I requested help on the 27th July, to pursue a window manufacturing company that had supplied defective windows for export to the CaribbeanDue to the fact that they were packed for export the goods could not be examined until they reach their destination nearly four weeks after delivery to the loading dockOne of the initial concerns was the time delay between delivery and any actionAfter the consignment was given a closer inspection a rejection notice was issued to the window manufacturer on the 5th AugustAs I had heard nothing from Ulrich, Scarlet, Wickman & Dean I decided to chase them on the 24th AugustThe question has to be asked why was I chasing them? They were the ones going on about delays enabling a claim of acceptance by defaultOn the 25th August I received a reply stating, "We have not received a reply yetI will attempt to contact them to see if a reply is forthcomingIf not, we can proceed as necessary." On the 26th I sent a reply which stated I would wish to move directly to issuing proceedings without wasting further time"On the 8th September I had a meeting with their Andrew Cwhere it was discovered that no action had still been takenI impressed upon him the urgency to get on with itBy the 6th October it was still the case nothing had been doneI wrote to John Wand he told me that Andrew Cwas in Court and he would get back to me the following dayHe failed to do soSo much for time delays prejudicing my case, the Rejection Notice was filed on the 5th August, I fired them on the 13th October and they did nothing in betweenNo I have that wrong they issued me with two invoices! After complaining to a paralegal at the firm I eventually got the offer of a conference call between myself, Don Sand Andrew CBy this time I was disgusted and purposely failed to respond and fired themDuring the whole of this sorry episode my father passed away and I had cardiac surgeryYou pay a great deal of money to lawyers and the least you expect is for them to conscientiously carry out their duty of careIn my opinion, for what it is worth, I think the above demonstrates a gross dereliction of dutyI received a limp olive branch apologyThe fees charged by Ulrich, Scarlet, Wickman & Dean were of course for nothingPlease draw your own conclusions

One of the initial concerns was the time delay between delivery and any action. After the consignment was given a closer inspection a rejection notice was issued to the window manufacturer on the 5th August. As I had heard nothing from Ulrich, Scarlet, Wickman & Dean I decided to chase them on the 24th August. The question has to be asked why was I chasing them? By the 6th October it was still the case nothing had been done. I wrote to John W. and he told me that Andrew C. was in Court and he would get back to me the following day. He failed to do so. So much for time delays prejudicing my case, the Rejection Notice was filed on the 5th August, I fired them on the 13th October and they did nothing in between. No I have that wrong they issued me with two invoices! After complaining to a paralegal at the firm I eventually got the offer of a conference call between myself, Don S. and Andrew C. By this time I was disgusted and purposely failed to respond and fired them. During the whole of this sorry episode my father passed away and I had cardiac surgery. You pay a great deal of money to lawyers and the least you expect is for them to conscientiously carry out their duty of care. In my opinion, for what it is worth, I think the above demonstrates a gross dereliction of duty. I received a limp olive branch apology. The fees charged by Ulrich, Scarlet, Wickman & Dean were of course for nothing. Please draw your own conclusions.
