Initial Business Response / [redacted] (1000, 5, 2015/06/29) */ The actual Property agreement started on September 29, and ended April 29, by owner The contract stated we are to collect 10% only for monthly management, nothing more other than the first month rent and owner would get the deposit Around December 10, owner requested we put up a hand rail per insurance and paint basement floor with paint already supplied, had to purchase more paint and apply another coatHome was also cleaned, bathroom vacuum, clean refrigerator, and to repair wall oven that needed a new board in order to repair per owner request because she had no one to do cheapCost $which owner paid with credit card On 1/22/we found a tenant for home and received deposit of $and first month rent of $and prorated rent of $for February A City of StJohn inspection was done and a laundry list of repairs were required to obtain occupancy and we rushed to help get tenant in as this was a tenant that they were currently living in a hotel because of a fire to their home Repairs from inspection were done at a cost of $1,745, in order to get occupancy theses needed to be done, repair asphalt hole in driveway, install cap on chimney, sewer vent on roof needs to be extended to inches, replace missing siding, replace missing chain link fence ( owner request), put up working smoke detectors, fix downspouts, and several other issues from inspections As agreed upon with Ultimate Realty to find a tenant we charged owner the first month rent as a one time fee, we guarantee a tenant for a year and if they moved out we would find another for free Once tenant moved in on 1/23/tenant said sewer was backing up, we went out and cleaned out, again tenant said issue of toilet not flushing happen again, we then pulled the toilet and found that it had dried up matter that turned into concrete causing the issue (very nasty)We replaced toilet, wax ring and intalled for $owner approved After all expenses and repairs total charges had exceeded income until the month of April when that rent was paid by the insurance company and owner received a payment of $Since owner continually complained about expenses out of our control and could not understand the statement we provided several times she decided to contact insurance company and have future rent checks sent to her direct and which I confirmed with them on 4/29/that the property management agreement was cancelled by ownerUltimate Realty has not received any payments for rent since 3/28/for April rent There is no money owed to owner from Ultimate RealtyI have confirmed with the insurance company that checks for May 2015, June (which she lost and was reissued then cashed along with new check) have been cashed and clear the bank

Complaint: [redacted] I am not sure what my permit of residence has to do with the issue at handHowever, if they would have complied with the city I would of had it the first, second, third and fourth time I went up to the officeI continued to contact the city to see if [redacted] replied to there request of documenting the windows being repaired I spoke w/ [redacted] the leasing agent who showed me the house and advised her of this on 06/28/right before I was to meet her to obtain the keys She allowed me along with the company to move into the unit without the permit On yesterday when the technician came to the house to repair the leaking toilet from the bathroom [redacted] contacted the office and explained to them yet again that he could not find the issue I had to advise him along with my friend [redacted] with [redacted] Contractors were the issued lied Once [redacted] started removing the rust and wood that was damaged from the ceiling in the basement which was located right underneath the toilet The water being to come down on his head immediately Which has been the issue from day one My daughter aid even advised [redacted] and myself were the leak lied the first, second and third time he appeared at the home This issued did not get resolved until I threat to file a law suit against the rental company because my daughter who is disable had fell in the bathroom The toilet was loose from the floorIt had never been sealed properly around the toilet or the tub again until Mr [redacted] brought it to ***'s attention In regards to the leak in the roof and being advised that they had to wait to speak with the owner since the repair was over $this has just been brought up I was involved that they thought the issue had been resolved and the second time was because the owner of the property had not paid them for other repairs that had been performed on the unitI was advise this information by [redacted] the office manager, [redacted] the leasing agent who referred me to [redacted] G the ownerI spoke with him on his cell phone and you requested that I send him an email of all repairs that need to be done He advised that he would take care of them allBut never did!!! The roofing company that they used Advised me that the rental company never gave them my telephone number, so they just took a chance to come and look at the roof and see exactly what needs to be repairedOn the work order the roofing company had it did not have my telephone number on the document from the email that [redacted] the tech assist from [redacted] supplied them with Everyone in the office is extremely petty and lie beyond words Every single compliant on this company is TRUE!!! They try to make it seems as though its everyone else and not them Fact of the matter, [redacted] might have performed the work, but it wouldn't have been done correctly if [redacted] would not have shown him the issue If anyone should receive payment Mr [redacted] shouldIt is so amazing how rental companies always want to blame the tenant Its the companies we rent from that has the issue with not repairing thing in a timely manner They deicide to try and charge me $for a pet depas though the dog hasn't been here with my family since the moment we moved in Her name is on the lease that I signedBut today I was being charged for her They tried to tell me that if I didn't pay the dep they would take it out of my security dep when I move out of the until 6/ If you do right by your tenants then you won't have this problem at ALL!!!!!!!!!!!!!!!!!!! I have emails going as far as 9/8/corresponding with this office about issues This house was not fit for anyone to move in at the time I signed the lease It should have never passed inspectionSo the things that are in the work order that he has attached is not everything I wish I could attach every single email, text message and none replies that I have but bottom line is I will truly be glad when 6/come because I will be moving out of this rental property I strongly suggest that NO ONE rents from them they are a HORRIBLE property management company Sincerely, [redacted] ***

As of 8/4/all these issues have been resolved, gutters, a/c, and concrete repairs.Ultimate Realty is the property manager for this tenant We collect the rent monthly and take maintenance repair request The owner of the property normally does the repairs himself So when Ultimate Realty gets a request for a repair we will then forward to the owner and he takes care of, unless it's something he can't handle then ultimate will repair Owner was informed of the a/c, Ultimate Realty sent our certified technician that is licensed to work on HVAC to repair Owner was contacted about the gutters and the concreteHe repaired and cleaned the gutters out on 8/2/to remedy the water leaking into the basement On 8/4/owner was working on and completing the concrete repairs to the front side walk The owner dropped the ball on the concrete as it was too cold in December to repair, he then forgot about it and has apologized in person Tenants asked him also for ceiling fans to be installed which the owner is putting up also on 8/4/

Correspondence with tenant began in November of The Property manager was informed by the city municipality that the tenant had not obtained her occupancy permitUpon contact with tenant regarding the permit, she stated that she needed a receipt for a window replaced prior to her move in
Tenant also stated that the roof was leaking and had not been taken care of yetWith our company, any maintenance work that will cost the owner of the home over $cannot be completed without prior owner approvalThe owner of this home at the time was out of the country and we were unable to obtain a timely responseThe property manager made the executive decision to fix the roof without the home owner’s approval to accommodate the tenant’s requestsTenant requested that the roofers call to schedule an appointment with her before coming out to perform an estimate and a repair, due to her daughter having special needsNotes were on the work order sent to roofing company to call and schedule with tenantThey did not call before arrival to complete the estimate, which did upset the tenantWe assured the tenant that we did inform the roofing company of her situation and apologized for their lack of communicationSince then, tenant has continued to contact us in regards to her rental payments, bankruptcy, and maintenanceTenant was informed via e-mail that the quickest way to get maintenance orders taken care of is to submit through the online tenant portalShe responded “First of all, Any and all repairs have been made through the portaland nothing has been done about it as explain the roof leak that you and your staff thought it was resolvedThis is my supporting documentationSecondly I am an adult and I can do what I wantThird, Do your job and I wouldn't need supporting documentation to make all my complaints about your company knownLeslie.” Despite maintenance requests continually coming to us from e-mail, we have always been responsive and professional The recent request regarding the toilet and her daughter falling prompted us to look through her past maintenance requestsAfter review of all work orders submitted, no request was found for repair to toilet due to “toilet coming up from the floor” and “water coming from the toilet to the basement.” The only request that was submitted that had any relation to the toilet was created by an employee on 11/03/referencing an e-mail from the tenant that stated, “toilet is taking an extremely long time for the water to fill up in the tank.” This request was repaired and completed on 11/07/Please review all of our supporting documentation in regards to this requestTo resolve the current issue brought to our attention by the tenant for the work order #*** created on 1/08/2017…we sent out a maintenance technician on 1/09/and repaired the issues brought forth in the maintenance request, work order is attached in the supporting documents

I think the reason I am having a problem getting my security deposit back is because *** broke my lease agreementAlthough Ultimate Realty took over the house after I moved in, they still need to stick to my original lease agreementMy lease agreement clearly states that "Lessor shall give lessee reasonable notice in writing at his last known address or in person of the date and time lessor will inspect the dwelling unit following the termination of the lease, to determine the amount of the security deposit, if any, to be withheldLessee shall have the right to be present at the inspection of the dwelling unit at the date and time scheduled by Lessor." However, as I explained in my original complaint, *** did a final walk through with my husband on 6/29, and then did another walk through with the owner in mid JulyWe did not have a chance to discuss with the owner directly, which caused all the following problemsSo I request that Ultimate Realty pay me the rest of my security deposit ($295) if I can’t get it back from the ownerI am not satisfied with Ultimate Realty because even now *** insists that they only need to “do walk thru send pictures to owner”This clearly indicates that he is completely ignoring my lease agreementI have had further discussion with *** and the owner on this issue last weekThe owner agreed to send me a check of $for found ice maker tray and stove cleaning fee, and *** agreed to send me a $check for the garage door repair fee that he charge the owner in March (because the owner refused to pay that $95)However, until now I haven’t received either of these checks yetI hope I can receive them soon because days have passed since the termination of my lease (I am expected to receive the security deposit within days after lease termination, based on my lease agreement).Again, I really appreciate your help on this

Around December 10, 2014 owner requested we put up a hand rail per insurance and paint basement floor with paint already supplied, had to purchase more paint and apply another coat. Home was also cleaned, bathroom vacuum, clean refrigerator, and to repair wall oven that needed a new board in order to repair per owner request because she had no one to do cheap. Cost $804 which owner paid with credit card.
On 1/22/15 we found a tenant for home and received deposit of $1395 and first month rent of $895 and prorated rent of $234.32 for February.
A City of St. John inspection was done and a laundry list of repairs were required to obtain occupancy and we rushed to help get tenant in as this was a tenant that they were currently living in a hotel because of a fire to their home.

We never ran the application and will be refunding the application fee since we did not run. This takes around 10 days to be credited back to your account.The application did not show any of our agents showed  the property and no other agent called saying they showed the property to this...

client.  Therefore we did not follow up.  People sometimes fill out the application but have not seen the property so we do not run until they actually view the property to make sure it is a home they want to rent.When the application did come in we had already had other applications in that we approved, therefore we do not run other applications and pick the best app.  We run based on first come first serve.If she called several times during several weeks, a voice message was never left with [redacted], [redacted], [redacted], or [redacted].  If one had been left we definitely would have called  back and gave  a status on the application.
