Response:

I have received the complaint filed by Ms. [redacted] and would like to submit the following response.1. Unlevel deck - Part of the work to be done was to add a small addition to her already existing deck. As I explained to her before starting the job, her existing deck was 2" out of level from front to back. I had to match the grade of the existing deck to not create a 2" tripping hazard down the middle of the deck. I am sending you a video through Dropbox showing that the deck addition matches the existing deck so as to not create a tripping hazard. This was all explained at the start of the job.2. Damaged door - I have no idea what she is talking about as we have never discussed a damaged door.3. Warped deck boards - Deck boards out in the weather sometimes warp. As you can see in my text below, I offered to change or repair anything that is not right. 4. Door installed improperly - The door I installed was installed plum, straight and level. We never discussed the door being installed improperly. 5. Grey trim boards installed on handrail - As I was tasked to paint the deck, I had primed the 2 x 6 handrails.6. Concrete step - there was a concrete step that needed to be removed to add the small addition. After the step was broken up, I asked if I could leave the small amount under the deck. If not, I would remove the concrete. I was told it was fine to leave it, and feel she would not have allowed me to continue if it wasn't.7. Crack next to vent - After installing the foundation vent, a small hairline crack showed up in the mortar joint. I told her I would fix this and paint the deck. However at this time she told me to leave immediately and that I was not welcomed and was trespassing she was going to call the police. She stopped me from completing the job.8. No permit - On April 28, 2016, I contacted the inspections department and told them I was doing a small project. I described the work to be done, and since there was not electric, plumbing or HVAC involved a permit was not needed. If you review the text below and the video in an email sent to you through Dropbox, you will see that her statements are not truthful. We had only ever discussed the deck and the mortar joint.Sincerely,Joseph Tyler

Response:

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

He has been asked to leave my property. The other area of the deck goes down and then back up the ramp and down which he doesn’t show you. The rail is warped and not level the new door he put in has a hole under it and he used spray foam instead of kick plate and didn’t haul away block step, charged for paint even though he was told on several occasions that I was purchasing my own. Used decking boards that are labeled not for ground contact (ramp touches ground) did not use [redacted] plywood in new building floor, no building permit, installed used wood already painted grey on top of railing, cut vinyl on house to make his boards fit, (now water can get in), cement cracked round new vents that he installed, not sure he has contractor license, sprayed foam around old door now it is swelled and hard to close, door trim not cut to 45 degree angles at top of new door, he cut it straight across leaving gaps again for water to get in, warped boards under pickets. His video should not be allow because he trespassed to obtain it.I have had three licensed contractors come out and that agree with all of my above statements. Thanks for your time, [redacted]

Response:

To Ms. [redacted],Sometimes it is not about who is right or wrong. You believe with a passion that you are right and I feel the same. However, after cooling down and really thinking about this, I thought what would I feel if I was in your shoes. I wouldn't think it was fair that you have paid this money for the work and you are not satisfied. The fair thing I could do is to reimburse you the $800 to fix what you think is wrong. This would be fair for both of us because fairness is very important for how I do business and make some life decisions. Plus, I really feel bad that we could not have handled this better. After thinking about this, I must say I agree that you should be compensated and I will pay you the $800 you are asking for. When I stand in front of my maker to account for my deeds, he will ask me to explain this one. I want to be able to tell him I did what I thought was fair. I will have the $800 to you in a few weeks.Sincerely,Joe Tyler

I have reviewed the response made by the business in reference to complaint ID [redacted], and would like a exact date the $800.00 will be paid to me. I will wait for the business to perform this action and, if it does, will consider this complaint resolved
