Response taken by phone: [redacted] was not present during the move out, her sister was [redacted] has been supplied all the paperwork regarding the security deposit and move out charges We had to have the floors professionally done and various repairs (chair, blinds, whole in wall, paint) We understand that there was an emergency and she could be present but this documentation was presented upon moving in and vacating, so there is no misunderstanding as to what is required upon move out
Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below I have attached the Move Out Statement provided to me by the United Group of Companies for the apartment I rented from June through August at Lonsway Hill apartments, Unit [redacted] ***This Statement was issued on September 1, and shows that the carpet cleaning and repairs to the kitchen cabinet and counter and broken blinds are indeed included as United Group of Companies claimed However, this Statement clearly shows that the amount to be refunded to me from my security deposit is $ (See attached document 'Lonsway Hill Move Out Statement'; last line dated 09/29/2015)In addition, I am still owed $for the amount that was over paid for the washer/dryer rental for the month of August (See attached documents: 'Lonsway Hill Issued Receipt for Rent Payment for Washer & Dryer for August 2015' and 'Lonsway Hill Record-Washer & Dryer Rental Overpay') The Receipt for Rent Payment attachment shows I paid $for August rental of a washer and dryer, which is $more than the monthly rental of $The Record-Washer & Dryer Overpay attachment (noted as 'Resident Ledger' on this document) shows a credit balance of $and a hand-written notation initialed by Michelle D***, the Lonsway Hills rental manager, that she had "copy of check deposit--entering payable 8/7/to have check for [redacted] before 8/31/15." Response to Complaint ID # [redacted] In the complaint made by Mr [redacted] he claims he is not required to give a day written notice to vacate prior to movingIn Clause #of the lease agreement, it does reference the deposit refundIt states that " the amount of the refund will be determined based on the following conditions" and giving a day notice is part of thatHowever, it does not state that, you can forfeit the deposit in lieu of the day noticeIt is one of the conditions of receiving the deposit back , but the day notice is required under the terms of the contractIn addition, the renewal letter that was sent to him notifying him of the upcoming lease expiration, reminds the resident we will need a day written notice to vacate Also, upon move out he signed the Notice to Vacate that also states we require a day notice to vacate the premises Both of those documents are attachedThank you and please let me know your findings, Shannon R [redacted] Area Manager

This Statement was issued on September 1, 2015 and shows that the carpet cleaning and repairs to the kitchen cabinet and counter and broken blinds are indeed included as United Group of Companies claimed. However, this Statement clearly shows that the amount to be refunded to me from my security deposit is $194.50. (See attached document 'Lonsway Hill Move Out Statement'; last line dated 09/29/2015). In addition, I am still owed $50.00 for the amount that was over paid for the washer/dryer rental for the month of August 2015. (See attached documents: 'Lonsway Hill Issued Receipt for Rent Payment for Washer & Dryer for August 2015' and 'Lonsway Hill Record-Washer & Dryer Rental Overpay') The Receipt for Rent Payment attachment shows I paid $100.00 for August rental of a washer and dryer, which is $50.00 more than the monthly rental of $50. refund will be determined based on the following conditions" and giving a 30 day notice is part of that. However, it does not state that, you can forfeit the deposit in lieu of the 30 day notice. It is one of the conditions of receiving the deposit back , but the 30 day notice is required under the terms of the contract.
