Dear Sir or Madam We deny all her accusation We had advertised a cavalier convertible on craigslist for $for saleWe had quit a few local inquiries (buyers) Ms [redacted] husband also called and was very interested and he said what do you mean by good condition as we mentioned in the ad, and we reply that for years old car and considering the millage 110k and auto check (Vehicle History Report) witch indicate No Accident and we had just get California Smog check passed witch also is very hard and if any car has problem is not possible to get, so we think this car is in good conditionAnd per his request we emailed a copy of auto check to his email address that was given by himwe told him to be advice this car is in original condition the seat and leather our in original condition just keep in mind that this car is about years old so please come over with expectation that you are not buying a brand new carAfter he reviews the record (Auto Check) he called back and starts negotiating the price down to $and said that he will be at our office with cash to buy the car the following business dayAs he arrived and inspect the car he said that he wants to pay with credit card that is totally against our company policy to take credit card for car sales, Ms [redacted] husband also had problem over the sales tax that under California law we are obligated to collectIn regards to the title was at our main office witch we had to processed through DMV, Please be advice that as a California retail used car dealer we have up to days to processed the legal and title paper work As you wish all the supporting document and evidence is available per your request Thank You in advance for your time and cooperation [redacted]

Mr. *** misrepresented the condition of the car It was NOT in "Good" or "Very Good" condition, regardless of the age of the car It was in poor condition and had a number of mechanical issues, body damage, and cosmetic issues In the craigslist ad, he advertised the car as follows: "No AccidentNo Mechanical issue" and "Runs and Driver (sic) very well well no mechanical issueNo body Damage." In the telephone conversations, we asked him about the condition of the interior and he never mentioned that the seats were torn and coming apart He also never mentioned that the CD player was inoperable and that there was a large chunk of plastic missing from around the CD player He also did not mention the cracked and peeling dashboard He told us the air conditioning worked; it did not He also did not mention that there was an oil leak, which is most definitely a mechanical issue
After we filed this complaint, Mr*** immediately deleted the words "No body Damage" from his craigslist ad Shortly after that, he deleted the ad entirely I have hard copies of both versions and will attach them to this response He clearly knows that he should not have advertised the car as having no body damage because the car does have a fair amount of body damage It is not in good condition It would probably cost two thousand dollars to bring this car into "good" condition We understand that the car is years old and we did not expect it to be in perfect condition We expected there to be some minor imperfections, but this car was in poor to very poor condition regardless of the age of the car It is highly doubtful that it would have made the drive from California to Idaho without breaking down In summary, the car did have mechanical problems and body damage
We demand to be reimbursed $ If Mr. *** is not willing to reimburse us and to admit that he falsely advertised and misrepresented the condition of the car to my husband, we may seek legal remedy

With all do respect to all the false accusation, we have tried and attempt to contact them to resolve any possible misunderstanding. As of today we have not received any response from them. As we explained in our last email we advertised for a car that was 14 years old and has 110k miles. The AutoCheck report was emailed to him before he came to see the car. The AutoCheck report indicates that the AutoCheck score is 52 which is above average for the vehicles of similar type. According to AutoCheck similar vehicle scores are between 14-37. The California emission test was passed & the car was & is in good driving condition withm above normal wear and tear.

Review: We decided to buy a car after seeing the following ad: http://losangeles.craigslist.org/lac/ctd/4540656800.html (if they remove the ad it will not be found online). The 2000 Cavalier Convertible is listed in good condition with no mechanical issues and no body damage (they have since removed the "No body Damage" part of the ad, however I have a hard copy of the original ad). My husband spoke several times to [redacted] on the phone about the car. He specifically asked [redacted] about the condition of the car and asked if there was any damage to the interior or exterior of the car. [redacted] repeatedly said the car was in "very good" condition and that everything worked and there were no major flaws anywhere on the car. My husband negotiated a price of $2650 for the car and then bought an airline ticket to fly from Idaho to California on June 30, 2014. When he arrived at the car dealership, he found a car in extremely poor condition. It had major body damage along the driver's side of the car and there were numerous dents and dings all over the car. The interior leather was torn and ripped apart. The factory CD/stereo had been pulled out and a large chunk of plastic had been broken off in the process, leaving a gaping hole(and the face plate was gone, so it was unusable). The dash was cracked and extremely weathered. The leather on the arm rest was torn. The air conditioning didn't work. The car was dripping oil. And to top it off, the dealer did not even have the title to the car. There was no way my husband was going to buy the car with no title and with so many problems. The car was not in any condition to drive to Idaho. He basically had to walk away. We bought another airline ticket and he came home, out over $400 in travel expenses. This company needs to be held accountable for their fraudulent business practices and outright lies. The car in the ad looks NOTHING like the car for sale. They are being extremely deceptive.Desired Settlement: This company owes us $403. We paid $191 for a flight to [redacted] to pick up the car and then $35 for a shuttle ride. After seeing the car, we then had to buy another airline ticket home (to [redacted]) for $141 and another shuttle ride to the airport for $36. This totals $403, which we are now out because of this company's unethical business practices and false advertising. These are just the basic expenses (we are actually out much more), but this company needs to be held accountable.
