I would like to start off by apologizing that this has gotten to this point It is never our intention to have something get this uglyWhen the customer threatened us with legal action it took away any want that I had left to try and reconcile this transaction I am torn about how to handle this I feel the accusations the customer has mae against me are very overblown and with out basis He has stated that the truck had flood damage I have a copy of a Carfax vehicle history report that states no such thingFrom the description and the photos the customer sent to us it shows that the truck at some point was driving in mud and red dirt, but to claim that it has been flooded is a very strong accusation when there is nothing to back this claimThe customer did mention some damage to the roof of the truck I had tole him that it may have happened in transport and that I would look into it I pulled up the pictures we have of the truck and it does not show any damage to the roof I have contacted the transport company and sent them pictures of the damage Hopefully I will be able to get some sort of payment from them for the damage as it appears to be pretty obvious it was damaged in transport The customer also asked for pictures of the undercarriage of the truck prior to him purchasing it We sent him seven pictures of the under side of the truck None of these pictures shows anything to validate the amount of mud the customer claims the truck had I don't doubt the truck had dirt and mud in some difficult to access places such as on top of the fuel tank of inside the frame rails, but I feel his accusation of 300-pounds of mud is overblownThe customer has also stated that we did not service the truck before it was out our for sale This is also completely baseless and false I have the invoice dated 10/6/showing and oil change with filter and synthetic blend oil, new wiper clades, balance and rotation of all tires, engine air filter, cabin air filter, tire pressure sensor kit and a license plate bulb The customer also stated the truck smelled foul The truck had no odor when it left our lot I pulled the condition report on the vehicle from the auction to verify this as they notate any interior odors on the condition report The condition report notes the interior odor was ok and there was no foul odorsAs far as the customers complaint that the title was not in our name is also a moot point The title had all the necessary reassignments to us and to the customer The state of Utah does not require dealerships to title the vehicles in their namesSo to say that we were somehow in the wrong on in regards to this issue is completely baseless I understand the customer was upset that there was mud underneath the truckAnd his complaint is valid, however I feel overstatedHis complaint about the damage to the roof is valid and I am happy to make this right regardless of wether or not I amble to get anything from the transport company who is the liable party for this issue as the truck did not have any damage to the roof when it left our dealership As far as the customers other claims, I feel the are without any proof or completely hypothetical situations about what could happen down the roadThe customer also stated that the truck was driven through the red Utah mud This is completely false We are in Northern Utah where this is no red dirt and hundreds of miles from SoUtah where that could have happened The customer has also left us negative reviews on Google and yelp under a Different name than his own He is asking for us to help him when while at the same time putting out information that is not true and is bases on his option and emotion The customer bout a used truck with 101K miles on it I was not a new vehicle and was never represented to be newThe condition report from the auction gave this truck a score of on a scale of 1-5, which indicates the truck to be in good condition This was also before in a reconditioning work that was done to it on our partI apologize the customer had a negative experience with the transport company we used They had a perfect 100% feedback score with positive ratings We had every belief that they be great I feel we have done our due diligence in regards to the customers complaints Also we already refunded him $ I am willing to help try to put this issue to bed, but I feel the customer needs to be responsible for the accusations he has leveled against us as well as the damaging reviews he has posted about us with information that is not true I am willing to take the truck back and refund the customer his money for the full purchase price Or I will refund him $in addition to the $we have already refunded him with the condition that he removes his negative reviews about usI will also upload all relevant documentation to back up my claims

Complaint: [redacted] I am rejecting this response because: I would like to refute some of the claims made by the dealerFirst, the license plate light was never changedThe housing for it was completely filled with red mud and the wire and socket were just hanging thereI made no mention of the "lube shop" oil change that was doneThere was still mud in the bottom of the air box underneath the cheapo new air filterThere was red dust completely surrounding the cabin air filter which was not re-installed correctlyI was missing a fender liner, the skid plate was barely hanging on with lots of missing hardwareThe tow harness plugs were completely filled with mud and had to be replacedWhen I replaced the tires which were badly cut up from rocks, had uneven wear and were cupped very badly, there was also no sign of new TPMS sensors which I had to replace alsoI have pictures of fuse panels totally encrusted with mud and dustThere were even chunks of dust in the inner parts of the rear-view mirrorWhere the tools for the spare live in this truck, there was very clearly a water, or mud, line apparent and evidence of a quick wipe-out with a ragWhen I pulled the spark plugs, there was mud and dust that made its way past the rubber seals and down the plug tubesThat just doesn't happen with a simple dusty roadWhile cleaning the undercarriage I completely destroyed the stall of a self service quarter car wash timesI spent over $per time and still to this day have red mud puking out from every pore of this truckNot even counting the poundage of mud that came out at the car wash, I had the truck up on ramps in my own driveway for 3-solid days of scrape, spray and cleanI completely coated my own square feet driveway in mud three timesI was forced to let the mud dry and scrape it off the driveway using an ice scraper and the shovel it up into a wheel barrowI filled a full size old school wheel barrow up almost full twiceEach time, barely being able to haul the wheel barrow and I'm not a small guySo my approximation of 3-pounds of mud is dead on, maybe even a bit conservativeI have upwards of high res pictures that show every thing I'm discussing hereWhile I do believe this dealer has/had a solid reputation, the due diligence that was required for a solid sale just didn't occur hereHis offer of refunding $is clearly evidence of known wrong-doing and misconduct while doing businessWhen I was told nothing else would be possible from the owner to be done, I had no choice but to take my experience to the online public and share my story to warn othersI absolutely understand that these reviews are vital to a business and can cause a lot of grief, hence the decision to go that routeI have spent 40-hours on the truck I purchased and upwards of another $to bring it up to what I see as fit to daily driveI had to put all of my affairs on hold as well as my business to ensure I could have a truck capable of daily useIf the dealer is willing to come up with a realistic figure of refund, I will absolutely retract my negative reviews of his establishment as well as not follow up with the Utah division of consumer affairs along with a report to the Utah motor vehicle enforcement divisionThe paper work is filled out and ready to go to those two departments, but I will wait on response from the dealer in questionAnd for the record, it was never my intention for it to become this ugly also, but I feel this was a "wrong" of astronomical proportions that must be "righted" Sincerely, [redacted]

There was no deceit in the description of the vehicle Vehicle has a clean and clear title as well as a clear Carfax and history report The customers claim that the vehicle has been flooded is completely baseless We did everything we could to work with the customer Before
purchasing the vehicle the customer asked for some additional pictures of the undercarriage which we provided for them We provided all information that the customer asked for The customer was upset with us over a delay of three days in the transport which was unfortunately out of our control As an act of goodwill we refunded the customer $to try to help rectify the delay in transport On 11-21-the customer sent us pictures of the truck These pictures included areas behind the taillights, under fender liners and in difficult to access places There was red dirt present, as this truck came out of Texas I then called the customer to discuss his concerns He also mentioned and included a picture of a small dent on the top cab of the truck To the best of our knowledge this was not present at the time the vehicle left our lotI asked him if he had the bill of laden so that we could see if the transporter had notated any damage there, as it appeared to us from the pictures that it could have been transport related If that was the case we would have been happy to contact the shipper and helped to resolve the situationThe customer asked me what I was willing to doI told him we had already refunded $to his credit card and what else he expected He responded he wanted to know what else we were willing to do before he called the Utah Attorney GeneralI was surprised by his response and asked him if that was a threat to which he responded it was not a threat, but a promiseAt this point I decided that we would no longer engage in any conversation with the customerI feel that we were clear in our description of the truckIn over years in business I have not had a customer threaten us With the $goodwill refund that we gave him, which we had no obligation to do, but did so to try to help make the transaction better for the customer, and with a singed buyer guide marked we feel we have done our due diligence to help the customer I am saddened that this transaction did not happen the way we like to see, but I believe the customer got the truck he wanted and as stated in his complaint does not want to returnWhen someone resorts to threats it takes away our want to help, especially when we already had made efforts to satisfy him

I am rejecting this response because: I would like to refute some of the claims made by the dealer. First, the license plate light was never changed. The housing for it was completely filled with red mud and the wire and socket were just hanging there. I made no mention of the "lube shop" oil change that was done. There was still mud in the bottom of the air box underneath the cheapo new air filter. There was red dust completely surrounding the cabin air filter which was not re-installed correctly. I was missing a fender liner, the skid plate was barely hanging on with lots of missing hardware. The tow harness plugs were completely filled with mud and had to be replaced. So my approximation of 3-400 pounds of mud is dead on, maybe even a bit conservative. I have upwards of 50 high res pictures that show every thing I'm discussing here. While I do believe this dealer has/had a solid reputation, the due diligence that was required for a solid sale just didn't occur here. His offer of refunding $1000 is clearly evidence of known wrong-doing and misconduct while doing business. When I was told nothing else would be possible from the owner to be done, I had no choice but to take my experience to the online public and share my story to warn others. I absolutely understand that these reviews are vital to a business and can cause a lot of grief, hence the decision to go that route. I will also upload all relevant documentation to back up my claims.
