The tree is not healthy, being the property owner it is their responsibility to maintain THEIR property, not mine. If it is such a simple solution then they should proceed with filing an insurance claim. I have small children that play in my backyard. Im sure that they own multiple properties and have a handy man of sorts that you could send out to fix the problem. Why would they possibly allow something that would cost you close to nothing have the possibility of becoming something that could cost them hundreds of thousands if one of my grandchildren, nieces or nephews are hurt from a falling branch from this tree?? I really do not see why they wont fix this problem that is clearly theirs. I would hope that they would just do the right thing. I would like to resolve this issue amicable. If not, I will be forced to take the next step and am very confident that the judgement would be in my favor. I will not allow my small relative to be placed in danger by anyone who is so short sighted. If they are interested in cost sharing, I would be open to this resolution.
