On or about August 7th, 2015, a contract for a concrete driveway was drawn up for the sum of $10,350. A verbal price at the dollar amount of $10,000 cash was agreed upon by both parties, Mr. [redacted] and myself, Daniel G[redacted]. This contract covered 2,300 square feet of concrete @...

$4.50/ft at a standard thickness of 4 inches. A handshake and $5,000 deposit set this project in motion. After two days of prep work and setting forms, I ordered enough concrete to cover 1,680 square feet of the project at hand. Due to the high temperature that day as well as other common variables that go hand in hand with most concrete projects, the concrete "got away from us" and started setting up faster than we could handle at which point I made a calculated decision to finish as much of the slab that could be saved and abandon that which could not be saved. In this type of situation, we tear out the concrete that is unsatisfactory and replace it at my cost. This type of situation happens once or twice a year due to all the variables involved with owning a concrete company and is not uncommon. After ten years in business and over one thousand customers it is simply part of the overhead that I have to absorb to keep the consumer satisfied. Upon retuning the following day to start the demo process, Mr. [redacted] had come up with his own plan for the continuance of this project. He requested that we tear out a significantly larger part of the drive than I had anticipated which included the demolition of approximately 384 square feet of what I considered to be nicely finished concrete. In an attempt to satisfy Mr. [redacted], I agreed to demo that area as well as the concrete that was clearly unacceptable. At that point Mr. [redacted] said and I quote; " Here's my nextproposal; I only have $2,000 left to finish the driveway." My response was as follows; " Even without the mishap, I couldn't financially complete a drive of this size for that price ($7,000)". He restated that he only had $2,000 left and I told him that we would certainly tear out and replace that which was not up to par as well as the additional area that he requested. In retrospect, I assume he thought that he was going to get a $10,350 driveway for $7,000 which was clearly not agreed upon by both parties. My company did in fact tear out the substandard work and replaced it. Not only did we replace it but also gave him 42 feet of six inch curb at the lower end of the drive for free to show that we go above and beyond what is expected. At $20 per linear foot for curb, it was an $840 act of kindness on my part.In conclusion, Mr. [redacted] received well over the amount of concrete that he paid for in the sum of a $5,000 deposit. I poured 1,260 square feet of concrete at an average thickness of six inches, not the standard four inches. 1,260 square feet @ $4.50/ft equals $5,670 plus $840 worth of complimentary curb to keep him from sliding off the driveway or sliding into his house like he has done in the past. I have documented everything in this letter with pictures of the quality and thickness of the concrete.Any good faith of getting further payment was ruined when he claimed that he only had $2,000 left to spend so I elected to give him $6,510 worth of work for his $5,000 deposit and simply pulled off the job until he came up with the remaining $5,000 of the balance at which point he sent me a text that I was no longer aloud on his property. I have counted my losses and moved on but will certainly countersue for additional monies if litigation is persued on his part. Mr. [redacted] is the first unsatisfied and clearly unreasonable customer in my ten years of business as a concrete contractor.Upon request, I will provide names, addresses and phone numbers of at least ten customers of similar situations like Mr. [redacted]'s.Thank you for your time in reviewing this matter. Pictures of the project in question are attached for your convenience.Sincerely,Daniel G[redacted]Universal Concrete Construction
