I am rejecting this response because:He states that I signed an agreement to no returns and this is not true.Naturepedic's website says that they donate mattresses to charity.Tarik's own website indicates a restocking fee on returns not no returns "Returns: In the unlikely event of an approved return, customer will pay a 25% return and restocking feeOn special order or custom items, there is a 50% restocking fee, at merchant’s discretionIn the event of a defective, damaged or faulty product, merchant assumes no liability beyond product valueIn the event of a defective, damaged or faulty product, merchant at its discretion may repair or replace said item, customer is responsible for transporting item to and from repair facilityAll clearance items are not returnableAll custom items are not returnableAll made to order items are not returnableArt items are not returnable regardless of conditionSoft goods are not returnable regardless of conditionCustomer is fully responsible for all shipping costs associated with layer swaps, returns or other transactions after the initial purchase, even if customer is offered free initial shipping or delivery by TYFFPillows, sheets, mattress protectors and all other bedding items are not returnable, exchangeable or refundable in any wayLiability: T.YFine Furniture accepts no liability for property damage, or personal injury during delivery Acknowledging receipt of delivery by a third-party carrier constitutes acceptance of these termsCustomer agrees that the order is accurate, and that they agree to the operation guidelines detailed aboveCustomer also agrees that order detail notes as listed above clearly express what they have ordered." I am rejecting this response because I want the refund of money and the return of the mattress.When I was in the store MrY*** never said I don't take returnsHe never pointed to signage that said "no returns all sales final " and he never said checkout my webpage that says "no returns"But he did take the time to say that warranty issues had to be done through the manufacturerThat would have been his first opportunity to say we don't take mattresses backInstead he said there were optionsOne of which was the layer swap We did not purchase a mattress that day.When we came back to the store in August it was nearly the exact same conversation No mention of no returns, only options When I contacted him the 3rd time by phone and told him I was uncomfortable and that my wife has pain he suggested the layer swap, which I agreed toI paid to have the layers shipped to and from the manufacturerAgain he had the opportunity but neglected to say anything about a no returns, no refund policy.He said hopefully naturepedic can do something yet he knew full well they do not take any returns on mattresses not purchased through their website.I truly believe the mattress delivered is not the same quality that is displayed in his store and for whatever reason he is refusing to do the right thing. He has said to me since that 90% of people are comfortable with the mattress we purchasedWell I am not one of those people I want to return the mattress for less the 25% restocking fee we discussed

we are still glad to offer the return with a 50% restocking fee as mentioned before, but we cant do any refunds as long as a charge back is in full action

Unfortunately, we are unable to take in used mattresses. We have a clear return policy. All sales are final. Terms are posted in showroom and customer signed in agreement with our terms. It is illegal in Ohio to resell used mattresses.
