U S A Appliances Reviews (2)
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me with a Full refund.
Review: I went to purchase a refrigerator for my office. There was only one that looked reasonable.Since I was not sure of the measurement of the space I was putting it in,I asked the cashier if it would be okay if I called in case the fridge turns out to be bigger than my break room could accommodate. I was told okay but I had to sign a receipt which later turned out to be a purchase agreement.I also paid for the delivery and installation charge of $80.Mind it they would not accept the credit card, only debit or cash. The very next day I called to cancel the order since my space was too small for that size refrigerator. Lo and behold,I was told 'no refunds or returns'.They never delivered or installed the product and kept my payment. Is this legal? I asked them. And they replied' who cares, have a good day'.

Since the item is not going to fit in and nonetheless it has not been delivered or installed,I would like to cancel the order and get my money back.
Initial Business Response /* (1000, 9, 2014/08/05) */
There are several discrepancies with Mrs. [redacted]'s claims.
She put in a special order for an item that needed to be repaired solely for her. USA Appliance has incurred costs associated with those repairs as well the cost of storing her item she no longer wants.
Mrs. [redacted] choose this item and was not coerced into purchasing the item. Nor persuaded to sign our sales receipt which indicates our terms and conditions.
We have informed the customer that their item is ready for delivery but she has refused.
I'm sure USA Appliance and Mrs. [redacted] can come to a reasonable solution, keyword "reasonable". However, Mrs [redacted] has a pending civil action against USA Appliance Inc.
And we have incurred costs due to her order which will warrant a counter claim if we cannot come to a reasonable agreement.
We want Mrs. [redacted] to be happy with the outcome and are willing to drop our counter claim if she is willing to drop her civil action against USA Appliance Inc. In doing so, we will provide her a check in the amount of [redacted]
Initial Consumer Rebuttal /* (3000, 11, 2014/08/11) */
(The consumer indicated he/she DID NOT accept the response from the business.)
First of all I am not Mrs.Second US appliance wanted to sell the item lying about the size exact size of the item. They were supposed to deliver and charged $80 extra specifically for delivery and then never delivered or even called to deliver the item. They sold the item to JPJHealthcare suggesting that it was in perfect condition with a 3 month warranty(otherwise why would I even purchase it ,common sense!).What storage counter claim when they themselves failed to deliver? Hence I filed law suit. However upon receipt of written apology and out of good faith I have dropped the suit against them in the hope that they would never treat their customers like that again.
