We
attempted many times to schedule [redacted] a training appointment to
teach him how to use his Money Merge Account (MMA) (6/12/2009,
6/15/2009, 6/26/2009, and 7/10/2009). On 10/28/2009 we received word
that [redacted] had requested a refund. At this point he was well outside
the three-day...

right of rescission (3DRR) in which he could make a refund
or cancellation request. We contacted his selling agent, who told us that she had tried
to contact him several times, but he had not answered her calls.
Another agent involved in the sale told us that [redacted] was just going
through hard financial times and didn't want to get a refund; he still
wanted to use the MMA, but he couldn't make his contracted finance
payments. We spoke to [redacted] later that same day, and he asked for a
temporary suspension of his payments. The next day a three-month
suspension was approved, and [redacted] signed a Suspension Agreement.
However, when we tried to resume his payments after the suspension
period was over, his payment failed, which was in violation of his
signed Suspension of Financing Agreement. We
left him a message on 3/11/2010 about his failed payment, but he never
called us back.On 9/30/2013, our Upgrade Department got a hold
of [redacted] and scheduled him a training appointment for the newest version
of the program. He did not show up for that appointment. We got a hold
of him again on 6/18/2014 and scheduled him another upgrade training,
which did not happen. On 12/28/2015 we received an email from [redacted]
saying "The
program did/does not work for me and I want to cancel it and get a
refund." We replied that he had signed a finance contract that could not
be canceled. There was no response from him until 2/9/2016 when he sent
us another email: "I need an electronic or hard copy of my balance and payment history.
Please either email this to me or mail it to me via US Postal service." We sent his balance statement via email the next day.As
can be seen in this history, [redacted] has never been trained on the MMA,
but not for lack of trying on our part. [redacted] never started using his
program, either. He may have lost his home, but the MMA can still help
him with any other debts that he has, such as car loans, credit cards,
student loans, lines of credit, etc. It's true
that [redacted]'s current balance owed sits at $[redacted]; interest has been
accruing on his past-due account every month since the last time he made
a payment, which was 9/25/2009. He is six and a half years past-due on
his payments. He has been sent a past-due email every month since
6/2014, yet he didn't respond to us until a year and a half later.
However, we are willing to forgive his debt and cancel his finance contract, but we cannot issue him a refund for the finance payments he has already made.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.

Sincerely,
