Yes, my [redacted] membership was transferred to Ultimate Fitness without my knowledgeThe phone number for Ultimate Fitness is ###-###-####I believe the owner is named James DeFalco and his email is [redacted] @***.comUltimate Fitness Center billing goes through [redacted] Services, INC whose number is ###-###-####, email [redacted] @ [redacted] .comAgain, I just want to be sure my membership is cancelled and I am out of their systemI do not want to be billed for as I never signed anything for them stating this nor did I say I wanted to be with Ultimate Fitness after [redacted] had closedI have attempted to cancel at least times nowThank you

Regarding this customer complaint, the customer sent their cancellation letter within the three day cancel period, per policy on the contractRecently there has been a change in our cancellation department location that has caused all cancellation letters to be forwarded directly to the clubFor reasons unknown, the customer's letter was not forwarded to our new addressAt the time this complaint was filed, we had already received notification of attempts to deliver this letter to our previous address Once that error was realized, we had already refunded the member the monthly payment that was taken outDue to billing system error, a second payment was taken by mistakeWe have refunded the customer both monthly payments that were taken in addition to the original down payment of $that was paid by the customer and have officially closed the account (total of all refunds to be $43.98)Unfortunately, we cannot compensate the customer for payments made to the postal carriers to follow procedures on cancellation, nor can we compensate for potential post office or mail carrier errorFurthermore, the club cannot return original membership documents, as we are required by law to keep them on file for up to months, regardless if an account is active or cancelled, and all customers receive a carbon copy of such paperwork upon sign upHowever, upon cancellation, all credit card information is deleted and/or destroyed as required by law This notice is to serve as the official cancellation of the customer account, with no further payments to be due or charged to the customerWe apologize for any confusion this may have causedWe also consider this matter to be officially closed with this responseSincerely, Bally Total Fitness Sincerely, Bally Total Fitness

This customer has been refunded $due to an error in forwarding cancellation notices to our new cancellation departmentThe customer sent a letter in JanuaryDue to our day policy for cancellations, the cancellation would normally be in effect days from the date is was postmarked
Therefore, the customer would be billed one more month ( February ) before the cancellation would take effectThe customer has been refunded the remaining three months they have been billed and the account has been closed. Statement taken over the phone: I have been notified by the billing company the the contract has been cancelled When this gym closed they did not notify us how to cancel the contract I have been trying to cancel since July The notice says it is canceled as of October 19,

She has a zero balance and was cancelled as shown in her history. I will contact the billing company to correct their mistake She could not have a past due because she was paid in full

Revdex.com spoke to Chris at business and the following was relayed: I am the Manager of the Cancellation DepartmentThe customer entered into a day trial contract on 5/15/There was a day right to cancel wherein the third business day would have been Tuesday, 5/19/We have no record
of a certified letter having been sent within that time frameIf the consumer has a tracking number to confirm a certified letter was sent by or on 5/19/I will be able to retroactively cancel the contractIf not, the day trial contract that the consumer signed requires visits within that days and if there are not visits then it becomes a month contract which costs the initial $deposit and $month for a total of $Business states they did move approximately a mile down the road but that they are currently openRevdex.com is requesting proof that either cancellation was done properly and in time, a certified letter sent within business days of signing the contract or that visits were made within the trial period of days

Today, I received your letter dated September 3, 2015, regarding the above referenced complaint. This was a credit reporting issue where one of the three credit reporting agencies was reporting that a loan still had a balance. We provide the same credit reporting information to all three agencies so...

I'm not sure why two reported correctly while Transunion did not. We have submitted a form to update and correct the Transunion reporting information. I have provided Ms. [redacted] a copy of this form that we electronically submitted to the credit reporting agencies on September 4, 2015. This will correct the reporting error. I also sent [redacted] a letter explaining the actions that we have taken to resolve this issue. I believe that this should resolve the issue to her satisfaction. Due to billing system error, a second payment was taken by mistake. We have refunded the customer both monthly payments that were taken in addition to the original down payment of $10.00 that was paid by the customer and have officially closed the account (total of all refunds to be $43.98). Unfortunately, we cannot compensate the customer for payments made to the postal carriers to follow procedures on cancellation, nor can we compensate for potential post office or mail carrier error. Furthermore, the club cannot return original membership documents, as we are required by law to keep them on file for up to 24 months, regardless if an account is active or cancelled, and all customers receive a carbon copy of such paperwork upon sign up. However, upon cancellation, all credit card information is deleted and/or destroyed  as required by law.  This notice is to serve as the official cancellation of the customer account, with no further payments to be due or charged to the customer. I do not want to be billed for 2016 as I never signed anything for them stating this nor did I say I wanted to be with Ultimate Fitness after [redacted] had closed. I have attempted to cancel at least 4 times now. Thank you.

Revdex.com did request a copy of the contract and was told that business will have Margaret from the billing dept. call  back. Revdex.com has not received a call as of yet.

Response taken by phone:  There is a pending cancellation on the account.   Once the balance of 69.98 is paid the cancellation will go through.

I have repeatedly requested a copy of the contract but have not received it.
