Review: [redacted] examined the chimney at my house on October **, 2012, explained in detail the repairs he proposed to perform on that chimney, and provided a written contract which we both signed. I paid him a deposit, using my TD Bank check number [redacted], dated 10/**/12, in the amount of $1500. The contract notes work was to "start in 11 days". Because of wet weather followed by the winter, work was postponed until the spring of 2013. I received a call around late January or early February to schedule a start date and [redacted], their representative who made the call, scheduled us for March **, 2013. There was no confirmation call on March [redacted] as promised and no work crew arrived on March [redacted]. When I called them (###-###-####), their phone had been disconnected. On June [redacted], I located a phone number (###-###-####) for a 69 year old [redacted], who I suspected was my contractor [redacted]'s relative and called to request that the younger [redacted] call me. On June [redacted], a [redacted] called me, representing "the chimney guys", and said that it ([redacted]) was "too far" (away) for them to do the work and they would "send a refund of (my) $1500 by the end of the week". She wouldn't provide her phone number, claiming to be a new employee who didn't know the phone number, and suggested that I get it from my phone's caller ID. I said I was on a landline which didn't have caller ID and again requested her phone number. She seemed to be being directed as to what to say by another individual in the background and finally hung up. When I called the phone number (###-###-####) provided by my phone's caller ID, it turned out to be a service department message machine and multiple requests to be contacted by [redacted] have gone unanswered. The last contact information that I have for Up 2 Code NY LLC is from a sticker on my contract giving [redacted] and ###-###-#### as their contact information. Their Suffolk County License is [redacted].Desired Settlement: Refund (cash or banker's check or money order) and an apology from [redacted].
