Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Note that Cutting Edge Homes said nothing in their response about the delayed delivery and the resulting costs that I absorbed CEH continued to promise delivery from month to month, so that I had no option but to delay starting another project This meant that I had to pay my two employees while I waited, cover workers comp, as well as the cost of property taxes and interest on the construction loan (for money I had sent to Cutting Edge Homes) The company says on their website that "the modular building process helps finish the project quickly to minimize the time you spend and the stress and uncertainty about your projects." CEH did not deliver on their commitment to deliver a home in September, and instead lead me on until the delivery in Feb, 2017, causing great stress and loss of productivity The total loses for this delay are over $100,000, but I have requested a much smaller amount that does not include the costs associated with my employees, but only the costs related to the property and project CEH needs to reimburse me for the costs of this delay Regards, [redacted]

Mr***'s response is very consistent with the type of communication and interaction I've had with him all along. He has minimized my issues, often using a condescending tone. He talks over me, uses manipulation and promises, and frequently threatens me. My sister and I recently started our real estate business and this modular home was our first new build. We contracted with Cutting Edge Homes in good faith based on the information that was provided both via the website, as well as emails, and verbal conversations with the company's manager. The company was aware of the importance of our fall timing and provided assurances that the home would be delivered before the winter rains. The email received on Aug 5th stating "Delivery date: The home is expected to be delivered in the 2nd half of September" could not be much clearer.A big part of me just wants to move on, but I feel that being a woman in the world of real estate and construction has always required that we put up with mansplaining and bullying, And in this current environment of women standing up to the men who diminish us, I want to be strong. I am not proud to say that this man has made me cry on a number of occasions. But now he calls me a thief, when I paid this company almost $400,for a house that they delivered late, damaged and defective. Now I am just angry. The factory that was contracted by Cutting Edge Homes to produce the modulars took responsibility for the damage and defects, but Mr*** has refused to take any responsibility for anything at allHe even tried to abdicate his role completely by manipulating me into an "Assignment of Rights" agreement.I have retained a lawyer to advise me and he points out that Cutting Edge Homes, as the seller, is responsible for all damages caused by the delay; it was foreseeable that I would incur collateral expenses and these expenses can be attributed to the breach. As outlined in the contract I wish to enter into mediation administered by the Revdex.com and if a settlement cannot be reached, I plan to move forward with arbitration.

Our position is the same, and we will further elaborate on Ms***'s claims here. Her demands fall into two categories - 75% +/- is explicitly in violation of our mutual agreement, and 25% +/- is an attempt to force us as a supplier to take on her risk as a developer despite never giving us a chance to know about that risk at the time we signed the contract.Ms*** is a developer who is trying and has tried throughout her project to force suppliers and subcontractors to pay for expenses that she and her partner at *** LLC should have bornCutting Edge Homes did not guarantee a specific time of delivery and we can not control and are not obligated to pay for her subjective stress levelThe simple fact is that we had the large, complex home she ordered was delivered as quickly as possible, and much more quickly than any other dealer of modular homes would have had it deliveredCutting Edge Homes did not guarantee Ms*** a delivery date for the home, and is not obligated to pay for any of her costsWe updated her with the best available information from the 3rd party factory CMH that is our supplierWe kept her informed of the preliminary schedule that we communicated with her because she demanded a guess of the schedule before we had a confirmed delivery scheduleMs*** had the option to terminate or even file for a recission of the contract, but she never did soShe can not renegotiate the contract now. If Ms*** wanted to make us pay for her damages based on her desires, she should have asked for penalties to be in the contractThe contract includes no guarantees of the delivery date, and zero penalties for delivery on any particular date. At the very least, we would need to have the opportunity to opt out of the contract based on penalties that she wanted to earn if delivery did not meet her requirementsNo such request was made by Ms***. Ms***'s Revdex.com claim and response that 75%+/- of what she is asking for is to pay for a failed attempt to crane and set her homeIt was an attempt to steal the modular home that Cutting Edge Homes owned at that time that was sitting not fully paid in a parking lot near her construction site because she demanded the home be sent to herShe attempted to steal the home and install it on her foundation in breach of our contract prior to paying for the home in full, which would have been felony theftShe unwisely scheduled the theft of the home Cutting Edge Homes owned on a day when the soils of her site were not suitable for placing a craneThe simple hiring of a licensed California soils engineer to run a test would have told her that the soil was not suitable, but she chose not to take this steps and unilaterally went forward with the set day (and attempted theft) anyway. She did not ask for permission from Cutting Edge Homes and we did not encourage her to steal the home and set it on her foundation in breach of contractShe hired a crane and set subcontractor for this failed attempt, and is per contract 100% responsible for all on-site costs which clearly includes her mistakes and attempted criminal behaviorOn-site costs, project management, scheduling, and the hiring of site-subcontractors and all other site costs are hers and *** LLC's costs to pay.Ms*** can libel us anywhere on the internet that she desires for now, and complain any consumer organization that she wantsIt will not change the fact that we do not owe her anythingShe is grasping for straws that are not thereCutting Edge Homes owed her a house, and we delivered it as soon as it was completed and able to shipMs*** and her partners at *** LLC would be wise to move on without further issues.We strongly reject her requestIf she does move forward with mediation and arbitration, Cutting Edge Homes will file a counter-claim against her for substantial damages, fraud and misrepresentation of service expenses, and libel against our company. If required, we will vigorously defend our company against any of these claims to the 3rd party arbitrator, and believe that Ms***'s case is an unreasonable claim

We are not responsible for the damages that Ms*** seeks reimbursement forWe offered her a courtesy credit because she was upset of over $4,that we did not owe her, but she refused to accept it.The expenses that she is seeking to have us pay for are expenses that she incurred as part of
her developer risk in building a homeCutting Edge Homes acted at all times in good faith to fulfill the terms of our agreement, and we delivered the home as promised, and ensured that all service and warranty items were completedNow she persists in asking us to pay for her expenses and risks as a residential developer, and we fully reject that Cutting Edge Homes has any liability to pay for her expenses
