Urban Terrain Reviews (2)

Review: On Friday 9/*/13 at approximately 1:15pm, I purchased a pair of Jordan Sneakers from Urban Terrain Sneaker store in the Bronx for $84.99. I was told that the transaction failed although the money was available. It turns out, my debit card was charged 2 times. I informed the manager, while in the store that my card was charged 2 times and showed her on my phone threw my online banking app. The store denied that they charged my card and refused to return my money. I was told by the female manager Sandy that my money would be returned to my debit card in a few days. On 9/*/13 my debit card was charged a 3rd time for 84.99 and I was not in that store on 9/*/13. At this point I concluded that the store has saved my debit card numbers and immediately turned my card off. I disputed this matter with my bank and will be contacting the police. It appears that this store scams people on a regular and I will never shop there againDesired Settlement: I would like a refund of my money as well as additional monies for the aggregation.

Response:

First, I would like to apologize for what happened. As soon as the transaction communication failed, we contacted our processing company and it took us many phone calls to resolve this issue. I finally received a call from the processing company and was told that $169.98 ($84.99 x 2 authorization) will be refunded to you by tomorrow. However, depending on the issuing bank's procedures and policies, it would take additional time before this refund is posted to your account.

It may seem a straight forward transaction (money is debited from your account, so we, the merchant, must have received the funds), in reality, debit or credit card transactions go through a rather complicated network with processing companies, Visa, issuing bank, etc. involved in the middle. First attempt was authorized, meaning, your bank acknowledged sufficient funds in your account to approve this transaction and immediately sets aside this amount. But this information failed to reach its intended hub, so our processing company did not receive the necessary information to tell us that the transaction is approved and we will get the funds within few days after the transactions are settled. Therefore, from our side, the transaction was not approved and we do not have the necessary information to get paid.

Thus the second attempt was made and it went through as normal and we were paid $84.99 for this transaction on Sept. **. However, when the settlements for the day happened, the network failed to recognize that this approved transaction information was already communicated. I believe that is why the attempt was made third time. In fact, we do not keep anyone’s credit card information and do not store any of the details except for the last four digits of your card and transaction information.

After a number of calls, the processing company reconciled all three transactions: one was authorized and paid to us; two were authorized but not paid. Therefore, processing company is releasing these two transaction amounts from the network and redirecting the money back to your issuing bank. When your bank receives the notification, it will credit back your account thus making $169.98 available to you again. Simple fact is we never received any more funds than $84.99 for the purchase of your Jordan Phase 23 sneakers and we’ve tried hard to cause these big companies in the middle to bring about speedy conclusion.

I understand that it is rather complicated, but this is the best I can explain. So if your account is not fully restored with $169.98 within a week, please email me again.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved.

Review: I bought a shoe which I later found out was defective and wasn't made properly by the manufacturer. The left shoe instep was not made properly which hurt my feel really bad I am unable to wear it. I took it back to the store to get an exchange. Which I was told by the store manager they will not exchange the shoe, saying it was already worn so there is nothing they can do. I explain to him that the it is during the first and second initial use that I realize that the shoe was not made properly by the manufacturer. The store representative [redacted] insist that he will not help and there is nothing more he can do and that I have to suffer the lost.-Desired Settlement: I would like an exchange on this Item.

Complainant has purchased Nike Dart 10 size 8.5 (style #580523-402) on Sept. * at 5:26 with receipt #[redacted]. This product was purchased as a debit card transaction. Urban Terrain has our store policy prominently posted in front of the cash register and also at the bottom of every purchase receipt. It states:

NO CASH AND/OR CREDIT CARD REFUNDS.

MERCHANDISE IN ORIGINAL CONDITION WILL

BE EXCHANGED WITHIN 7 DAYS WITH RECEIPT.

As the Complainant admits, he wore the shoes, thus by definition, the merchandise is no longer "in original condition". As a retailer, we strive to do what we can to satisfy our customers. Everyone has different anatomic structure and everyone has different preferences. We do not guarantee suitability of shoes nor workmanship of the products. We sell products from reputable manufacturers such as Nike and workmanship warranty either explicit or implicit rests with each manufacturers.

Complainant has the option of contacting the manufacturer directly to arrange for redress of his grievances. In addition, we do not consider assertion of discomfort to be valid reason for shoes to be considered "defective".

Furthermore, as the Complainant states, he came back to us on Sept. *, beyond the 7 day exchange period. Shoes were definitely worn and unsellable by any measure. The Complainant entered our store at 3:17 pm and until he left at 3:55 pm, he exhibited less than desirable behavior by shouting at the manager, throwing the goods, and otherwise disturbing our other customers. He even threatened by saying he will call the police to force us to exchange the used shoes and I believe he did call the police. Since then he has filed a complaint with The Revdex.com as well as New York State Division of Consumer Protection. We will not be bullied into complying with his demand for an exchange of his used sneakers just because he is experiencing buyer's remorse.
