to arrive and when she did not, she started the class without *** being presentIt’s important to note that *** never did show up that morning at all and the class went out without herIn the complaint, it is alleged that someone told *** to call the office and rescheduleAt no time did anyone tell *** that she could reschedule as that was not an option. The following week *** called our office asking to reschedule classNot knowing who it was I asked what the situation was she told me her name I asked her why she was late that morning, her reply to me was she thought class started at 8:30, a different story then she told the teacherI asked her if she remembered talking to me on the phone prior to the class and me telling her what time the class started and emphasizing the importance of being on time*** admitted she did remember talking to me but she thought start time was 8:I told her although we are under no obligation to do so we would reschedule her in one of our upcoming classes that was not filled and that she would just have to be patient, she agreed to thatA week or two later her father called to see if anything can be done I repeated to her father exactly what I had told *** that I would let her come back to the class but also explained to him that since the number of students we can have a class with limited I f I were to put her in a class that would fill or was full our company would be losing moneyHer father agreed and said that was fairI told him I would call *** when an opening became availableHe asked me to call him instead saying and I quote, “I'll drive her there myself”On Friday October *** I called ***’s father as instructed and when he did not answer the phone I left a message on his voicemail saying that we have an opening for the weekend of October *** and *** that *** could come and participate in the class and to please be sure that she was on time this timeThey did not show on the ***, she did not take her up on our offerThe next thing I know I get a letter for the Revdex.com that someone has rendered a complaint saying she said she called several timesThe fact is, *** called twice and her father called once, both times they were spoken to and agreed with the offer that was madeContractually we do not have to do an ything more after the day she did not show for class but we found a place for her to come back and she chose not to.After receiving the letter of complaint from Revdex.com I once again called ***’s fatherWhen there was no answer I again left a voicemail asking him to return my call in an effort to resolve this matter, to this date he has not returned my call. I think that SmartRider made every opportunity to deal in good faith with this customer and has gone beyond what they have to do contractuallyOur offer still stands that she can come back and take a class but we cannot refund her not because she was late and did not show
