I am rejecting this response because:Ugly Deck Salesman never disclosed possibility that "sleeper system" boards might need to be replaced Contract specifies such boards to be used; Ugly Deck KNEW boards were rotted and failed to check Sleeper system boards

As far as we are concerned this matter is closed We offered more then reasonable responses to their problems We sent out our service guy, the manufacturers representatives, and offered to help on a problem that we did not cause Again the homeowner notified us 5-weeks after completion, after we had already been there to take care of a punch list So to say they were not on the deck after it is was completed is a flat out lie How do you come up with a punch list if you were not on the deck? you don't Bottom line, we do not want to invest any more time on this, I'll say it again, we will let our reputation speak for itself

please see previous response our position has not changedThis was NOT an attempt to get more money of any sort, this is a small job for us and we are swamped Our sales guy says he of course did mention that there was no way to see what condition the framing was in (see photos), Just to reiterate, this was a Rubber roof top deck, so until you take the old decking off, there is no way to see the condition of the framing under it Any contractor would tell them the same thing therefor he couldn't guarantee the shape or condition it was in We could have been like percent of the contractors out there and just put good decking on the framing, and maybe it would last 10yrs? maybe 20? no way to know But being the company that tries to do the right thing, we brought up this point, so THEY could make the decision on THEIR framing We even offered to lowered our cost to re-frame it to work with them, and they refused to pay for THEIR framing

UglyDeck.com entered into a contract with *** *** on 4/11/for $8,This contract was for replacement of their decking and Fascia on an existing rooftop deck. The contract clearly states that we were planning on using the existing sleeper system “Frame” for
the project Unlike the standard deck where you can see the framing to inspect, in a rooftop deck there is no way to inspect prior to removing the decking and starting the jobRoof is below the framing and the Decking is above the framing(See attached picture of the sleeper system attached) On our Terms and Conditions page that is given to the customer at time of signing the contactSection would address the issue of concealed -Pre-existing conditions(See Attached Contract and Terms and conditions Page) After removing the existing decking it was decided that the sleeper system “Frame” was questionable for applying the new decking. We offered the Customer optionsOption #We would attach the new decking to the existing sleeper system as stated on the ContractBased on the condition of the framing we could not determine how long it would lastThis was not acceptable for the customer.Option #$to replace the sleeper system with new lumber which would include removing the existing sleeper system. The customer came back and said they would only pay $We lowered our price to$for the total replacement so we could get on with lifeThey did not accept this.Option #$We offered to add material alongside the existing frame that would sit on the roof and we would attach the decking to this framingThey refused this offer as well We are not forcing the customer into any of these options. We have received payment for $for this jobWe have $in labor and materials into the job right nowWe would expect to be paid the balance if they decide to have another contractor finish the work

I am rejecting this response because:
A resonsable person would not accept these remedies: "We are willing to work with TimberTech rep to blend scratches" Ugly Deck failed to mention that they said they would not be held responsible for any damage caused by the heat gun. "Replace up to damaged boards using screws/plugs that may not fit as well with the current decking." I don't think this is a viable option becuase it is not addressing the problem with all of the scratches and it leads me to believe that the integrity of the deck may be compromised. Bottom line, we paid for a deck that should not have any scratches when completed When we first stpped onto the deck and looked closely, we saw the scratches and contacted Scott immediately From that moment, Ugly Deck never took any responsibilty and accused us of damaging the deck At this point, I would like the owner Josh to call me directly and addess the issues I have

below is the email we sent explaining things from our side. Customer created punch list of things for us to take care of. Meaning they did go on the deck and go through it. You don't go through the deck, create a punch list before making final payment and not see scratches,
(By the way not talking about a few boards, scratches are on numerous boards). They did not see them because they were not there. we do not, and never will leave a brand new deck with scratches all over it. it would be different if there were a few boards to be replace, the customer thinks the whole deck should be replacedhow is this missed when you go through the deck with a purpose of a punch list to see what needs to be taken care of? Customer states we did not get back to them, not true, here it is. as you can see we tried to resolve in a fair manner. We will not apologize for something we did not do. We have been In business for years and will let our reputation speak for itself. ***,We feel as though we have done everything we can to make you happy with the deck we built We do not believe that the scratches were caused by our crews at the time of installation based on a few factors. 1. The deck was finished on 1/28/Nothing was mentioned to us regarding scratches at that time2. We came out to take care of a few punch list items that you wanted done on 2/2/(Nothing was mentioned about scratches at this time) A big snowstorm happened on the day we completed this3. Email in 2/8/from *** made no mention of the scratches but did mention a few nails and trash in the sandbox ,sawdust under snow ,and scrap wood on side of house.4. 3/15/we came out to look at scratches we were called about and cleaned the yard.5. The scratches are not on singular boards, they continue through multiple boards so they would have been scratched after installation( *** mentioned to the owners when they were out that the scratches were not caused by the deck crew)And the only thing that the rail installer brings up to the deck is screw guns to mount the rail. He does all the cutting and assembly on the ground.6. There was time to notice any scratches between 1/and 2/2. No snow during that time. Also in the snow had been melted weeks prior to ***’s phone call about the scratching. Options going forward are: 1. We are willing to work with the Timbertech Representative using the heat gun to blend the scratches as much as possible. 2. We are willing to replace up to boards in the field of the deck of your choice.When replacing these boards they would have to be replaced with cortex screws and plugs and may not fit as well as the current decking. By us doing one of these options we are NOT saying that we did the damage
