On June 3, 2018, I when into a contract with United Developer. The contract required them to do a full house renovation and secure all permits and inspections required for the job.

Working with Sean was the worst experience I have had with a contractor to date, He consistently calls needing more money, never was on the job site, always arguing with me when I ask about my project.

Re: Complaint No: *** Dear Sir/Madam, We have received your (MHIC) letter in which *** (herein after will be called as ***) owner of ***. filed a complaint against United Developers MHIC#*** claiming that his property was damaged.

In replying to this complaint we respectfully state as under:

1. This complaint is based on bogus and false claims, irrelevant and against the facts and the contents of the contract.

2. In the complaint *** has stated that United Developers will take care of the mold issues in the beginning, whereas, there is no indication of such claim or promise was made or stated in the contract. United Developers gave him a rough estimate of mold remediation but the price was not acceptable to *** upon which, he has decided to hire “ ***" to take care of such matter. (Copy of the Report Attached) 3. His second claim regarding demolition, plans, Permits and cleanup is also false and baseless, whereas, we have submitted the plans at the office of Housing and Community Development division of construction and building inspection and acquired the permit #*** in order to performs the demolition, making the laundry room and installing LVL beams on the first level. (copy attached) 4. Lastly *** claiming the roofer was under paid, stripped the roof and didn't complete the roof work, which is also false statement, whereas; as per contract United Developers has to remove only damaged part of plywood and replacement of the shingles. During this process, our roofer notified us that there are some damaged roof's joist upon which, we brought this matter to ***'s attention and told him that there will be extra charges to remove these joists, but *** refused to pay extra amount. The roofer was paid in full and in advance upon agreed price to show good faith to *** of our attention to complete the job. Moreover, all the material for the roof and plumbing was bought and was present at the premises. (Copy of check paid to roofer, ***'s receipt for the material attached)

We don't wish to participate in formal mediation because it's a civil which will be filed in court against *** and Our subcontractor.

This is humbly requested that this complaint may kindly be set aside on the bases of the following grounds:

This complaint was filed in your office by *** when our insurance ***” Claim #*** denied his claim against our policy. When *** sent us our termination letter via email, in which he stated he is terminating the contract for $3,500.00 but we sent him the final itemized invoice amounting to $11,150.00 to be paid within reasonable time otherwise we will pursuit to file a lien against his property for the remain balance. It was in the contract that if any additional work comes up will be charged at extra cost. The initial contract was in the amount of $85,000.00 which was later raised to $95,000.00 after we discovered that the whole house had a mold and need the entire inside demolition in order to complete the Mold redemption. (Copy attached) After demolition, cleaning and Mold redemption we have discovered the second floor of the property was unbalance and the floor joists needed to be replaced or sister with new ones and this issue was also brought into ***'s attention and also, he was told that it required extra cost. The Roof's work was suspended due to heavy rain forecast for several weeks in that area for the month of June and July 2018. While roofer was working we have discovered another issue of chimney which was tilted on one side and could fell down to because more damage to property. We gave him the price of joist and chimney then ***'s mom *** got direct in business with our roofer to deal with such issue in addition to that she prevented the roofer to perform his work in order to terminated the contract on or about August 05, 2018. ***'s conduct was absolutely against the Ethics, morals and grace of good and fair business practices. • In the end, we are concluding the key points as to why *** filed this complaint. The property under discussion located at *** Baltimore, MD *** was built in the year of 1920 and was abandoned for several years prior to *** has purchased. Roof has multiple damages at different places, the severe weather conditions, rain and snow contributed great damage to the property, its roof joists and its second floor. Beside *** is an investor, he failed to judge and cvaluate the property, properly and professionally and has realized that he made a bad investment. When we brought all the issues to his attention which we discussed above, the project price went way beyond his budget. In retaliation he is taking out his rage on us and doing multiple efforts to recover some of his losses by all or any means, that is why he claimed against our liability insurance and it was denied bases on facts and proofs provided by us. To satisfy his ego, he is trying to vandalize our reputation with your office. *** has wasted our time and money by breaching and terminating the contract without any solid reasons, hence; we are going to put a lien of $11,150.00 against the above said property and filing a law suit for damages against him and his company. With good hope, we expect that after reviewing all the facts and the attached documents, your decision will be in our favor. Note: *** have contact me to resolve this issue in which he was asking 5.000.00 for us to paid which is not going to take place. He never paid me 17,000.00 because his Bank wasn't willing to pay upfront it's when the job is done they will pay me after..I am pursing a lawsuit in the amount of 16,000.00 for material and time spent and headache.
