I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
In regards to the letter received from *** ***, CAI, registered Wisconsin Auctioneer, I appreciated his willingness to respond
I am grateful that he mentioned his long history in doing business and I appeal to his integrity as a businessman to be a man of his wordThat has been my expectation from the start of this business endeavor
As to the description of the tools, I typed out and brought with me packing slips for each box of tools that I was requesting the auction company to sellI went through each box of tools with both *** and his associate when I brought them to his locationI also brought pages from a tool catalog, so that he could see the current pricing of the toolsAs we went through the packing slips he made his own notations as to the few items that I asked him to set a firm price on and he agreed to return the tool if he could not get the agreed to priceAt that time he had the opportunity to set aside, or mark in some specific way the tools that fell under this agreement
I have attached a few of the packing slips that he made notations on and that bear his signature
As to my being present or sending a representative to protect my items, I do not see that in the contract (also attached)
I am respectfully requesting that the Auction & Realty company pay me in full for the tool that they were unable to return to me as this was our agreementMy complaint in no way denies his ability as an auctioneer

The agreed upon price was $less his 10% would be $675. The item was sold for $less his 10% which left us with a payout of $31.50. $less $leaves $which I feel is still due to me. I appreciate your efforts at helping me to bring this to an appropriate conclusion. Thank you,

In regard to your letter of August 13, 2014, Complaint ID ***, I would like to thank you for the opportunity to explain our experience from our 16th Annual Spring Lawn and Garden Auction conducted on Sunday, April 27,
Our auction company has been serving buyers and sellers in the Dodge, Jefferson and surrounding counties for nearly years, doing 1000’s of auctions. And, in some cases, we cannot make everyone happy
After reviewing your letter, a number of issues have come to our attention regarding our Annual Spring Lawn and Garden Auction conducted on Sunday, April 27, 2014:
1) The items in question were not described and clearly identified by the seller as to what they were
2) The items in question were not represented as the seller claims
3) The auction company held back items which we thought were those in question, and returned those
items to the seller, at which point the seller claimed they were not the items in question
Per our contract, in these types of sales, the seller should have been present or sent a representative to protect the items
We have tried to track down these particular items by contacting the buyers, but with no success
Only people were buying these items and we have contacted them numerous times and they do not have these items in question
Either they were not brought to the auction to begin with or they were not clearly marked by the seller as to what the seller is calling them and what the buyers or auction company would have described or represented them
We communicated to the seller that we would try to locate the items but again this was without success
As the auction company, we were protecting items of representation and then later informed by the seller that these were not the right ones
The buyers also informed us about the other items that they purchased as being outdated items and of lesser value. These types of machining tools and bits for precision machining are a one-time only use tools and bits and would not be used by machining professionals, subsequently, the value of these items may have been misrepresented by the seller
As the auction company, we had no way of determining if these tools were new or used
Thank you for this opportunity to clarify our experience. We have done all that we can to find these items for the sellerWe continue to represent buyers and sellers with the highest integrity
