I was called out to measure a job at [redacted] homeowner and I went over the sections he wanted replaced on West side of homeI gave him a proposal for square feet of siding to be replaced on West side of home He signed contractDay when I was removing the siding on west side of home Homeowner came by and had mentioned there was more damage he would like for me to look at on North side of home We both did a walk around and noticed there was a little more that needed attention, approximately 155sq feet Homeowner said he would like it done also I then responded that this was not in our initial contractThat I would have to measure and price for material and labor He agreed verbally and said no problemI then went back to work and continued with siding tear off, including tearing off the additional (ADD ON) he just includedThat evening I went to office, drew up a new proposal adding the additional siding he wants replaced I called him that evening to let him know what he was looking at for extra charge in material and labor The homeowner then told me I need to stand by my contract I told him I wasThis is for the additional siding we looked at todayHomeowner then became very irate on phone and wouldn’t let me explain to him the breakdown of cost for material and labor on additional 155sq feet of siding he was wanting replacedHe was talking over me, stating something to the effect of he is going to measure himself the square footage at noon tomorrow, and that my original contract stated 680sq feet and that covers the additionAt this point in conversation he was yelling and I could not even understand him We got off the phone Day I go back to job location to complete the 680sq feet of my initial contractHomeowner shows up to measure, (his way) and tells me, he only measures it out to be square feet on house I then tell him that I have already purchased 700sq feet of materials and it is on house I also showed him the pile of my less than 5% waste He goes into a yelling fit with me I told homeowner I have never been talked to that way ever He continues to over talk me to the point where I believe I need to leave the property, I was very uncomfortable being there due to not knowing how far he was going to escalate since he was yelling and not wanting to have a conversationI started to pack up; leaving the pile of trash I had scheduled to pick up that dayAs I was leaving the driveway he drives back, continuing to yell At this point it is on audio of homeowner screaming at me and trying to intimidate meI left job site and would like mediation to help solve these issuesAt this point the homeowner has only given me dollars I have receipts of total materials which are that $ Homeowner is not out any money whatsoever and he has nearly square feet of material replaced on his home Desired Settlement: Homeowner to pay me for extra costs in additional work he wants done and completedAnd for me to be paid for work I have already done, stated on initial contract

correct spelling errors.I am rejecting the business response for the following reasons.The contractor did not fulfill his obligation as per the terms of the contractThe contractor's perception of my behavior would be pretty much be how I would have described hisPointing fingers at one another claiming "he said this" or "he said that" will get us nowhere, so let's not do itFrom this point forward I would like to address the "FACTS" as I see them.FACT: Square footage is an exact quantitative value determined by multiplying length by widthIt is quite simply mathematical "FACT"There is one and only one correct answer when using exact measurements and correct calculations and is generally not up for disputeI think we can all agree that a 10' x 10' area is exactly sq ft.FACT: I met with the contractor at the job siteI went over the scope of the job, indicating where I wanted siding to be replacedThe contractor measured the areas that I had identified and submitted a proposal based on those measurementsHis proposal indicated that he would remove and replace approximately sq ft of sidingI signed the proposal.FACT: I showed up at the job site on day two of the jobI identified an area that had not been re-sided and informed the contractor that this area was part of his original bidHe disagreed with meI assured him that this area was to be includedThe contractor removed and replaced the siding in this areaThis portion of the job shall be referred to as the "disputed portion".FACT: The contractor called me that evening to tell me that the job was going to cost me an additional $(since reduced to $700)He claimed that with the area I insisted was part of the job was not included in his proposalWe went back and forth over this issueI ended the conversation stating that this can easily settled by simply measuring the square footage of the jobI also stated that if the disputed portion were to exceed the square footage of his original proposal that I would most certainly owe him for additional labor and materials.FACT: I came to the job site on day three and measured the square footage of entire jobThis included the disputed portion as well as unfinished portions of the jobMy measurements were for the entire scope of the jobTo my surprise, the total square footage of the job is only sq ftNot only did the addition of the "disputed portion" not exceed the square footage of the original proposal, it was in fact nearly 15% less than what the contractor had originally proposed to doAt this point I told the contractor that I was unclear why we were having this discussion an that he needed to complete the job per his bidHe insisted on telling me that he had purchased Sq ft of material to which I stated that I didn't care how much material he had purchased and that the job was to remove and replace sq ft of siding and not how much material the job requiredThis seemed to upset him that I didn't care about how much material he had purchasedAt this point, he yelled to his employee, "Roll it upWe're out of here"The contractor packed up his tools and walked off the jobHe also left all his waste and old siding that had been removed in a pile in the back yard.This is how my relationship with this contractor endedIn his response letter this contractor once again stated that he had purchased sq ft of material and put on the houseI would like to reiterate that that it is neither my concern nor responsibility to care how much siding he has to purchase to complete the jobNowhere in his proposal does it state how much material the job would requireIt simply states that he would remove and replace sq ft of siding, which he has not completedOf coarse it will require more that sq ft of siding to complete the jobHow much more is not my concernIf it takes sq ft or sq ft, then so be itThe material doesn't come precut to fit the jobAs someone who claims to be a professional contractor, it is entirely his responsibility to calculate how much waste the job will generate and his proposal should reflect thatIf he miscalculated how much material the job would require, that becomes his problem and not mine.With regards to the disputed portion, I would like to point out that I have no idea how the contractor came up with sq ft for the additional add onThe disputed area is a plane 9.5' x 9' with a 4.5' x window in the middle of itThe contractor sarcastically indicated that my measurements were "his way"In calculating the square footage of the disputed area "my way" I come up with a total square footage of square feetx = sq ft minus x for the window (sq ft) equalling sq ftI think it is reasonable to exclude the surface area of the window as the contractor neither removed or replaced siding for that surface areaIf this is the kind of fuzzy math the contractor embraces, it's no wonder we're having this dispute. So, in conclusion, not only is the disputed area not sq ft, it falls entirely within the scope of the original proposalIt is my opinion that the contractor under bid the job and when he realized this, in an attempt to cover his mistake, he generated a fictional additional add onMy question to the contractor would be, if the original proposal didn't include the disputed portion of the job, how is it that he came up with sq ft for the job and if you were to subtract sq ft for the disputed portion, then where is the sq ft of siding on the building you were supposed to replace? If the contractor wants to measure square footage of siding he installed, I would welcome that so he doesn't have depend on measurements done "my way"I'm confident that if he were to use exact measurements and correct mathematical calculations, he would come up with even less than sq ft, as I rounded several of my measurements up to the nearest 1/4, 1/or 1/foot incrementsMath may not be one of his strong points but it is mineIf the contractor wishes to do this, I would insist that there be a third party present when this is performedI want to avoid being accused of acting or saying something that I didn't do or say.Desired Resolution:I do not want this contractor to resume work at the job siteWalking off the job and leaving me with a partially finished project is in my opinion entirely unprofessional and I don't want to do business with this individual ever againFrom the contractors original proposal, subtract the cost of disposal for the waste from the jobDetermine how many sq ft of siding that was actually removed and replaced by the contractorDetermine what percent that amount is in relation to the originally proposed removal and replacement of sq ftof siding (the sq ft figure included portions not yet completed)From that percentage, calculate how much more the contractor is owed($minus disposal expense the multiplied by percentage of job completed)I want to compensate the contractor for the work performedA side note-this work was being performed as a settlement from the purchase of the propertyPayment was to come by way of a check from the title companyI wrote a personal check to the contractor for him to purchase materialsPayment will still come by way of a check from the title company but will include the $that he has already received from meI will need to be reimbursed for that amount from the contractor as he will be receiving that portion of payment in the check from the title companyI discussed this with him when I gave the $check and he was amenable to doing that at that timeUpon payment for what is owed, I would need the contractor to sign a statement that he is paid in full for the portion of work he completed and that he accepts this as a final resolution.Sincerely,*** ***

Again, the homeowner is not out any money. So however the homeowner wants to perceive measurements so be it. I do not and I am unaware of any contractor that subtracts out square footage of windows and such, and eats the cost of less than 5% waste.  Again his measurements are “HIS WAY” And honestly I am not even sure why measurements are being disputed.  The homeowner showed me the exact areas on home during our first appointment of where he wants siding replaced, and those are the areas that are complete. I did my measurements for my material order only and listed them clearly as approximate square footage being replaced on my proposal. It wasn’t until he added on another area on the opposite side of home that he decided to measure himself and see if he could use my measurements for material/siding replacement to his advantage. I suggest he contact the title company to have check written out to another contractor to complete the additional work he wants completed.  He has a check that far exceeds the amount of material and labor to complete the “ADDITIONAL SIDING” he wants replaced. Please note: His initial complaint dated 5/6 he wants this dispute resolved and to have job completed by Universal and the next complaint on 5/24 he is stating he never wants to do business with me.  I am an honest man, and 99.9% of my customers are referrals . If any mistakes on my end were made I would own up to it. At this point I would not feel comfortable nor safe continuing this dispute further. My time has been wasted enough, sometimes things are better left alone. Good Day and God Bless!
