Back in December 2018, my daughter purchased a $50.00 gift card from the restaurant "UnWined" 472 Mauldin Ave, North East, MD 21901. See enclosures - copy of receipt and copy of front and back of gift card; for a christmas present.

Tonight, Friday, February 28, 2020 I went to the restaurant with my husband and friends. When came time to pay the bill we handed gift card among additional payment to the server. She told us the gift card could not be honored; because it was purchased under the old owners of the restaurant. She gave me their names, ***. She paid, the new owner had honored them but no longer could. Why am I being discriminated when others were honored?

I had no knowledge of the old owners nor do I know of the new owners.

I finally got the opportunity to use this card and was very disappointed to hear this would not be honored.

When reading back of card...

"this card may be used at our location by simply handing it to the server or cashier for payment when making a purchase. Additional value may be added to this card at any time. This is not a credit/debit card and has no implied warranties. Merchant is not responsible for lost stolen or damaged cards, or any unauthorized card use. Card is redeemable for merchandise only. Unused value remains on card and can not be redeemed for cash. We look forward to serving you and hope you enjoy the convenience of our gift card."

No where does it say this card will not be honored if restaurant changes owners!

I believe that I should be reimbursed for this card old owners or new owners I do not care. The owners should be settling this. I did not purchase the business, I am the consumer.

I do not usually complaint but I really felt this was an unfair practice. Or is it a new type of scam?

Sincerely

Good morning. I am the new owner of UnWined. I purchased the assets of the business in late December to be effective January 1, 2019, I did not purchase the business entity.

As such I am under no obligation to honor previous gift cards. I did however honor all cards for more than six months. I did so not knowing the amounts, only taking the guests word as to the amount of the cards.

I decided that it was not a good business practice to continue to do this forever and stopped taking the previous UnWined cards on January 1, 2020. I felt it was more than enough time for someone who had a card from the past to use and be given the value of the cards. At some point I had to run my business and not be responsible for the previous owner. As I am sure you know, I received NO compensation from the previous owner for the cards he sold. All those funds went to him when the cards were purchased. So I'm essence o was giving away food and beverage on the full amount of whatever the guest told me was on the cards. I cannot survive as a small business doing that perpetually.

I have no control over what the previous owner did with the gift cards he sold. I believe this is the same as those who had a gift card from a chain store that went out of business and those with old gift cards were not able to use them.

I am sorry for those that still have those cards but I believe I have been a good steward in that I accepted those cards for a minimum of six months with no benefit to me financially.

(The consumer indicated he/she DID NOT accept the response from the business.)
I am sorry too. what is done is done. I do believe you to be a good steward but I had a receipt of how much was on card. I also, understand you felt you had given enough time for someone who had a card from the past. Given normal circumstances I would agree with you. But, you haven't walked in my shoes. The card wasn't used in a timely manner due to the fact I had breast cancer. Treatments made me weak and tired. If that was not enough, I ended up with lymphedema. Lymphedema is my constant reminder of all that took place. I don't want pity. I just want to make sure judgement wasn't made for all without knowing full story as to why the length of time before card was used. Being a good steward maybe you can look to ways to protect consumers from this happening with all businesses in the future. Consumers buy gift cards in good faith. Maybe they should be banned completely if they are not going to be honored. Especially, if business is same with just change of owners. Consumers just know it is a place they would dine. Who knows if they like it they would spread word as to how good it is. Or how treated to keep from going back and spreading that word as well.
