I am responding to complaint ID [redacted] regarding [redacted] dated 3/4/2016.We have stated our position in regards to [redacted] ’s claim in our prior two responsesWe have no additional comments at this time,Thank you

I am responding to the complaint from ** *** *** regarding a Mazda *** *** ** *** *** *** placed a deposit of $directly with Mazda Corporation, not with our business Mazda of Winchester to reserve a first right of refusal on one of the first Mazda *** ***
** vehicles built for the model yearThe vehicle arrived at our dealership, AS required by Mazda on all new arriving vehiclesWe removed all shipping materials, test drove the vehicle to make sure it was operating properly and cleaned the vehicle for customer deliveryThe *** were notified the vehicle was ready for them to take possessionThey arrived at our dealership and proceeded to complain about several aspects of the vehicleThey brought to our attention a very minor paint imperfectionThis was not due to damage or an accident but seemed to be a small paint issue below the fuel filter door area less than one inch in sizeWe offered to have it corrected but ** *** went into a dissertation about diminished value and wanting compensationWe advised we would have the small spot corrected but would not offer anything beyond that.The *** left without buying the vehicle and thus relinquishing their right of first refusal.held the vehicle for additional days while the *** were in communication with Mazda Corporation, who agreed with us that no additional consideration was warranted.The *** asked Mazda Corporation to get them another vehicle but Mazda declined due to the first units already had been built in Japan and shipped to the US.Almost everything built by man can have some form of minor imperfection, the imperfection on this once corrected would have no impact on its operation or valueThis was not a result of vehicular accident or damageI take offense to ** *** statement that he was to be treated as a special person not a regular person.We are all regular people ** ***-you certainly are not better than any of our other Mazda CustomersOnce the *** arrived at our dealership -it became our property** *** refusal to take delivery when offered voided his opportunity to buy the vehicleThe vehicle has been sold to a retail customer and is no longer available.have advised by Mazda Corporation that they are in process of refunding the *** their initialdeposit.consider this matter closed and have no additional comment.Bobby W***General Manager Mazda of Winchester

We received a complaint regarding [redacted] on 2/23/2018. We do not agree with all of [redacted] statements regarding his 2017 [redacted] but some of the concerns mentioned are accurate. The oil consumption that resulted in a short block replacement is accurate. Subaru corporation has...

had contact with [redacted] and have visited our dealership in Winchester to inspect his [redacted]. Any discussions regarding refund, buyback. compensation or Lemon Law concerns need to be between Subaru Corporation of America and [redacted]. The oil consumption issue was a manufacturing issue not a dealership issue.Our understanding is that these discussions between Subaru and [redacted] are ongoing. We hope for a fair and reasonable resolution and will help facilitate if possible.We consider Subaru of Winchester response to this matter closed until we hear otherwise from Subaru of America.

I am responding to complaint ID [redacted] regarding [redacted].We did perform a manufacturer's recali and Virginia State inspection on [redacted]'s 12 year old 2004 Mazda [redacted]We did not however do any damage to his dash or any portion of his vehicle during the course of the inspection or recall....

Since [redacted] does not feel that either normal wear and tear as a result of age or use of his vehicle resulted in the damage or he or someone else damaged the dash personally—then his only conclusion is that we must have done it.Our technician was not performing any repair in the area of the damage. He did remove the state inspection sticker which he did so from the driver's Seat area using his right hand to scrap the old state inspection sticker and replace it with a new one.We did offer [redacted] a substantial discount on parts and labor if he wanted to have the dash replaced After he brought his concern to our attention the following week, but he refused.Our conclusion is that [redacted] does not know how the damaged occurred thus in his mind we had to do it but our technician—who is excellent and has been on our staff for over 15 years is adamant he did not do any damage to [redacted]’s vehicle, in the past, when an issue or accident has occurred with any customer's vehicle, our factory trained technicians have brought the issue to the attention of our Service manager and we have taken care of the issue,We are sorry [redacted] feels we should be responsible for his issue but he has no proof that this damaged occurred at the time his vehicle was in our service department. would also add that [redacted] has only been in our service department a couple times with his 2004 Mazda. I am not aware of how long he has owned this 2004 Mazda but I would assume other maintenance or repair facilities have serviced it. Not just us.Thank You,

I am rejecting this response because:
There is no resolve for the damages by Mazda of Winchester. They have refused responisbility of what happened while the vehicle was in their possession.
