URETEK ICR South Texas appreciates the opportunity to respond to the complaint brought against usWe find the complaint against URETEK ICR South Texas to be untrue We were contacted on 03/16/to look at a property for the customerWe responded and visited the property on 03/17/We prepared a contract and presented it to the customer on 03/18/We were contracted by the customer on 03/29/to have the work completedOur contract was a project agreed of 'replacing existing rotted wood (exterior beams) and leveling the foundation of the building by using the existing piers, installing / replacing existing piers where needed'Our work upon completion did not require installing / replacing piers, only replacing existing rotted wood (exterior beams) and leveling the foundation, which was done by using steel shimsOur work was completed on or about 04/11/We invoiced the project on 04/14/and received a check for payment on or about 05/10/Payment was in full for the invoiced amount.On or about 05/25/URETEK ICR South Texas received a call from customer saying that our work was being scrutinized by another contractor (customer actually referred to the person as a 'handy man') customer had hired to do additional (different type of work than URETEK had contracted for) work on the propertyCustomer was told that it would not be a problem to have both the salesman and project manager that sold and completed the project to get back out there and review with customerIn addition customer was informed that an e mail containing the exact description of what was completed, the areas it was completed inAlong with this e mail was sent a drawing that I made 'showing' the areas we worked inThese were both sent at 3:Wednesday the 25th of May Along with these e mails, contained in one of the e mails were the request 'Once you or he has looked at this drawing and how it relates to the project, let me know if you find discrepancies in what we say we did'.Eight days later on June 3, I received text messages from customertext message contained a very crude video of the underside of the property and a beam, another text message contained a photo of a another beam and a third text said " [redacted] hear (sp) is a video and a text picture of the work you'll (sp) did and I spoke to the City inspectors and there was no permanent pulled for the job you did for"Not being sure what that was all about I called the customer and was informed he was upset because his 'handy man' hired said we had not completed what we said we had completed and that customer was having to pay additional money to get a good projectWe agreed that URETEK and customer would meet on site the next day to review the project.The very next day on o6/04/both the salesman that sold the project and the foreman that completed the project for URETEK met with said customerCustomer stated his complaint, that URETEK did not do what they contracted to doOnce allowed inside the building both URETEK salesman and foreman observed that a minimum of half of the wood flooring and most of the joists in the area where the wood flooring had been ripped outCustomer was asked who took the wood flooring out that was in place when URETEK did their workThe URETEK reps were told that the flooring was removed by the ‘handy man’ presentOur foreman stood by his word stating that when he had completed the project (days earlier) that it was not like what customer was stating it to beCustomer was not happy with that response and asked salesman for a refund of $2,for work said ‘handy man’ had to completeSalesman was told that was out of his range of responsibility and he would visit with me about it.On Monday June at work I visited with both salesman and foreman for a long time, both insisting that our work was not very well represented weeks after the ‘handy man’ had removed flooring and floor joistsA visit to the City Inspectors office on Monday the 6th of June was made by me to inquire concerning acquiring permits (if required) for said project we completedThe City Inspector was not in and I was told by personel at the front desk of the City Inspectors office that permits would be required for the project I completedI had a dispute with that requirementI then visited on Tuesday the 7th of June with our local Engineer of Record and we both understood ‘replacing of wood and leveling by shimming’ on a preexisting structure that has not ever been Wind Storm Approved was a gray area Once again I revisted the office of The City InspectorStill not being able to visit in person with the City Inspector I went ahead and filled out the form to aquire a permit for work we completedOn Wednesday June I texted customer and relayed to customer I was working on acquiring a permit for project completed and please forward to me his U.SMailing address for purpose of filling out permit form if required(please note we have completed numerous ‘wood replacement / leveling by shimming’ projects across south Texas and had never before been required to pull a permit)Nothing was heard from by URETEK from the City Inspectors office and on either wed or Thusday June or I left a voice mail for customer that I was still working on obtaining the permit for the work we had completedI received no call back or response.On June 17th my salesman forwarded to me a text saying customer was looking to hear from meThe text read “###### we haven’t heard anything from your boss [redacted] on the problem it your house in Ingleside I’m trying to be a nice guy I’m going to tell (said handy man) to give me a receipt no all the work he to fix” I thought that was rather odd that he would no attempt to contact me directly since we had either spoke or texted a half dozen timesI immediately made a phone call and a text to customerMy call went to voice mail where I left a message, my text went un-responded toThose were both made at or about 10:and 10:am on Friday the 17th of June.On Monday the 20th of June at 10:am I still had not heard from customer and I sent an e mail to customer detailing that I had heard he was looking for me, had tried to call and had left him a voice mail, plus had texted himAnd that I had received no response to either.On Monday customer finally returned my call at 2:pmI was unable to answerCustomer left me a voice mail acknowledging me that he had received my attempts but just had been busyI returned customers call at 3:pmWe visited for approxminutes concerning the project, how he saw it and how I saw it to be completedHe also stated that he personally had not been able to view our work before his ‘handy man’ had begun work and that he was only able to take his ‘handy man’s’ word because customer lived out of town and physically could not make the inspections himselfI told him I understood that and that was why I had made the detailed description and the detailed drawing and e mailed it to him, asking him to contact me if what I described to be was not completedI also stated several times he had allowed his ‘handy man’ to work inside the property for days before he personally looked at the projectAt that point the customer stated that we had his money and he was going to have to tell everyone he knew that we were not good and that he was going to report us to the Revdex.comAnd he demanded money backI told him I understood his position, didn’t like it, but understood it, and that was his perogitiveI believe it made him mad that I was not effected by his threats, so he repeated both of them againAt that point I very boldly stated Thank You Very Much Have a Nice Day and I hung up.Immediately customer called back and screamed at me that I hung up on himI very boldly stated that he had threatened me twice, that we were getting nowhere and that I had said Thank You Very Much Have a Nice Day before disconnecting the callI do not believe he either wanted to hear that or did hear that because he was so lividAt that point I said for the second time Thank You Very Much Have a Nice Day and disconnected again.URETEK ICR South Texas believes that the work it completed was as contractedThat if issues were as said ‘handy man’ had seen, customer would have and should have notified URETEK before said ‘handy man’ had ripped out half the flooring and most of the joists in the area worked.URETEK ICR South Texas does not in any way, shape or form believe the work was not completed as contractedURETEK ICR South Texas does not believe it owes customer any amount of money back.We also believe that URETEK ICR South Texas responded in a favorable way every time customer calledThere was never one instance where URETEK ICR South Texas ever did not respond in a timely mannerHowever we did find customer not prompt in returning communication attempts.URETEK ICR South Texas has been a member in good standing for numerous years and is currently an ACCREDDITED BusinessWe do not believe we have achieved this rating due to issues with the several thousand projects we have completed NOTE: on Tuesday 06/21/URETEK ICR South Texas met with the City Inspector of Ingleside Texas and was awarded permitting for the project URETEK ICR south TexasIt was also learned that said ‘handy man’ had been removed from the project by the same City Inspector[redacted]

We find *** *** statements to be untrueOur dealings with *** *** has all been negative from the initial day we worked for himIn our original proposed scope of work we allowed for several other phases of work to be completed, but he chose only part of the work. Once he
contracted us to install the piers and we were finished our work, he refused to pay us stating that he could have hired our workers cheaper had he just contracted them himselfThis after him watching our guys contracted work for to daysShortly after the completion of the project contracted we were flooded with calls and texts and e mails from him saying we were supposed to inject polyurethane into the center of his garage.......for freeHe had refused this portion of the project we originally proposed, asking us to remove it from the proposed work due to the cost associated with it. Then he said 'we screwed him on his contract......he signed it without reading it'Did I mention *** *** sells contracts (*** *** *** *** ***) for a living. Once he figured that argument would not hold water he refused to pay us until we provided him documented paperwork (final elevation readings) of his projectReminded that in his signed contract with URETEK ICR South Texas it plainly states "Payment is due upon completion of the project", he still refused payment. It took URETEK ICR South Texas over weeks to get paid on a project that was to be PAID UPON COMPLETION OF PROJECT as stated in the signed contractDuring the course of establishing a proposed project we could complete and have half a chance to warranty, we visited with *** *** concerning the type of flooring he was going to put down over the top of a wooden structure built in (plus years old)*** *** stated he knew exactly what he was getting into and had hired the best, most perfect tile guy to lay his tileNOTE: partial piering of a structure, wood or concrete is exactly that....a partial piered projectThere is never any indication that the remaining portion will or will not moveJust as there is never any guaranty that the area piered will or will not move again, especially if you do not pier the whole project.We were called out again in Feb of for concerns about his garage and his homeWe found no evidence his home was settling, and we once again explained that the settlement of the interior of his garage could be stopped by utilizing our polyurethane injectionsOnce again we proposwed a scope of work and a cost for that work to be completed.....but he refused our proposal. in August of *** *** called again saying his garage was settlingWe went back out and found this to be trueWe found that the other side of the garage (the side we had not piered) to be settling, plus the middle of the garage to be settling (a project we had proposed twice). We believe the areas mentioned were settling and effecting the side we had pieredWe visited with *** *** concerning piering the other side of the garage and also lifting the center of the garage using our polyurethane injectionsOnce again *** *** refused our proposed workWe scheduled a re'lifting project on the piers we previously installed and we completed that re-lifting project in a very timely manner.In October of *** *** called again saying the section of his pier and beam home we worked on was settlingWe scheduled a visit, took elevations, made observations and related to *** *** that where we worked, no elevation changes were evidentHowever the other side of the home foundation had begun to settleWe had taken an independent foundation contractor with us that crawled under the home and found dry rotted beams causing settlementHis recommendation to *** *** was to have those dry rotted beams replaced and the rest of the home foundation leveled by re-shimmingOnce again *** *** refused this proposed work.In January of *** *** called our office requesting that our salesperson *** *** call himIn his conversation *** *** had with *** *** had with *** *** he stated that we had lied in our contract on the work we had contracted to complete, that we had not done what we contracted to complete, and that he had had another foundation company check our work and it was not as contractedAnd he said he had photos to prove itI then called *** *** and visited with him concerning what he had allegedWhen pressed for WHO the alleged other foundation contractor was, *** *** refused to answerFinally he stated he 'crawled under there and looked for himself, and took his own photos'At that point I told *** *** I would call him back once I visited with everyone involved and looked at the file.after visiting with all involved and reviewing the folder I sent *** *** an e mail, putting in writing again the work we had completedI then recalled *** ***I explained to him the 4" by 6" beam he took photos was part of the pier installation (he was not charged additionally for the new beam) and the 2" by 8" boards he was charged for was approx5' away from where he took the photo, along the main support beam of the home foundationI also explained had he crawled 5' more he would have seen this workI suggested he crawl back under his home and see if this was trueHe told me 'I know what's under my house'I said if you do not find my statement of contracted work to be true please notify meThrough a series of e mails where he accused URETEK of just about everything you can accuse a company of and accused me of being everything from a hot head to a poor business man, we agreed on a time where we, URETEK ICR South Texas would come out and crawl under the home and everybody have a look.He cancelled the meeting an hour and minutes before we were supposed to meetI think he may have found out work to be correct as contracted Lastly I would like to add *** *** is asking for money back due to his insistence that he put tile over a wooden structureverbally we visited with *** *** about tiling over a wood structureContracturally we both signed a contract stating:"Owner hereby understands and accepts while care will be taken to protect the items listed below, foundation correction is being completed and all responsibility for and agrees that URETEK ICR South Texas is not responsible for any damage to or resulting from damage to, (1) plumbing, (2) sheetrock, (3) wall covering, (4) carpet, (5) flooring, (6) door and/or window frames, (7) any other rigid material(s) and/or (8) any other damage resulting from URETEK ICR South Texas' work".Did I mention *** *** sells contracts for a living?Please note: a business that is ACCREDDITED from the Revdex.com for years and years does not suffer from integrity issuesA business that is a participant in the public eye twice a year at The Home Show, standing in the middle of the general public, does not suffer from integrity issuesA business that is a standing tall participant in every Engineering Group and every City, County and State entity is not suffering from integrity issuesMyself, my partners and all of URETEK ICR South Texas personel all drive decalled / signed vehiclesWe are proud of our company, our integrity and the projects we have completed.*** *** we are awaiting the rescheduling of our meeting to investigate the project we have completed.*** *** Managing Officer, URETEK ICR South Texas

Our foreman stood by his word stating that when he had completed the project (13 days earlier) that it was not like what customer was stating it to be. Customer was not happy with that response and asked salesman for a refund of $2,000.00 for work said ‘handy man’ had to complete. Customer left me a voice mail acknowledging me that he had received my attempts but just had been busy. I returned customers call at 3:33 pm. We visited for approx. 5 minutes concerning the project, how he saw it and how I saw it to be completed. He also stated that he personally had not been able to view our work before his ‘handy man’ had begun work and that he was only able to take his ‘handy man’s’ word because customer lived out of town and physically could not make the inspections himself. I told him I understood that and that was why I had made the detailed description and the detailed drawing and e mailed it to him, asking him to contact me if what I described to be was not completed. I also stated several times he had allowed his ‘handy man’ to work inside the property for 13 days before he personally looked at the project.
