Our company was contacted to construct a flagstone walk wayOur Landscape architect met with the client to attempt to come up with a solution
to a very unique idea that the client wanted to doWe ordered the stone material last fallThe material is a natural stone and is used for building retaining walls not for constructing flat walkwaysThe natural stone that should be used for walkways was unacceptable to the clientThe material the client requested were used the result would create a safety hazardWe have invested a considerable amount of time and money ( materials for the job which are non returnable ) in attempting to come up with a solution that is acceptable to the clientAfter consulting with the client myself, it was determined that it would not work as she had hoped and her deposit was returned

Had either Mr*** or Mr*** shown me samples of any stone material to substitute for the wall stone, I certainly would have considered such a substitutionHowever, I was not given such an opportunity, nor was I contacted by Tyler's Landscaping regarding voiding the contractIn October of 2014, Mr*** contacted me to report that they were having difficulties with the wall stone and that he was looking into other types of stoneNeither Mr*** nor Mr*** contacted me again until Mr*** phoned and left a voice mail for me on May 14, When I returned his call later that day, Mr*** said he couldn't do the projectI asked that he give me some options on what could be done, and asked that he contact me to set a time we could meetApproximately an hour later, Mr*** showed up at my door without contacting me first, as I had specifically requestedAfter looking over the areas for the proposed walkways, Mr*** handed me a copy of the original contract with the deposit (my check) stapled to the copyHe then left
It is inexcusable that Mr*** held onto the deposit for almost eight months, especially since he seems to have decided that Tyler's Landscaping couldn't do the work at least seven months ago
I will consider this matter resolved when I receive the original contract, voided, and a letter of apology from Mr***Mr*** needs to attend to this in a timely mannerWith the exception of the return of the voided contract and the letter of apology, I do not want Mr***, or any employee of Tyler's Landscaping, to contact me in person, by phone, by email or any other means
