Dear Miriam Carmona: We are in receipt of your letter regarding the above complaint number made by [redacted] ***She contacted our shop regarding collision repair on her son's vehicleIt was not driveable, so they arranged to have it towed to our shop for an estimate on collision repairsUpon the vehicle's arrival, we were told it did not run, a friend had done some work and removed parts and wiring on the vehicleMs [redacted] stated that the reason it was towed to our shop was because of favorable reviews she read on Yelp and Google, she repeated this to us several timesShe specifically stated her son's boss would be paying for the collision repairs so he would be able to drive it for workShe told us the son's girlfriend had wrecked the car five months earlier and it had been sitting in their drivewayThe registration to the vehicle did not match MsKroger's name nor her son'sThe car was towed to our shop based on the fact that they wanted the collision repairs doneShe signed a repair order authorizing repairs on 3-22-First, the mechanical issue had to be resolved in order to correctly assess all the damageThe estimate was written and customer was called with total amount for collision repair and also amount due for mechanical repair to get the vehicle runningCustomer stated she would contact son's boss and they wanted the vehicle repairedShe understood the repairs were more than the value of the vehicle and wanted to proceedWe do not charge to write an estimateAfter discussing with other parties involved, called and said it was too much so they wouldn't be doing the collision repairsWe told her the amount for mechanical repair was $We charged her storage for each day the vechicle was in our shop as this was now not going to be repairedOur storage rate is $per dayAny vehicle that is brought in and then removed because of not repairing (total loss, etc.) is charged a storage fee for each day it is hereThis is customary and she was not singled outAll insurance companies and individuals pay this when this is the situationShe was not aware of this when she signed the repair order because she made it clear they had every intention of having the collision repairs doneAfter arguing on the phone about the charges, she hung upThey had a tow truck pick up the vehicle and paid the amount dueShe did not contact us for a refund, however, she did the following: went on a local Hemet Facebook page and proceeded to post everything that happened to her and how unfairly she had been treatedThis post was read by thousands of people and we have included copies of it and some of the comments made by the publicThis is Defamation of Character and she had no right to do thatWhat she SHOULD have done is contact us firstThen, contact your bureau and whoever else she thought she needed toThen wait for a response before taking it to that levelAfter sending her a letter and waiting a week, we sent her a Facebook message asking her to remove it and after much discussion, it was removed the following dayHowever, the damage has been done and cannot be reversedShe tried calling a few times, but never left a messageShe was told in the message we would not be talking to her until these issues are resolved with your agency and any others involvedHad she gone through the proper channels in the beginning, we may have been willing to negotiate with herNow, however, we cannot recoup the untold losses she has caused usShe has also posted negative review on Google and Yelp in order to reduce our five-star rating on bothWe have been in business for years, long before any social media and internet interaction was aroundIt's too bad she had to resort to this kind of actionWe understand you have to follow up on all complaints and to our knowledge, we have not had any in years.Sincerely, [redacted] and [redacted] Total Auto Body & Frame Shoppe
