I am rejecting this response because:The business did not comply to the terms of their own contract by not posting any of the items for sale BEFORE their 90 day window was up. The contract was signed on 9/12/12. The first payment AFTER the contract was signed was 1/5/13. The consignor stated he did not have enough room in his shop to display the tools and had placed them in storage until he could catalog them and put them up for sale, which was AFTER the 90 day period stated in the contract. His own contract says in Paragraph 3 "Upon receipt, urtoolshop.com will take necessary steps to sell your item" None of his "necessary steps" were completed within his own 90 day window. He violated the contract first.
