Union State Bank received your complaint dated September 28,2015, regarding a stop payment placed on a check written by Redracer Express LLC/Troy [redacted] I apologize for the inconvenience the stop payment on this check has caused you The check in question is dated August 28,2015, in the amount of $4,In conversations with Mr [redacted] , he stated that from that time until the date of deposit, calls were made to Union State Bank to inquire if there were enough funds available to cash the checkIn your statement, you stated that on September 4,2015, Union State Bank stated there were sufficient funds to cover the check in questionAccording to our records, that is accurateIt is important to note that the back of the item in question does not have any deposit date noted, so Union State Bank cannot be sure this item was actually deposited on September 4,as statedThe itemwas not returned to Union State Bank for payment until September 9, From the time the call was placed on September 4, 2015, until the check was returned to Union State Bank on September 9, 2015, for payment, Mr [redacted] placed a stop payment order on the checkWhile this is unfortunate, according to banking regulations, Mr [redacted] had every right to place a stop payment order on this checkBecause of this, Union State Bank is not responsible for any issues you have with your account at your institutionAs MrSchmidt and I had discussed in mid-September, the issues with Mr [redacted] appear to run deeper than this stop payment order on this particular check, and from my understanding, MrSchmidt has retained legal counsel to take formal action against Mr [redacted] Please know that if information is required from Union State Bank, a subpoena is required as Federal regulations limit the information Union State Bank can provide or shareAgain, I apologize for the inconvenience the stop payment order has caused in regards to your account, however Union State Bank followed all applicable banking regulations in regards to placing the stop payment and returning the check to your institutionIf you have any further questions, please feel free to contact me at [redacted]

Check referenced in the statement does not cover holds, but rather electronic check conversions. Regulation CC covers funds availability on checking accounts. Since the deposit was to a savings account, Regulation CC has no bearing on the deposit.
Ms*** is correct that a hold was placed on the savings deposit. Union State Bank places a five (5) day hold on all check deposits to savings accounts due to past fraud and loss history. Savings accounts are not covered by Regulation CC (Funds availability). Regulation CC covers checking account deposits and Ms***’s deposit to her checking account was made available immediately after deposit. By regulation, only $had to be made available the next business day after the deposit. Union State Bank rarely imposes this requirement and did NOT impose the $next day availability
Steven mention in the statement is a commercial lender and would typically not handle checking or savings deposit issues. This call should have been transferred to someone more knowledgeable regarding deposits.

My view on this matter is Union State Banks client had a right to put a stop payment on this check before it was cashed, as I stated I cashed the check on September 4th after I talked to Union States teller on Sept 4th, it was around 3:in the afternoon, she states the funds are available, and yes of course I have proof that's when it was cashed seeing I have my receipt, and my bank statement from Bayshore Credit UnionOnce that check in the amount of $was cashed Mr*** had no right to cancel that check, and I still believe that the bank is at fault for letting him do it, again seeing that Mr*** didn't have the funds in many times, and Union State Banks tellers stated, just keep checking back, so the bank was well aware of the client they were dealing with. I believe legally once that check was cashed Mr*** could not put a stop payment on that checkMy resolution remains the same I would like Union State Bank to hold their irresponsible client responsible for these funds, and Union State Bank put the funds back in my account seeing the check was check was cashed on the Sept 4th, and Mr*** put a stop payment on that check after that dateI feel it is the banks responsibility to have talked to their client seeing they have had this problem before with him, referring to writing out checks without the funds being available, that is why I always called first before cashing any of Mr***s checks.I st
