Review: We had a friend go and purchase a computer for us since due to issues we had with their store hours we were not able to pick it up ourselves, on bargain barns website they clearly state and have always disclosed any issue wrong with their product on line, I have purchased a few computers from them and have never had issues up until now, I purchased a apple imac 2006 20 inch display for $275 which bargain barn did not disclose any issues wrong with the system, but the screen pixels are bad as well as the computer will not accept the operating system, so we brought it back missed a full day of work and they even tried loading from their disk and it still would not work, they also tried telling us that they have a test room and that they offer the operating system to customers to try out, and told us our friend knew that since he was a regular customer and he had no knowledge of this at all! They refuse to do anything for us they will not even switch out the computer for one that works and the management there is horrible [redacted] was rude, did not help and kept not being honest the whole time. Also the receipt was never signed agreeing to their terms that the manager kept speaking of, so no one accepted these term and conditions.

Business' Initial Response

The Bargain Barn sells used surplus property owned by the University of California at Davis. The computer referred to by Ms. [redacted] was sold to a Mr. [redacted] on Monday, May 6, 2013, who is a regular Bargain Barn customer. Contrary to Ms. [redacted]' statement, Sales Receipt Agreement

[redacted] (copy attached), was in fact signed by the purchaser and includes the following provision:

Purchaser agrees it has inspected to its satisfaction the said property described on the receipt and accepts the same. The inspection of the above-described property was made prior to the time of purchase and Purchaser accepts the above-described property AS IS, and purchaser acknowledges that no warranties, expressed or implied, were made by the University of California Bargain Barn or its representatives. Purchaser, on behalf of itself, its hires, assigns, and successors, agrees as follows: The Property is being sold on an "as is" basis, and ALL SALES ARE FINAL. THERE ARE NO WARRANTIES (EXPRESSED OR IMPLIED), ADJUSTMENTS, REPAIRS, REFUNDS, OR EXCHANGES. Purchaser assumes the entire risk as to the quality and performance of the property.

Since items are sold on an "as is" basis we strongly urge our customers to thoroughly inspect all items prior to making a purchase. A computer testing room is available for customers to test equipment and we also have staff available to assist with this. As a regular customer, Mr. [redacted] is well aware of the "as is" policy.

A full week after the purchase date on May 13, 2013, Ms. [redacted] brought the computer to the Bargain Barn requesting an exchange or refund. Despite the computer being sold "as is" to Mr. [redacted] Bargain Barn staff attempted to resolve the problem by uploading an operating system onto the computer. It appeared that the upload was working and it was suggested to Ms. [redacted] that there could be a problem with her operating system disk; however she was not satisfied with this response.

The agreement in this case is between the University and Mr. [redacted] not Ms. [redacted]. In addition, the computer was sold "as is". We are sorry that Ms. [redacted] is dissatisfied, however due to the facts outlined above; we are unable to accommodate her request. We do our best to work with customers and resolve issues whenever possible.
