My name is [redacted] and I am the General Manager of United Cars and Credit.

United Cars and Credit prides itself on providing quality vehicles to its customers by performing a multi-point inspection upon acquiring each piece of inventory and making all necessary repairs.

Ms. [redacted] and her mother met with our Service Manager, [redacted], on April 24, 2014 to go over her concerns with the suggested repairs by [redacted]. Mr. [redacted] called [redacted], the manager at [redacted] and he declined Mr. [redacted]’s request to go over the work order and was unable to justify the estimated repairs.  Upon [redacted]’s refusal, Mr. [redacted] put the vehicle on a lift and went over each aspect of the [redacted] work order with Ms. [redacted] and her mother. After inspecting the vehicle with the customer present, Mr. [redacted] determined the concerns listed on the [redacted] work order were meritless.  He did find a small rattle in the passenger wheel area that only required him to make a simple adjustment.  Ms. [redacted] signed the repair order (see attached). She and her mother were grateful for Mr. [redacted]’s help and thoroughness.

We understand that customers can become frustrated when vehicles don’t behave like they think they should or when they are given misinformation from another service department.  We are grateful that Ms. [redacted] gave us another chance to prove our quality service work and we greatly appreciate her business.  Upon the outcome of yesterday’s appointment, we ask that this matter be closed.

My name is [redacted] and I am the General Manager of United Cars and Credit.  Ms. [redacted] purchased a 2000 Infiniti I30 from United Cars and Credit on June 29, 2013 and did not disclose that she was filing Bankruptcy prior to purchasing the vehicle on June 29, 2013.  It is against...

United Cars and Credits policy to sell a vehicle to a customer if the customer discloses the intent to file Bankruptcy.  [redacted], Inc. is a related finance company and the vehicle was financed through [redacted], Inc. on June 29, 2013.  Any complaints that Ms. [redacted] may have in regards to billing or collection issues need to be directed to [redacted], Inc.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I was told by the machinist, [redacted], he took the car up on the lift and told tried to show me every part that the [redacted] had told me was wrong, he told me everything was perfectly fine with nothing to worry about. Now I looked up places that were approved by the Revdex.com and [redacted] is one of them, I took it in because the bottoming out on my car has gotten worse and the back left tire is going flat every other day. The [redacted] guys recommend all of the parts on the shocks getting replaced. I'll give these guys one more chance to replace every part before I get my money back and return the car.

On 5/20/2014 United Cars and Credit replaced all four of the

struts (shocks) on this car. Ms. [redacted] signed RO # [redacted] stating the repairs are

done to her satisfaction, the car drives great and no further repairs are

needed.

Review: The 1999 toyota camry was sold to me with various issues, when I took the car back to the place to have it checked out I was told it was fine, and the noises I was hearing were normal, that was 5 days after the purchase, now the noises became horrible and I took it in to get a second opinion, I have paperwork stating the car is worth 3 times less than what the have me paying for it (from [redacted], if the car were in good condition) and a bill from the [redacted] saying that the car needs almost $3,000 worth of work done to it. I want my $500 down payment back and the first payment I made to the company for $168 back as well. This unsafe car was sold to me in the first place and then I was lied to about the condition it was in.Desired Settlement: Refund cash for $668 and provide document to get me completely out of the contract so I may return the car and not have any other issues with the financing company on any future date.

Review: I went to United Cars and Credit to purchase a car. I told them I was filing bankruptcy. I had a car with a 30% interest rate with 7 1/2 year loan. I did a voluntary repossession. I was told by my attorney that if I could find a better interest rate for a vehicle, I could reaffirm that loan. I explained that to the Salesman and the Sales Manager. The company advertised they give credit to bad credit no credit and bankruptcies. $499.00 down is all you need. They made some calls and told me that due to my circumstances they could sell me a car for 19.9 % interest. It was a 2000 I30 Infiniti Sedan. VIN # [redacted]. They did a credit application and saw that I make almost $4000.00 per month. This was on June 29th, 2013. It was installed with a device that would cause the car not to start in the event of a past due payment. They told me they could finance me with $2000.00 down payment. 83 payments of $187.00 last payment $147.56 biweekly. Beginning 8/1/2013 and ending on 1/16/2017. The Finance Charge was $4546.52 The amount of Credit was $11142.00. The total payments would be $15668.56. The vehicle 13 years old with the Down Payment of $2000.00 would total $17668.56. The cost of a new car, the sales tax was $956.04. I paid the car on time until the date of 9/17/2013. I called in and spoke with [redacted] on 9/16/2013 on the due date. The payments were set on auto draft with my debit card. My debit card had been replaced. I called to let them know I would need to call them back with the new card to update the account. I spoke with [redacted]. She said that would be fine. It was ok to call back on Friday. I told her as a courtesy that I would soon be filing my bankruptcy. I would be reaffirming the loan. She said oh you are going to file bankruptcy. I said yes, that was disclosed to the car dealer when getting the loan. It was the reason I had to pay $2000.00 instead of the $499.00. She said ok. I was told it was alright to call back on Friday with the payment and new card number.They normally didn’t take the funds out of my account for several days after the due date. I could have not called to inform them and let them contact me. I was being diligent and calling to inform them of the change in my card, as well as my giving them up to date information on the status of my Bankruptcy.

The next day not even 12 hours after the due date the tow truck came and they repossessed the car. I had just gotten back to work after being on disability for a month or so.

I had paid a total of 3 payments totaling $602.77 plus the $2000.00. So, I had the car from July 1st, 2013 until September 13, 2013. So, in actuality I rented their vehicle for $2602.77 and paid taxes etcetera for less than 3 months.

I then received a Notice of Disposition of Collateral. It gave me the option of getting my car back for a total of $11243.73 or they would sell it in a quote “commercially reasonable manner, which may include either public or private sale. It is agreed that 10 days’ notice of any such sale shall be reasonable.”

I then obtained information that the Sale was a selling price of $3000.00 and a selling fee of $150.00, a recon fee of $85.00. I believe that must have been billed to me. The check was written for $2965.00 and the Buyer was in fact United Cars and Credit.

I was then served with Court Papers from [redacted] on January 2nd, 2014. I was being sued for the balance of the loan minus the sales proceeds of $2965.00 which is now $8319.70 at an interest rate of 19.99%.

I stopped paying on the car because the car was repossessed and I no longer had the vehicle. The Lender violated their contract on repossessing the vehicle. They lied and said I refused to pay the vehicle on the day I called. They said I said I needed the money for the car payment to file my bankruptcy.

They normally didn’t take the funds out of my account for several days after the due date. I could have not called to inform them and let them contact me. I was being diligent and calling to inform them of the change in my card, as well as my giving them up to date information on the status of my Bankruptcy.

I was in no position to not pay the vehicle since I knew they had the GPS device that would disable the vehicle. I did not pay $2000.00 down and make the payments on time by providing my bank card info for the auto draft. I was not trying to not pay them by calling on the due date to let them know the card was cancelled and I would be calling as soon as I get the new card in the mail. It is now 5/24/2014. I have not filed bankruptcy to date.

I lost my case in the [redacted] because I am not an Attorney. They were focused on my not paying the loan. No one listened to me when it came to the fact I didn’t breach the contract, [redacted] did. They normally didn’t take the funds out of my account for several days after the due date. I could have not called to inform them and let them contact me. I was being diligent and calling to inform them of the change in my card, as well as my giving them up to date information on the status of my Bankruptcy.

I found out during my research of the Companies that they in fact are owned and operated by the same people. So, United Cars and Credit and [redacted] are the same people under different company names.

So, in fact they took the car and sold it back to themselves and then sold it again. I have a photo of the vehicle on the United Cars and Credit lot where it was in fact sold once again. I’m not sure how many times this has happened. All I know is I am still without a vehicle, they have sent my employer the Writ of Garnishment Papers on May 14th 2014. The return address on the paperwork is now Equity Auto Finance at the same address. The Company is owned by [redacted] their phone number is ###-###-####. Every one of the Companies is listed with the same address. [redacted], United Cars and Credit and Equity Auto Finance: 1951 W. Camelback Rd. Ste # 105, Phoenix, AZ 85015.
