The gym continued to debit my bank account after I followed the instructions to cancel the account. This occurred 3 more months after we submitted it.
I began our contract on 12/30/2016 and was attempting to end the contract in Aug of 2019. I called the gym and asked what steps were needed to cancel. The manager stated that I had to send her an email and pay that month for our service and the account would be closed. Doing so I have my wife the email address provided to me and she sent the cancellation in.
I noticed in December of 2019 that I was still being charged. So I immediately called the gym to state that I wanted to cancel the account and explained that I had been charged for 3 months after I ended my account there. The manager ended my contract per my request but did not attempt to reissue my 3 months of payments without speaking to the owner. After calling multiple times to make sure the matter was handled, I finally sent a letter to the gym myself.
I received a letter today from the owner. He stated that we went on social media and sent a message, incorrect. He stated he did not understand why we didn't notice the charge before then, not his problem. He stated that he thought the charges were accurate. I am going to write another letter back to him to state my case again, but I will also speak with my family attorney concerning this matter. All I asked was for the gym to refund me a total of 168 dollars. That's for the 3 months of being charged after I cancelled my account the exact way we were advised to do so.
The amount debited was 56 dollars per month for 3 months. 168.00

*** was made aware of the cancellation process and it is clearly explained in the attached contract. *** is not a acceptable notification since it is only a "Social Media" platform and has no legal binding clauses and is not considered a legal communication or a legal document. We do not take any cancellations via social media, nor do we say that we accept *** as a cancellation method. Attached is the *** cancellation we received, it is tagged as a note to the *** page which is circled. Also, we have attached his contract that he signed that also explains the steps to take to cancel. We've attempted to explain this to *** however, he seems to think that sending a *** message is "good enough". He has mentioned many times that his parents are lawyers and that he would have them "go after" us, however, I'm assuming if they are lawyers they too will agree that their son did NOT follow the proper cancellation process. In closing we have provided documentation that clearly identifies the cancellation process and clearly shows that he in fact DID NOT follow the correct procedure and just sent a *** message and assumed it was "good enough".
