To whom it may concern, I would like to apologize on behalf of United Express Construction for Calling Mr. [redacted]. We have been cross referencing our data base with the Fed. D.N.C. list. Sometimes numbers do get duplicated and not taken out. I listened to the recording of the call and we were...

informed of the D.N.C. status of Mr. [redacted] after 2 minutes 30 seconds into the call, in we we were providing our company information to Mr. [redacted]. Our manager Gloria apologized and told Mr. [redacted] that he would be removed immediately (which he was). Gloria then was politley saying good bye when she was answered with an expletive that I do not wish to write in this message. We have removed Mr. [redacted]'s phone number from our data base and will not be contacting him in the future. We try out best to serve the community of San Diego and to maintain our A+ rating with the Revdex.com and hope this does not effect that in any way.

I understand Mr. [redacted]'s frustration, however he asked for a third party to join, I can do nothing else but to apologize and assure Mr. [redacted] that we will not be calling him again.

Dear Revdex.com, I have reviewed the complaint brought forward by Mr. [redacted] and have researched him in our dialing database. I would like to apologize... We did call him and offer a free estimate. He explained that he was on the D.N.C. list, we...

apologized and informed him that he would be removed from our system. I have had a few responses like this and have met with the company that provides our call information and also configures the caller i.d. attached to it. I was assured that the list he provided us will be crossed checked again with the federal D.N.C. list. As a company we understand some people's frustration with telemarketing, we remove anyone's information on request or once we are informed of their status. The San Diego construction market is saturated with companies doing the same marketing that do not abide by the rules and make it harder for reputable companies, we value our A+ rating with the Revdex.com and will continue our efforts to keep our rating. I would again on behalf of the company like to apologize to Mr. [redacted] for any aggravation or inconvenience this may have caused.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.How
can this company possibly be a member in good standing in the Revdex.com?  Not
only do they violate FEDERAL laws regarding Do-Not-Call lists, they
also admit that they violate CALIFORNIA laws regarding recording of
telephone conversations.  Here is the law:
California makes it a crime to record or eavesdrop on any confidential
communication, including a private conversation or telephone call,
without the consent of all parties to the conversation. See Cal. Penal Code § 632.
The statute
applies to "confidential communications" -- i.e.,
conversations in which one of the parties has an objectively reasonable
expectation that no one is listening in or overhearing the conversation.
See Flanagan v. Flanagan, 41 P.3d 575, 576-77, 578-82 (Cal. 2002).  A California appellate court has ruled that this statute applies to the use of
hidden video cameras to record conversations as well. See California v.
Gibbons, 215 Cal. App. 3d 1204 (Cal Ct. App. 1989).
If they knowingly and routinely violate FEDERAL and CALIFORNIA laws, how do you think they will treat customers?  The least that Revdex.com can do is to remove them from the list of approved businesses.  I am willing to consider mediation of this matter in lieu of filing a court complaint and/or with the District Attorney.  Will Revdex.com participate in this regard?

I would like to apologize to Mr. [redacted], I have checked and see that he is registered on the national Do Not call list. We have been in contact the last several days with our source provider in an effort to get to the bottom of this issue. We have noticed in the last two months the increase in...

this occurance. We do not wish to bother anyone on the do not call list, our source provider is currently double and triple checking to make sure we are in complete compliance with the rules and guidelines set forth by the FCC. I did listen to the recordings and we did call Mr. [redacted] and had technical difficulties on the first attempt wich I'm sure only compounded the problem. I would like to offer my most sincerest apologies on behalf of United Express Construction and have made certain he will not be bothered by our company again. We understand where he is coming from... this issue is not taken lightly and we will address this. If there is anything else we can do please let us know. We want to be an asset to the community of San Diego County and will try and get better with everyday. We appreciate you bringing this to our attention.

I really want to prevent another call and any further aggravation to Mr. [redacted], if there is any way to get the number that is...

being called so I can find and remove it from our system I would appreciate it. If in the meantime another call to him is made, he can tell our Marketer to talk directly to "[redacted]", I will take care of it immediately.?

There was a production issue with his job that was resolved immediately, Mr. [redacted] is pleased with the result and we look forward to doing more work with him in the future.

Hello, I would like to apologize to Mr. [redacted] for any trouble or irritation. I looked up the call history for [redacted] and show that we have called Mr. [redacted] 5 times since 10/13/13  but actually only speaking with him once on 5/19/2014 for 90 seconds. With that said, Mr. [redacted]'s...

D.N.C. status should have kept him out of our system with the cross checking program we have in place. To be honest we have had some issues with the software we are using to do this, and are currently seeking out other avenues to use instead. We appreciate Mr. [redacted]'s privacy and on behalf of the entire company would like to extend Mr. [redacted] our sincerest apology.
