To whom it may concern, We have reviewed the response on claim # [redacted] and have the following comments that are underlined? ? Please find below our response to the negligence claims, an updated timeline by our agent involved, and attached phone records to show there was plenty of response from the agent to the owner and clients.? This is separate from all the emails both agent and clients exchanged in connection with this process, not to include the days the agent was in Europe visiting his daughter, 4/29/18-5/8/Agent has been in the business for many years and has a great reputation with landlords and clients alikeA.? ? ? ? ? ? ? ? ? ? ? ? ? ? The misbehavior and negligence of Modern Real Estate:1.? ? ? The agent was totally not responsive to us during the process.? It took him days to send us the lease after the 3rd? roommate handed in her application and ID; it took him another days to get back to our queries about the lease [please refer to the timeline and the Attachment & 2]---Agent was very responsive through email and clients even thanked him several times for answering their questions2.? ? ? The agent was not responsive to the landlady as well? while, at the same time, he forbid us to contact the landladyWe were informed by the landlady that the agent lost contact with her, and thus she in the end rented the place to another group [please refer to the timeline and the Attachment of messages].?"The agent was very responsive to the owner with several phone calls back and forth regarding this apartment3.? ? ? Modern Real Estate misused the one-month-rent deposit? ($2700)The agent required one-month rent as a deposit to keep the unit off the marketWe agreed and handed it in on Mar[please see Attachment of the receipt]It is clear that the deposit did not keep the apartment off the market as the broker company promisedIf the company cannot keep the place off the market, for what purpose did it request the deposit in the first place?-Whenever we receive a deposit an owner will keep it off the market but if they go behind us and choose to continue to show the unit and rent it out, we can’t control that part of the process.? Most owners would not do that but in this case she chose to without any warning to usWe put our trust in the owners to honor what they sayThe only time we are able to fully control the situation is when we own or manage a unit that is for rent.? This owner said it would be held off the market and did so for a period of time and then went in a different direction, this was completely out of our control 4.? ? ? Modern Real Estate also illegally charged us an application fee? ($120) on Mar21, which reflects how Modern Real Estate misconducted business and crossed the borderline of regulations to bully its customers [please see Attachment of the receipt]The application fee is not allowed in Boston [please refer to the website of? City of Boston, [redacted] ]What made us more astonished was that the agent at first was unwilling to return the fees to us until we sent email informing him that we might complain to Revdex.com [please see Attachment of emails].- This is a claim and a defamation of character, there was no such bullying involved in any part of this process.? We as a brokerage are allowed to charge an application fee as long as we do not work as a broker employed by the owner.? We are a separate independent brokerage not employed by any owner.? ? ? 1.? ? ? Evidence for how we properly behaved:? ? ? ? ? ? ? ? ? ? ? Modern Real Estate in its response implicitly owed the deal’s termination to our procrastination.? We consider that as a purposive twist of the truth.? ? ?" The deals termination was the sole choice of the owner, we believe she strung us all along and did what she wantedThe procrastination on behalf of the clients may have added to the reason the owner decided to terminate the deal, but it was the owner’s own choice to do so without any warning to us.? We have rented many apartments this year so we were as surprised as the clients that she decided to go in another direction with no notice? Landlord met in the office with the clients and everything seemed to be moving along, she did state there would be so security but later found out there was an undergrad involved and she wanted a security deposit at that point4/14/18? ? ? ? Received 3rd Application and Guarantor’s Form and was submitted the Application to the Landlord.4/17/18? ? ? ? ? Contacted the Landlord to check the status of the ApplicationLandlord did not have a chance to review it yet.4/18/18? ? Contacted the landlord and had a conversation with her about the status of the ApplicationLandlord does not normally accept undergraduate students and does not feel comfortable by accepting undergraduate studentsShe said she needed more time to make a decision.4/25/Lease was created and sent to the Applicant for preliminary review after the owner said to move forward4/26/18- Along with many emails back and forth between agent and clients, agent had a minute phone conversation regarding the entire process while answering many questions [redacted] > Apr ? ? to [redacted] , bcc: [redacted] Hi,? Thanks.4/26/Landlord called saying that will accept an Application but needs Security Deposit.4/25/After receiving the Lease on April 25th Applicants sent email asking the Lease to be signed weeks later, on May 15th.? Landlord did not feel comfortable with the whole situation but did not give a clear answer.4/29/18-5/8/18- Agent was out of the country to visit his daughter in Europe05/10/The Applicants still trying to negotiate the term of the Lease.? It is clear that the landlord decided to go out on their own without our knowledge to look for another group while we were kept in the dark? [redacted] May ? ? ? to [redacted] , [redacted] ,me ? Thank you for the correctionsI looked at itI remember when we asked the landlady that if we don't have to pay security deposit, the Landlady told us "but you have to promise me that you will keep the place clean."And we promised.? In response in complaint #*** 1) Explanation of canceled deal by landlady: The timeline of events would be the best explanation of why the landlady decided on her own to rent the unit to a group we had no interaction with. Our
agent was in constant cordial contact with the applicants throughout this process with no indication they would not be securing the tenancy from the landladyOur agent answered their emails in a timely manner and they had a good working relationship from what I have seen from the email transcriptsWe do not own or manage the unit so at the end of the day we can’t stop an owner from going outside the norm and renting a unit they own to another groupThe landlady took a very long time to acknowledge that these applicants could move forward and that a lease could be presented for signature. Once a lease was given to us for approval on 4/25/it was presented to the applicants. The applicants had several questions about the lease and wanted more time to review it. A few days time was given to answer specific questions but because of their schedule and other circumstances the applicants asked for a lease sign date of 5/15/18. This was several weeks later than when the lease was presented and it was explained to the applicants that the lease needed to be signed asap and that we could not guarantee the unit would stay available for that long. During the time frame up until 5/15/we were given no message or indication that the landlady would rent this unit to another group. It is of course unfortunate for our clients because they spent time trying to secure this apartment. We can understand the frustration because we also spent a lot of time trying to make sure this tenancy went through but the landlady took it upon herself to rent the unit out to another group. Please see the timeline below which may help clarify the explanation: 3/21/18- applications filled out by two applicants and a schedule of deposits signed by those two applicants, they needed to find a 3rd roommate since it was a bedroom unit 4/8/18- 3rd applicant found and approved by current applicants, 3rd applicant filled out an application which was presented to the owner 4/14/18- co-signer information and a copy of the ID from the 3rd applicant was submitted 4/15/18- 3rd applicants information was presented to landlady 4/25/18-a lease was given to us which we sent to the applicants for their review and signature 4/25/18-many emails transpired back and forth between the agent and applicants regarding more time than a few days to sign the lease, applicants requested a lease sign date of 5/15/4/25/18- it was explained by the agent that the landlady wanted the lease to be signed the week of 4/and the applicants were urged to sign that lease as soon as possible and not push the date they could sign out so far 4/26/18- agent spoke to the landlady to ask for more time and she said ok but she would like it signed that week Late April to early May- agent checked in with landlady and said that he would be out of the country and that the applicants would sign when he got back, she indicated that was fine 5/13/18- out of the blue agent received text from landlady that she did not want to wait any longer she re-rented the apartment **Modern Real Estate was given no indication by the landlady that she was going to re-rent the apartment and waste all the time and effort everyone spent trying to secure this 2) Refund: the total deposit of $was already refunded on the morning of 5/21/and picked up by an applicant prior to the complaint being filed with the Revdex.com 3) Compensation: Modern Real Estate will not be providing any compensation to the applicants other than their full deposit that has already been refunded.

Evidence for how we properly behaved: Modern Real Estate in its response implicitly owed the deal’s termination to our procrastinationWe consider that as a purposive twist of the truth We handed in deposit on Marto keep the unit off the market [see Attachment 4] We sent back our inquiries about the addendum the next day we received it, but it took the agent days to reply [see Attachment 1] We requested to finish signing the lease quickly on Apr and sent several follemails during the waiting periods, but received no response for a long time [see Attachment & 2] We Request: Due to the deal’s termination, we missed the best season to find an apartment, which incurred an extra huge cost to us (e.g., time, money and effort)We thus request two-month rent ($5,400) as a compensation for the cost incurred as a consequence of the agent’s and the company’s negligence Timeline:(Note to the reader: The black lines are timeline provided in the responseThe red lines are the material incidents that happened in between/concurrently but the Modern Real Estate purposefully did not mention in its response.)3/21/18- applications filled out by two applicants and a schedule of deposits signed by those two applicants, they needed to find a 3rd roommate since it was a bedroom unit4/4/18- the agent urged us not to contact the landlady directly (but he lost contact with the landlady later) 4/4/18- 3rd applicant found and approved by current applicants, received an application that needed to be filled [see attachment 2.1]4/8/18- 3rd applicant found and approved by current applicants (that was on 4/4/18), 3rd applicant filled out an application which was presented to the owner 4/10/18- 3rd applicant submitted the co-signer information and a copy of the ID [see Attachment 2.2]4/12/18- We sent an email inquiring about the the 3rd roommate’s application, the agent replied “I will know only after I present to the landlord”4/13/18- We sent an email asking about next steps, and requested to proceed the signing process quickly, but didn’t receive any feedback [see Attachment 2] (during 4/13/18-4/25/18, we didn’t heard back from ***)4/14/18- co-signer information and a copy of the ID from the 3rd applicant was submitted (that was on 4/10/18)4/15/18- 3rd applicants information was presented to landlady4/25/18-a lease was given to us which we sent to the applicants for their review and signature 4/25/18-many emails transpired back and forth between the agent and applicants regarding more time than a few days to sign the lease, applicants requested a lease sign date of 5/15/184/25/18- the lease addendum has a lot of unclear or misstated terms (e.g., security deposit, agent fee) which we thought we need time to figure out, and we sent an email asking for more time till 5/15/18, but didn’t receive any response We also asked if we could sign the lease electronically after knowing that the agent will be out of town for a week, the request was declined first by email but later, *** told us over phone that we can sign electronically by that weekend after we get satisfactory answers to our questions about the lease addendum4/25/18- it was explained by the agent that the landlady wanted the lease to be signed the week of 4/and the applicants were urged to sign that lease as soon as possible and not push the date they could sign out so far4/26/18- agent spoke to the landlady to ask for more time and she said ok but she would like it signed that weekLate April to early May- agent checked in with landlady and said that he would be out of the country and that the applicants would sign when he got back, she indicated that was fine4/26/18- knowing that the landlady wanted us to sign as soon as possible, we returned all of our questions on the lease addendum to the agent, but received no response hereafter [see attachment 1].5/4/18- we sent a follemail to *** without any response [see Attachment 1]5/10/18- we sent another follemail to ***, he replied first with an addendum without adjustment [see Attachment 1](During 4/26/to 5/10/18, the agent did not reply any of our emails and lost contact with the landlady) 5/13/18- out of the blue agent received text from landlady that she did not want to wait any longer she re-rented the apartment5/13/18- as the agent can’t explain to us about the snow removing terms in the addendum and we were about to sign the lease, we sent a message to landlady to inquire, but was informed that she hadn’t heard from ***, and the deal was terminated [see Attachment 3]5/13/18- the agent was only willing to give back the deposit ($2700) and tried to keep the illegal application fees [see Attachment 4]
