As we have said before If she comes with full coverage insurance we will provide her a loaner until the vehicle is fixedIt is at the shop at the moment She will also have to catch up on the amount that is past due on her account We will not be charging her for any repairs , even though the purchase was " AS IS" and she can have her car back. We can not give her a loaner without full coverage insurance It's state law she must have insuranceAccount must be up to date. Thank you *** ***

Ms*** came in on April 27th and purchased a Mercury Sable Theday she purchased it we had to jump the car so we purchased her a brand newbattery. She purchased the vehicle as is but we were willing to help herwhen she brought the car back three months after she
purchased the car statingthat car air conditioning was not working , the car was misfiring and shehad to jump it even after the replacement battery was put in. We told herto leave the car on July 27th and let us fix the car sinceshe wasn't paying for any of the repairs even after purchasing as is and forher just to catch up on her paymentsOn August 16th , three weeksafter calling her several times to pick up her car since it had been readysince the 29th off July, Ms *** came to make a payment of $and pickup her vehicle After making the payment we went to start the car andunfortunately after sitting for a weeks the problem was back . Wehad to again jump the car we offered her to leave it here again so we can havethe mechanic check out this issue againWe did fix the misfire and theair conditionerWe offered her a loaner car but she did not have insurancewhen we called to verify the insurance on the sable even She got upset anderratic she wanted all the money backWe explained to her that her downpayment was a total of $1,and that was all she paidSince she only put down and deferred and had not madeany actual payments to the car since April except that day when she made thepayment of $ She started saying"Give me back the $I don't want the car just give me the $back.I don't want the car". We weretrying to work with her but she refused we gave her back the $she hadpaid that day even though we shouldn't have because she was past due at thetime $I have attached her payment history her receipts contract and hersignature on the as is part of her contract

I am rejecting this response because: a) the things are not true, *** who is owner told me the car was a great car and that I could leave it running for hours and it would never over heatand I never came times I only test drove once and I did not drive it after it started to over heatI pulled over right away and a mechanic told me that it looked like hoses vere sabotaged before I got in it and drove away, like as if the car lot done it on purpose to get the car back and get more money out of me and now I am at a loss of $for my down payment, now really why would I hurt my only transportain that I needed so badlyAnd at first I was goinf to pay the extra he wanted but then everyone that was with me qhen it happened said that no way should I do that because it had only been lesa then 24hours bedore this happened snd I did nothing but drive about miles on itAs well as a family emergency came up and I had to fky to florida for my mom n dad and no longer had the $So now I have to take him to court because im not going to throw away $on a lemon and I even offered for him to just put me in another car but he eanted me to pay for this car and it was in the shop daysSo its either we go to court or he pays me my money back or I would be willng to pay a payment and allow him to charge me $on to the loan to pay out in paymentsThats my only offer. Regarding to Mrs *** *** before she buy this car Lexus she come to our location different time to ck this car and test drove it every time and she diced to buy it was no sales men involve to recommend or bush any sales and she came with Humberto *** every time and this
her man the one he ck the car for her Mrs *** she know all our used cars sold as is no warranty given or promise and she singed the form requier by state of texas .MRS *** whiel she drove the car the hudrolic hose for the cooling fan busted and it cuz leak and fan it did stop working and of curse timpruter wase raise she should stop drivin the car and towed to repair shop but that did not happin she keept drive the car and engin wase over heated .when she calld us we pay for towing and we find this proplum like I explain to you befor .so I calld MRS *** and I told her the situation and the car need to go to mechanice have A machine shop to fix it and that will cost A bout $and we willing to help her with half of this and she agree so we tow the car agin to the shop they willing to fix it .and B cuz engine wase so muche damadge it take almost days .I called MRS *** we tolde her the car is ready but she never come by to pay and pickup the caralso I will fax you all doucuments .and if she is willing to pay halfe this repair bill $ and first payment we willing to let her have the car back and start making payment

I am rejecting this response because: The statements he has made are false, to an extent, bottom line is the car just didnt work...I understand that "AS IS"means exactly that. I truly believed by him changing the battery at the initial sale it would fully function from there on. Misfiring as he wants to state has nothing to do with the car being completely dead is sounds good but it can't misfire if its DEAD!!!!He never once offered a loaner it was me that asked on one of the several times I stopped in to see what was gonna be done so I wouldn't have to be jumping it every time I started it..I was told by him he doesn't do that and if he did I would have to take out insurance for the loaner.and yes I didnt have insurance on the Sable when I went to pickup the vehicle it had been there for for almost 3weeks. I wasnt gonna continue paying if I wasnt driving the car..Once it was fixed then I would have no problem to put insurance back on the car.Regardlss that has nothing to do with my complaint..I was told by him to bring 650.00 if I was going to pickup the car. at that moment he was the one that mentioned that I hadnt made my 300.00 towards the down. but for some odd reason after I asked for all my payments back. the first payment mysteriously got put towards the down according the the printout of my account he provided. after waiting 30 im assuming he moved the numbers around to make it look like I had never made the first payment of 318.00 thats why it states 300 towards down and 18 towards payment.?? why would I come in with 318.00 if it wasnt for my payment..but I guess paying me back all my payments of 954.00 for 3 months didnt sit to well with him. even after I told him to stay with my down. By him or whom ever moved the numbers made it to his advantage. staying with the 800.00 im assuming wasnt enough for him.He never called  me to let me know of the car being ready im the one that called. He stated that the car sat for 3 weeks...When I went for the car his excuse for the car not starting was that it had been sitting for 8 days..so which is it 3 weeks or 8 days???Regardless he has 800.00 +318.00=1,118.00 and I have no car!!!!! How can he continue to do business its not right nor is it fair..I NEED A VEHICLE THAT TURNS ON AND WORKS!!!!OR MY 1.118.00.. Its simple I want a car or my money.

I am rejecting this response because: I appreciate the offer which should've been offered to me from day one. But I was told by him that he doesn't give out loaners.and getting full coverage insurance would not be a problem for me. Which I do know that it is the law. My problem that I seem to not understand is why does he keeps  trying to give me that particular car? I DO NOT want to have any ties with that business anymore...Another question I do have is why is the car in the shop at this moment? If it had been repaired like I was told it had been. Obviously it's still not in working order. so that only tell me he was trying to give me a vehicle that wasn't totally in working order..I'm sure they is another vehicle within the same price range that can be substituted for. I would like to move on with my downpayment of 800.00 + 318.00 =1118.00 and go elsewhere to purchase a vehicle..his offer of giving me back the vehicle would be next to impossible if he expects me to catch up on payments that is 4 months worth. I refuse to continue any business with this company I need my 1118.00 back!!!!!!!!! It doesn't make sense that he keeps my money when he has the vehicle in possession. I would kindly appreciate the return of all my money.....shouldn't this be against the law to keep the money while the vehicle is in his possession??I will look into it just in case it is a law......
