leased oil hot water tanks from blue wave energy, after 6 1/2 years on a 7 year term they want to terminate my lease which we pay $24 a month for and have never missed a payment, but our tenants are not purchasing the oil from there company. In terminating the lease they want to charge us $421 residual value on 6 1/2 year old oil tank that costs $900 originally. fair market value appears to be approx. $200 online quotes for similiar product. In addition to terminating our lease which we pay $24 dollars a month for they want to charge us $120 termination fee and also $140 removal fee for the tank. If we are buying out the value of the tank why are they able to charge a removal fee of $140 and they are heavy handedly terminating our lease which we have never missed a payment on and trying to charge $120 to do so. It is strong armed tactics with excessive fees. we have paid Blue wave $1872 already in lease costs, $280 installation costs to date and now they want another $783 to terminate our lease on their demands.

Thank you for sending this to me.
Firstly, the customer was in violation of their lease agreement. The last time their tenants purchased fuel from Bluewave Energy was in June 2017. We did not contact the customer for nearly a year although their contract clearly states that they are required to purchase heating fuel from Bluewave if they are renting their hot water heater from us.
Secondly, we made multiple attempts to contact the customer starting on May 30, 2018. Here is a summary of our contact attempts:
• May 30, 2018 – Mailed Memo
• June 20 – Left voicemail message to call me to discuss
• July 24 – Left voicemail message to call me to discuss
• Aug 9 – Emailed follow-up
• Aug 16 – she answered my call and said she was too busy to talk and would call me the next day
• Aug 17 – emailed another follow-up
• Aug 30 - Left voicemail - advised I did not request RWH Buyout as per Aug 17th email - however, can proceed with it in Sept and amount would not be due until end Oct. Need her to contact me.
• Sep 21 – Left voicemail - advised I will proceed with RWH Buyout by Sept 25th cutoff date for $498.30 plus tax
• Oct 10 – Customer called me and left message – saying she only wants to Rent the Hot Water Heater and cannot make Tenants buy. Also wants copy of her Contract. I called her back and advised the Unit had been billed out with no reply over the Months on how to proceed. She was extremely irate saying she had a busy Summer was not around alot, got married. She also said she spoke with the Revdex.com and we are not allowed to do that and then she hung up on me.
• Oct 10 – Emailed copy of Contract per Customer request
• Oct 16 – Left voicemail to advise I did not hear back from Oct 10 Email and copy Contract she requested. Indicated we are trying to come up with a suitable resolution in regards to a Goodwill Credit or Removing the HWH. Asked her to reply to email or call me on direct line to discuss as the Unit is Billed and amount on Account.
• Oct 17 – Customer replied to my email

We have detailed correspondence relating to this matter. I do not believe our tactics were heavy handed, as the customer notes. I believe we allowed a condition to persist for an extended period of time in which the customer was in violation of their contractual obligations. The tone of our correspondence was conciliatory and we acted in good faith to attempt to find an agreeable solution.

As of October 17, 2018 we offered the customer a goodwill credit and waiver of the removal fee. The amount due would have been $423. We received a response on October 19 indicating that they would be in contact ***. They also asserted on October 17 that we were in violation of the consumer property act. I do not believe we are in violation of any applicable laws, but we referred the matter to our *** on October 22.
