Complaint: [redacted] I am rejecting this response because:There was no change in the condition of my property from the inspection done the year beforei was approved the year before and not approved this yearI was the person who brought the issue with the neighbor to Universal's attention before the second claimi have been diligent in helping Universal obtain restitutionI have written and sent certified letters to the property owner, made many calls with the city, and kept recordsThe adjuster will state that I was very good at doing work myself after my claims to lower costs and I paid the arborist out of my own pocket to trim limbs from the neighbor's treesof note, the arborist stated in writing the trees located on my property were safeEven the attorney representing Universal thanked me for my detail and diligenceWhen it came down to universal being there for me, they tossed me to the curbIt's incorrigible and shameful Regards, [redacted]

Regarding the non-renewal of your Homeowners Policy.Our records show that your policy was non-renewed due to the substantial increase in risk of unstable trees falling onto and damaging your property. While we appreciate every measure you took to have your neighbor remove the unstable trees, to protect your property from further loss, we have to consider the fact that the remaining trees do still present an increased risk of loss. It is because of this increased risk of loss that we cannot continue your policyInsured’s are expected to maintain their properties in an effort to protect against loss, and a failure to do so could lead to losses, and to termination of the policy for the failure to maintain and/or protect against loss.We appreciate the steps you took to protect your property against further loss, to mitigate damages as much as you couldDoing so is a condition outlined in the policy form under “Duties After Loss”.While our Claims Department is currently attempting to subrogate against your neighbor for the damages, it does not negate the ongoing and increased risk of the other unstable trees falling onto your propertyYour policy was reviewed prior to renewal due to the two recent losses, and it was then that Underwriting discovered that the remaining trees posed an increased risk of loss. Additionally, our review of the inspection that was completed last year did not indicate any issues with the trees in your neighbor’s yard, only with the tree in your yard that was touching the side of your homeWhile we realize that our response may not be what you hoped, and that you attempted to have your neighbor remove the trees to no avail, we do have to consider the increased risk of loss those trees present to your propertyUnfortunately, until that risk is removed, we cannot continue your policy

Dear Sir or Madame: Universal North America Insurance Company (Universal) received the complaint from [redacted] via the Revdex.com. [redacted] concerns related to the coverage declination for this claim. The claim involves a claim for water damage resulting from...

a leak from a plumbing system that occurred over a period of weeks. After reviewing coverage under the policy in question, Universal determined that the loss was excluded from coverage. The attached coverage declination letter provides the specific details of the declination. If you require additional information, please contact me. I am rejecting this response because: When they came to inspect last year, they had me trim the tree limb that was touching the house and I do mean by only a couple of inches. This year the tree is not touching the house at all and I just went out there to look at it. Why would they continue my insurance last year and not this year when there is no difference. I believe it is obvious that I am being punished for the neighbor's trees. Of note, I never received the second letter of response from them.

I am rejecting this response because:It is shameful to punish a client when not only they have done nothing wrong but have done everything to help the situation. I find it suspicious that Universal stated it was because of the trees on my property until I stated an arborist had looked at them and now we are back to the neighbor's trees. It may be legal. I don't know yet but not ethical.

Universal did make contact with[redacted] on September 5, 2017, prior to receiving this complaint, and was able to get acopy of the estimate in her hands. offer the following:Our investigation shows that our policyholder suffered two water losses in 2015 (May 06, 2015 and October 07, 2015).In an effort to keep rates competitive and to provide coverage to as many California homeowners as possible, Universal North America Insurance Company develops underwriting practices that are designed to be applied on a fair and equitable basis to our policyholders throughout the state. These guidelines are also filed with the State of California Insurance Department to ensure their consistency and compliance with regulations.Unfortunately, our underwriting guidelines do not allow us to continue insuring homes with multiple losses of the same type within the previous three years. As a result, we were unable to offer our policyholder a renewal at the end of their policy term.We are sorry that we were unable to provide a more favorable outcome at this time for this policyholder.
