Initial Business Response / [redacted] (1000, 10, 2016/08/26) */ In August of Mr [redacted] requested a quote to restore and rebuild a Triumph Chopper at which time I quoted him a price of $to tear down, (disassemble and diagnose any problems), and also all sandblasting of any parts that needed to be cleanedAt this same time using a rough guess without actually tearing the bike apart I suggested he was looking at around $5000.00+ worth of work to complete the bike using all the original bike parts Underw000d Motorsports then completed a work order authorizing Underwood Motorsports to complete the workUnderwood Motorsports has a signed contract to completely overhaul and complete a frame up restoration and rebuild, signed by Ty [redacted] on 1-As stated this was not a verbal contract At the start of the project Mr [redacted] stated he did not have all the money to complete the job and could make installmentsWe agreed, as a complete restoration job may take years to complete, he was in no hurry, just so the bike looked like new when it was done Underwood Motorsports tore the bike completely apart, diagnosed all problems, sandblasted all parts, and ordered all necessary engine parts paid for with the original $and then the 2' payment of $at which time Mr [redacted] was told that the bike would be unsafe with the front end that was on the bikeThe fork triple tree and fork neck had to be replaced as the tree had been cut and welded causing it to be unsafe The frame and neck was bent a littleMr [redacted] said he understood and gave approval to put a new front end on the bike to make it safeThe front wheel was also bent and had to be replaced A new front end was ordered and we cut the frame apart and fabricated all new parts to facilitate welding the frame together correctlyWe then installed new front wheel and a new Springer front forks and all related parts Underwood Motorsports then completely rebuilt the engine using old and all new parts needed restoring the motor to like new condition As time went on the amount of work was exceeding the amount paid by Mr [redacted] Underwood Motorsports, I, Scott Underwood called Mr [redacted] 's home to request that we get togetherMr [redacted] 's then wife told me he should not be putting their money into this bike, but that she would have him call meTime went on and I didn't hear from him for a whileFinally he called me and he came and made a third payment of $at which time I ordered some of the remaining parts to complete the jobI also checked on the chroming he wanted redone SUnderwood Motorsports is a part time venture that I run when I am not working in my trade as an operating engineerAs such I am not on anyone's schedule, and I complete the work honestly and safely on my time constraints Time went on, I was working to feed my family and Mr [redacted] understood thisHe stated that there was never a rushWhen not working my regular job I would work to finish the bikeBy this time I paid to have some of the chrome parts redoneI had the seat recovered and was again in contact with Mr [redacted] to tell him if he wanted all the chrome parts he wanted redone the cost would be $3,Where is the money he claims he paid for rechroming? The money he paid had already been spent on other partsDuring this visit Mr [redacted] really balked at spending anymore money on the projectHe stated that he already gave me cashTo this I stated to him that I would have given him a receiptI do not have a copy of said receiptIf he could produce the receipt I would have gladly given him the benefit of the doubtMr [redacted] stated I said it was better for him to pay cash due to tax reasonsThis is ridiculous as I always give a receipt for any and all payments made to meI strive to be fair and honest with all of my customersIn my + years of doing this work I have never had any complaints about my work or my reputation until nowIt has taken a long time to complete this project and I do not recollect any cash payments from Mr [redacted] The real reason the job is not completed is because the work that has been done is exceeding the amount that has been paidHe was informed of this on his last visit at which time I told him to produce his receipts so we could work it all outI have not heard from him since that time Enter the BULLDOG NEW WIFE in this projectAfter demanding and arrogant phone calls from her, Mr [redacted] refuses to contact me himselfOn January 11, I started a six day sometimes seven day twelve hours a day job working nd shift in my regular jobOn 1- 27-she was told that as soon as I could I would finish the bikeShe called again on 5- 25-while I was still working hours a day, six days a weekShe was again told that I was working my regular job and would not be working on the bike until I got laid offShe demanded they come to look at the bike's progress at which time there had been no further work done on the bike since Mr [redacted] 's last visit [redacted] , a friend of Mr [redacted] , showed up wanting to remove the bike and parts from my shop without contact from Mr [redacted] or his BULLDOG wife [redacted] and the new Mrs [redacted] have no business in my dealings with Mr [redacted] Refusing to let him take the property I said to have Mr [redacted] call meI have received no response until I started receiving complaints from you Mr [redacted] is not a man of his word as he has agreed to have this work done and now does not wish to pay the fair priceI did not repeatedly state that the bike would be done in two weeksAlso I have many reservations about their honesty as I resent the fact that they state that the bike and/or bike parts have been sold offWe at Underwoods do not do business like thatWe are washing our hands of this project because of this dishonesty, noncommunication, non-payment bullstAnyone who thinks they should pay a set amount of $worth of work after making all the changes he wanted is living in a fantasy world He said yes and knew it would cost more Resolution: First, his wife does not know what she is talking about as there was never an original contract stating the final cost would be $The $figure was a rough guess on the amount to fix the bike with only the original parts and not new purchased parts that had to be replacedThe first payment of $was for teardown and sandblastingThe second payment of $and the third payment of $all went toward the projectMrand the new Mrs [redacted] state that there is no signed contract when I have a signed work order with his signature on itUnder the same transaction information total cost is $which is not trueThe amount paid to date is $In the complaint Mrand Mrs [redacted] state they paid $in checks and $in cash which is $So which is it? Their facts don't add upThe total cost of the project to this date is $12,in labor, parts, and taxes Given the first $was only teardown and sandblastingThat leaves the $I can say he did pay me for the billI can say that he did pay me towards that bill of $12,That amount minus the $= $ I cannot honestly say he did or did not pay the $in question only that I informed him that I have no receipt of thisI would not have taken any payment, cash, or otherwise, without giving him a receiptA receipt he says he has but has not yet produced it As anyone can see we performed the work to get the bike this far along on our dime and have not been paidEven with the so called $payment he still owes me $to dateThe only reimbursing that needs to be done is by Mr [redacted] by paying the bill that is owedUntil he produces as receipt for the $he owes me $In the 40+ years I have been in this business I have seen customers that don't or won't pay their bill or wish to fight to get things their wayI really did not see this coming from Mr [redacted] In the beginning he wanted all new chrome, handlebars, grips, tires, paint, wiring a completely restored bike in like new conditionIn this process he has been informed all along on time, costs, etche said yes every timeThere was never a time limit until the new wife stuck her nose in and demanded things happen immediatelyI will not be intimidated with threatsThe only solution I see now is to wash my hands of this messThe only way I see out is Mr [redacted] paying the remaining bill and removing his so called sold off bike parts from my shopI cannot and will not put any more work or my money into this projectAfter consultation with my attorneys we will settle for exactly on half of the $on the condition that he produces the receipt for the $cash payment that he states he hasThat would mean Mr [redacted] 's total bill would be $If there is no receipt produced there will be no deal and we will have to settle this matter in courtIf we have to go to court on this matter I will pursue all court and legal fees be included in the final cost of this

1. In August of 2009 Mr. [redacted] requested a quote to restore and rebuild a 1967 Triumph
Chopper at which time I quoted him a price of $1500.00 to tear down, (disassemble and
diagnose any problems), and also all sandblasting of any parts...

that needed to be cleaned. At
this same time using a rough guess without actually tearing the bike apart I suggested he
was looking at around $5000.00+ worth of work to complete the bike using all the original
bike parts.
2. Underw000d Motorsports then completed a work order authorizing Underwood
Motorsports to complete the work. Underwood Motorsports has a signed contract to
completely overhaul and complete a frame up restoration and rebuild, signed by Ty
[redacted] on 1-12 10. As stated this was not a verbal contract.
3. At the start of the project Mr. [redacted] stated he did not have all the money to complete
the job and could make installments. We agreed, as a complete restoration job may take
years to complete, he was in no hurry, just so the bike looked like new when it was done.
4. Underwood Motorsports tore the bike completely apart, diagnosed all problems,
sandblasted all parts, and ordered all necessary engine parts paid for with the original
$1500.00 and then the 2' payment of $2500.00 at which time Mr. [redacted] was told that
the bike would be unsafe with the front end that was on the bike. The fork triple tree and
fork neck had to be replaced as the tree had been cut and welded causing it to be unsafe.

7. As time went on the amount of work was exceeding the amount paid by Mr. [redacted].
Underwood Motorsports, I, Scott Underwood called Mr. [redacted]'s home to request that
we get together. Mr. [redacted]'s then wife told me he should not be putting their money
into this bike, but that she would have him call me. Time went on and I didn't hear from him
for a while. Finally he called me and he came and made a third payment of $2500.00 at
which time I ordered some of the remaining parts to complete the job. I also checked on the
chroming he wanted redone.
S. Underwood Motorsports is a part time venture that I run when I am not working in my trade
as an operating engineer. As such I am not on anyone's schedule, and I complete the work
honestly and safely on my time constraints.
9. Time went on, I was working to feed my family and Mr. [redacted] understood this. He
stated that there was never a rush. When not working my regular job I would work to finish
the bike. By this time I paid to have some of the chrome parts redone. I had the seat
recovered and was again in contact with Mr. [redacted] to tell him if he wanted all the
chrome parts he wanted redone the cost would be $3,134.00. Where is the money he claims
he paid for rechroming? The money he paid had already been spent on other parts. During
this visit Mr. [redacted] really balked at spending anymore money on the project. He stated
that he already gave me cash. To this I stated to him that I would have given him a receipt. I
do not have a copy of said receipt. If he could produce the receipt I would have gladly given

work done on the bike since Mr. [redacted]'s last visit.
11. [redacted], a friend of Mr. [redacted], showed up wanting to remove the bike and parts
from my shop without contact from Mr. [redacted] or his BULLDOG wife. [redacted] and
the new Mrs. [redacted] have no business in my dealings with Mr. [redacted]. Refusing to
let him take the property I said to have Mr. [redacted] call me. I have received no response
until I started receiving complaints from you.
12. Mr. [redacted] is not a man of his word as he has agreed to have this work done and now
does not wish to pay the fair price. I did not repeatedly state that the bike would be done in

they paid $6500.00 in checks and $2500.00 in cash which is $9000.00. So which is it? Their facts
don't add up. The total cost of the project to this date is $12,601.25 in labor, parts, and taxes.
Given the first $1500.00 was only teardown and sandblasting. That leaves the $5000.00 I can say
he did pay me for the bill. I can say that he did pay me towards that bill of $12,601.25. That
amount minus the $5000.00 = $7601.25.
I cannot honestly say he did or did not pay the $2500.00 in question only that I informed him
that I have no receipt of this. I would not have taken any payment, cash, or otherwise, without
giving him a receipt. A receipt he says he has but has not yet produced it.
As anyone can see we performed the work to get the bike this far along on our dime and have
not been paid. Even with the so called $2500.00 payment he still owes me $5101.25 to date. The
only reimbursing that needs to be done is by Mr. [redacted] by paying the bill that is owed. Until
he produces as receipt for the $2500.00 he owes me $7601.25. In the 40+ years I have been in
this business I have seen customers that don't or won't pay their bill or wish to fight to get
things their way. I really did not see this coming from Mr. [redacted].

be $2550.62. If there is no receipt produced there will be no deal and we will have to settle this
matter in court. If we have to go to court on this matter I will pursue all court and legal fees be
included in the final cost of this.
